IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION:

10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED ABOVE

Screening action has resulted in the assignment of the AMC/AMSC of R3(AMSC R). The Government does not own the data or the rights to the data needed to repair this part from additional sources. It has been determined to be uneconomical to buy the repair data or rights to the data based on Navcom’s quote to provide Level III data at a cost of $6,000,000 if they were pressed to sell the data. It is uneconomical to reverse engineer the part. The Government repair shop does possess some of the testing and troubleshooting data for the CARA system; however, the repair data is at the circuit Card Assembly (CCA) level and it does not provide data down to the component level. The Government did not purchase the Level III rights and drawings to the CARA system and NAVCOM has stated they do not want to sell the drawings for the CARA system. In all cases the rights to use the data to repair these parts from additional sources are not owned by the Government and cannot be purchased, developed, obtained, or reengineered.

Market research (see section VII) determined that these NSNs should not be considered common commercial items. No source other than NAVCOM Defense Electronic Inc. (CAGE 57057) can provide this service exclusively for the AN/APN- 232 Electronic Altimeter system. The data is proprietary to NAVCOM, to include their ownership of interface test adapters needed for successful integration to the aircraft.

A complete data package is not available for competitive solicitation.

NAVCOM is the original and only manufacturer for the AN/APN-232 and possesses the knowledge of testing and evaluation processes for the sustainment of these CCA’s used in the CARA system. NAVCOM has configuration control and owns all engineering data that pertains to the past and current configurations.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will be synopsized on the Federal Business Opportunities (FedBizOpps) web page as required by FAR

5.201. It is anticipated that sources having an interest in

subcontracting may be identified through synopsis. Although the Government does not own data to support acquisition of this repair effort from any other source, any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential subcontracting possibilities.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost or pricing data to be used supporting the government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material and other direct costs, and direct and indirect rates will be negotiated by the government based on recommendations from the Defense Contract Audit Agency (DCAA), and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the government is fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS

NOT CONDUCTED

The System Engineer, 407 SCMS/GUEA, conducted market research in accordance with FAR 10.001 and 10.002. The engineer conducted research using internet searches; such as, Central Contractor Registration, Thomas Registry, IHS Haystack, ILSmart and Google. The engineer searched these websites by part /national stock numbers and by manufactures. Also, qualified individuals within the appropriate government sections were contacted for assistance gathering product background information. A search for HUB zone and service disabled veteran owned businesses was also conducted using the Dynamic Small Business Search Engine. Market analysis shows that there are limited companies capable of CARA system technology and manufacturing. Given the unique characteristics of CARA requirements and capabilities, only NAVCOM is qualified to perform this repair effort. NAVCOM is uniquely and solely capable of meeting contractual performance metrics. The item is peculiar for military application, the manufacturing processes and components used in the manufacture are unique to the avionics industry; therefore, this item should not be considered a common commercial item.

The data is proprietary to NAVCOM Defense Electronics Inc.

NAVCOM is the only responsible source due to their ownership of the data required for manufacturing. In addition, testing information is also needed for successful integration to the aircraft. The item must interface and integrate with existing configuration in regards to size, weight, and electrical requirements.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

A request to obtain data from NAVCOM Defense Electronics Inc. for CARA (Combined Altitude Radar Altimeter) R/T (Receiver/Transmitter) Engineering Level data rights was quoted at $6,000,000. Due to limited data rights, the limited number of test sets, and the projected workload for the remaining life cycle of the APN-232 system, it would be cost prohibitive to purchase the required data.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

See Section VI above.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE

TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES

It is not economically feasible for the Government to purchase unlimited Technical Data Rights and drawings at a cost of $6,000,000, and the requisite time it would take to qualify new sources. It is for the above reasons that no efforts to remove competitive barriers will be taken at this time.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
