IV. Statutory authority permitting other than full and open competition.
AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901) FAR 13.501(a) Brand Name IAW 41 U.S.C 1901
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Air Force's minimum needs can only be satisfied by Green Hills Software LLC listed in the market research. From this market research, there are multiple sources that can provide this procurement. The 579th requires these tools to stay competitive. Without the tools the 579th SWES would be unable to continue development for the current software baseline, to include the ability to provide software fixes and enhancements. The reinstatement of support is required to maintain patches and updates to GHS software that is already owned by the government. The multi-functional Information Distribution System Joint Tactical Radio Set (MIDS JTRS) is a link 16 radio composed of embedded software
Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items
April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5April 2021 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5 that runs on the Integrity operating system developed and uniquely sold by GHS. Integrity is one of the few NSA certified secure real time operating systems. The tools being purchased are compilers and middle-ware were chosen by the contractors who originally developed the MIDS JTRS software. To meet mission requirements of the MIDS JTRS software, the 579th SWES must acquire these tools for engineering development and software release. Reinstatement of support is required to maintain these functional capabilities.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Green Hills Software LLC, is the only manufacturer who can provide the compatible MIDS JTRS software. A solicitation was posted to identify potential sources. We received responses from multiple potential vendors that can provide the required GHS software.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure the items described herein are negotiated at a fair and reasonable price to the Government. IAW FAR as supplemented, the contractor will be required to submit Certified Cost or Pricing Data and/or Other Than Certified Cost or Pricing Data. A detailed cost analysis and price analysis will be performed. The Contracting Officer will request a technical evaluation from the Defense Contract Management Agency (DCMA) to aid in the evaluation on the contractor's proposal. The Contracting Officer will seek audit assistance form the Defense Contract Audit Agency (DCAA) if necessary.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market Research was conducted IAW FAR Part 10, IAW AFMAN 17-1203 and DAFI 64-117 by the Acquisition Management Support Specialist. Efforts conducted in an attempt to provide competition include thorough market research via ESI, the mandatory source for software, which resulted in no available vendors for these Green Hill licenses. Searches on 2GIT and GSA, also resulted in zero matches for the part numbers requested.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
None.
X. List of any sources that expressed, in writing, an interest in the acquisition.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The Government will continue to solicit industry to determine if capability has been expanded.
XII. Certification by the Contracting Officer.
As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
