(1) Contracting Activity:
Air Force Materiel Command, USAF AFLCMC/HBMK
(2) Nature and/or description of the action being approved:
This action will be a modification to existing delivery order FA8720-10-D-0004 0005 with BAE Systems Information Solutions. The modification will upgrade various Commercial Off the Shelf components used within the JMPS-E and Common Component in order to maintain the Authority to Operate (ATO). The CLINs will be Cost Plus Fixed Fee for the general scope of work for the upgrade and Cost for the associated Other Direct Costs, such as software licenses and travel.
(3) Description of the supplies/services required to meet the agency's needs:
The modification will extend the period of performance by 12 months to 30 April 2017 in order to upgrade the JMPS-E system from existing COTS products: WINDOWS 7, JAVA7, SQL SRVR 2008, JBOSS and OFFICE 2010, to: WINDOWS 10, JAVA9, SQL SRVR 2014, and OFFICE 2013 in order to mitigate the risk of losing its the Information Assurance certification in FY17, which would result in a denial of ATO within the fleet.
This effort is within the scope of the multiple award IDIQ. The type of work and contract type are the same as that of the original delivery order; this modification merely continues the same work for another year. The ordering period for the IDIQ continues through June 2019, with performance permitted for another year after. The delivery date of the effort to be performed under this modification is well within the IDIQ period of performance. Finally, this effort is expected to cost only , well within the $919.64M ceiling of the IDIQ, of which only $355.78M has been obligated.
(4) Identification of the exception to fair opportunity and the supporting rationale:
FAR 16.505(b)(2)(i)(C) This action is a logical follow-on to the original delivery order. The current contractor has worked the JMPS-E project since its inception over 8 years ago. BAE has the greatest knowledge of the system and of what is required to meet the agency's needs in the most efficient manner.
Utilizing the current developer will save approximately and by saving time during the contracting process as well as building on an already extensive knowledge base. Transitioning to a new Contractor would likely take an additional months to put on contract, costing an additional in government support. It would also take approximately months and an additional for a new contractor to to come up to operational tempo, increasing development time and reducing the time spent fixing any coding errors that may occur.
(5) Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:
BAE will be required to submit a proposal with bases of estimates, justifying their proposed costs. The final contract price will be evaluated and negotiated by the Contracting Officer in accordance with FAR Part 15 to ensure the cost to the Government is fair and reasonable.

(7) Actions the agency may take to remove or overcome any barriers to increasing fair opportunity before any subsequent acquisition for the supplies or services:
This exception will ensure that JMPS-E 2.0.3 is released, allowing JMPS-E to maintain operational capability in the fleet.
However, after JMPS-E 2.0.3 is released the contract for follow on versions will be re-competed.
(8) Contracting Officer's certification that the justification is accurate and complete:
The Contracting Officer's signature on the signature page provides evidence that he/she certifies that the justification is accurate and complete to the best of his/her knowledge and belief.
(9) Certification of technical/requirements personnel that supporting data is accurate and complete:
As evidenced by his/her signature on the signature page, the Program Manager certifies that any supporting data contained herein, which is his/her responsibility, is both accurate and complete.
(10) Determination by the approving official that one of the circumstances in FAR 16.505(b)(2)(i) applies to the order
As evidenced by my signature on the signature page, I hereby determine that the fair opportunity exception checked in block 6 (Page 1) applies.
