Section A: General Contract Information
Is this a Bridge Action as defined in the AF Bridge Action Reduction Plan? Yes No
Contracting Activity: AFSC/PZAAA
Project/Program Name: HH-60 SADL Avionics Bus Box (ABB)
Purchase Request/Identification Number: FD2060-19-01090
Estimated Contract Cost (including Options):
Section B: Description of the Supplies/Services Required
This requirement is for the repair of the Situational Awareness Data Link (SADL) Avionics Bus Boxes (ABBs), NSN 5895-01-610-3177GC, PN AB2151/PMC05, from an unserviceable condition to a serviceable condition. The ABB serves as an interface between the SADL Radio and the 1553 Data Bus on the HH-60G Helicopter.
This will be a five-year contract with one basic year plus four one-year ordering periods, with the estimated period of performance being from 30 August 2019 to 29 August 2024. The total quantity on the contract is 30, and the best estimated quantities (BEQs) for each ordering period are:
Period BEQ
Basic (FY 19) 10
I (FY 20) 6
II (FY 21) 6
III (FY 22) 4
IV (FY 23) 4
The total estimated contract value is , including repair, data, and Contract Line Item Numbers (CLINs) for No Fault Found and Beyond Economical Repair to be used as necessary. A was applied to the estimated unit prices for each Out-Year Ordering Period. The basis for the average FY19 cost of repair was derived from previous small purchase repair contract FA8524-15-M-0002. This requirement will be funded with the 4930 Working Capital Fund (WCF).
The delivery requirement for this repair effort is 60 calendar days after receipt of awarded order or reparable assets, whichever is later. The nominal CLINs are as follows:
CLIN Description Cost Type
CLIN X001 Repair FFP
CLIN X002 NFF FFP
CLIN X003 BER FFP
CLIN X004 Data TBD
Section C: Justification for Soliciting from a Single Source or Brand Name
This NSN was screened and assigned Repair Method Code (RMC) / Repair Method Suffix Code (RMSC) R3/B. The 'R3' means repair, for the second or subsequent time, directly from the actual manufacturer. The 'B' means this part must be repaired by a source specified on a source control or selected item drawing as defined by the current version of ASME Y14.100, Engineering Drawing and Related Documentation Practices. The drawings in JEDMICS are vendor controlled by the OEM, Ballard Technology, Inc. Suitable technical data, Government data rights, or manufacturing knowledge is not available to permit repair by other sources. Although, by ASME Y14.100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained.
Additionally, if the Government were able to obtain the data, we would not reach the break-even point on the investment until after the HH-60G platform has retired.

This item has had an inconsistent failure rate since 2014. FA8524-15-M-0002, a small purchase in 2015, has been the only repair contract, and it was established in response to a small number (4) of unexpected failures. Prior to that contract, the item had historically performed with virtually no failures. Since that contract ended in 2016, failures did not appear again until mid-2018.
As of 21 May 2019, there were 7 routine backorders, 2 MICAPs, and 10 reparable assets in Air Force supply. The need date for this requirement is no later than September 2019 in order to reduce risks of (1) increasing backorders or the development of urgent requirements without a repair vehicle in place and (2) a continued void in performance data (i.e. repair history) for the reliability of this particular item. Any delays to meeting this need date will be unacceptable to the War-fighter; current requirements will remain unfilled and affected aircraft will be grounded until requirements can be met.
The OEM retains complete control over the data rights needed to repair the ABB. Their reasoning is to preserve future business opportunities. Ballard Technology, Inc. is the only source capable of satisfying the USAF requirements for NSN 5895-01-610-3177GC, P/N AB2151/PMC05. The only technical documents the Government possesses regarding the ABB are:
Technical Order (TO) 1H-60(H)G-4-5 Fig: 914.2 Index: 27/3, which is an illustrated parts breakdown (IPB); TO 33D7-4-178-1, which is a support equipment operations manual; and two vendor-controlled drawings that are reference only and do not include repair procedures. Since technical data rights are not owned by the Government, there is currently no option to compete this requirement among multiple potential sources. The contract action sought by the U.S. Air Force requires services and capabilities that are not possessed by any source other than the OEM.
Section D: Efforts to Obtain Competition
As part of the market research, an RFI was posted to FedBizOpps on 8 March 2019 and closed on 8 April 2019. However, no responses were received. Further efforts to obtain competition included a request to the OEM to sell the data rights for this repair to the Government, sent on 8 February 2019. On 5 March 2019, the OEM responded that they are unwilling to sell the data rights and are unable to set up repair anywhere other than their own facility.
Both the previous and current market research yielded no alternate sources of repair for the ABB, whether due to lack of technical data rights or capability.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
The requiring activity will assess data rights purchase opportunities as needed from the OEM and conduct market research to identify new supplier alternatives that could potentially preclude the necessity for future sole source acquisitions of the same services.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
