Justification and Approval (J&A) for Other Than Full and Open Competition
Note 1: See guidance at the end of this document for completing the following sections.
Note 2: Each field will expand automatically if additional space is needed.
I. Contracting Activity.
Justification for Other Than Full and Open Competition. Department of the Air Force, Air Force Research Laboratory, Directed Energy Contracting Branch, AFRL Det 8/RVKDB, 3550 Aberdeen Ave SE, Kirtland AFB, NM 87117-5776, Contracting Officer: Susan L. Alley (505-846-6877).
II. Nature and/or description of the action being processed.
Contract modification to incorporate additional work and increase the value of existing contract, FA8650-13-C-1525 (cost-plus-fixed-fee). The contemplated modification will increase the value of the contract from , an increase of $1.0M (estimated contract cost).
III. Description of supplies/services required to meet agency needs.
The scope of the Long Range Imaging LADAR (LRIL) Transceiver contract is demonstrating, via laboratory and validation tests, the state of the art in Inverse Synthetic Aperture LADAR (ISAL) technology, with a goal of producing an ISAL image from a geosynchronous orbiting object for The LRIL Transceiver effort is anticipated to cost
The contemplated effort will develop, deliver, and support integration of a LADAR system for ISAL demonstration. Specifically, the Raytheon Company will procure components, develop subsystems, deliver, and provide integration support for an ISAL demonstration on the
. The specifications for the system to be developed are captured in a classified appendix.
The contract modification will include additional work to incorporate Synthetic Aperture Radar (SAR) image processing algorithms into the ISAL analysis environment and performance model, as suggested by the ST-level GEOMAST Independent Review Team. Additional work will also be added to design, fabricate, and integrate components at the MSSS required for integration and testing of the low power transceiver to be delivered by Raytheon. Additional laboratory investigations are also being added to address reliability concerns for the high power amplifier.
The design and development of the basic laser, stable master oscillator, waveform encoding, power amplifiers, and receiver system are being executed under a separate contract, FA8650-11-C-1162 (Identification at Range Integrated Sensor (IRIS)) with Raytheon. The contractor will procure components and produce a modified second transmitter and detection system utilizing R&D products (and contract residuals where possible) of the IRIS contract for and support the integration and demonstration of this system at for geostationary satellite (GEO) imaging. The contemplated phased approach is to develop a LADAR transceiver for the
. This will allow for ISAL imaging of cooperative targets, and image processing and analysis research and development.
IV. Statutory authority permitting Other than Full and Open Competition.
10 USC 2304(c), as implemented by FAR 6.302-1(a)(2)(iii), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The highly specialized hardware in both the SAL and ISAL systems are
Integration costs and risks make it economical to build 2 transceivers based upon the same waveform generation and amplifier chain for enduring research and demonstration capabilities.
The IRIS contract FA8650-11-C-1162 was awarded to Raytheon after a full and open competition in March 2011. Out of the four proposals that were received, Raytheon was chosen based on their technical maturuity and reduced risk in their
Justification and Approval (J&A) for Other Than Full and Open Competition proposed approach. IRIS is currently on contract for a seven year period of performance ending on 30 September 2017, and the contract has been modified to accelerate the design and development of the transceiver hardware to
. The contemplated LRIL Transceiver contract would require development and delivery of
These hardware deliverables would be based upon the IRIS design and development.
The contemplated effort is estimated to cost . It is estimated that the hardware development for the ISAL mission will cost if executed under the current contract with Raytheon. Additionally, it is estimated to cost
The cost to complete the effort with another contractor is estimated to be ~$18M and take 5 years from the current date to deliver hardware. This includes ~$13M for the hardware design, development, and delivery and the integration and testing costs of ~$5M. This estimate is based upon
This last estimate is based upon the SBIR process costs to produce a novel technology. The result of not allowing Raytheon to produce the hardware would be duplication of costs in the amount of $6M and 3 years schedule slip. This is based upon the 2 years of design, development, and risk reductions performed by Raytheon and 1 year to compete and award the contract and the of research and design performed by Raytheon, which is not yet mature enough to be transferred to another contractor.
Accordingly, Raytheon is the only firm capable of providing the services described in paragraph III above without the United State Air Force experiencing a substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The IRIS contract FA8650-11-C-1162 was awarded to Raytheon after a full and open competition in March 2011. Out of the four proposals that were received, Raytheon was chosen based on their technical maturity and proposed approach. In addition, a Notification of Contract Action (NOCA) describing the required capabilities for the LRIL Transceiver effort was posted via the Federal Business Opportunities website on 5 July 2012 and no responses were received.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Prior to executing the contract modification, the Contracting Officer shall evaluate the sole source proposal received in accordance with FAR Subpart 15.4, as applicable, and make a fair and reasonable price determination. Once received, all direct and indirect rates proposed by the Contractor will be verified with the DCMA in accordance with the company's most recently negotiated Forward Pricing Rate Agreement. In addition, the Government Program Engineers will be asked to provide a technical evaluation relative to the number and type of labor hours proposed, the materials to be purchased, any travel, and the subcontract support to be utilized, as appropriate. Travel costs will be verified utilizing various appropriate websites, as well as the Joint Travel Regulation for per diem and lodging. A Weighted Guidelines will be accomplished relative to the proposed fee and a properly executed Certificate of Current Cost or Pricing Data will be obtained at the conclusion of negotiations, prior to award.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
N/A.
X. List of sources, if any, that expressed interest in the acquisition.
