Single Source Justification (Simplified Acquisition)

Section A: General Contract Information

Contracting Activity: AFSC/PZAAA Purchase Request/ Identification Number:

FD2060-18-02083

Project/Program Name: Computer Navigator/Aero Dynamix, Inc. Estimated Contract Cost (including Options):

Section B: Description of the Supplies/Services Required

This requirement is intended to repair the Computer Navigator (NSN 5826016675541; P/N 011-01066-00) in support of the UH-1N Helicopter program. The UH-1N has a fleet of 68 and supports the Presidential Mission.

The AMC code is R3/B. Original design of the end item and parts thereof, or the design functional capabilities of the end item, shall not be changed, modified or altered unless such changes are authorized in writing by the Procuring Contracting Officer. This part must be repaired by a source(s) specified on a source control or selected item drawing as defined by the current version of ASME Y14.100, Engineering Drawing and Related Documentation Practices. Suitable technical data, Government data rights, or manufacturing knowledge is not available to permit repair by other sources. Only currently approved source is the Original Equipment Manufacturer, Aero Dynamix Inc.

as they developed the modification as part of a supplemental type certificate (STC) for other aircraft and Aero Dynamix owns the data rights to the night vision modification that was applied to the GNS 530AW. Another repair authority will not be able to develop the necessary expertise via reverse engineering at a reasonable cost and schedule because the Computer Navigator is proprietary and patented to Aero Dynamix Inc.

Section C: Justification for Soliciting from a Single Source

6.302-1 - 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Recommended source is the Original Equipment Manufacturer (OEM), Aero Dynamix Inc., because they own the data rights to the repair and modification of the Computer Navigator and due to the critical nature of the components, requires that all repairs be conducted with precision and expertise. The Government does not adequate data and lacks rights to the data needed to contract with any additional sources to obtain these repair services. Reverse engineering the Computer Navigator is not a viable solution to establish a competitive environment. The fleet of 68 UH-1N Helicopters are retiring and will be replaced by a new weapon system through competition. Retirement of the UH-1N fleet is estimated to begin CY2018, and continue draw down to zero USAF inventory by CY2030. By CY2025, 36 of Air Force Global Strike Command's fleet of 41 UH-1N Helicopters are schedule to retire. The remaining 32 UH-1Ns are scheduled to retire by CY2030. The retirements will result in a rapid and steady increase in asset availability with more rescue hoists supporting fewer helicopters (minimizing or eliminating need for future production). The Government would not recoup the investment to reverse engineer this component prior to system retirement.

Section D: Efforts to Obtain Competition

In order to break barriers to competition, the last inquiry to purchase data rights from the OEM was 25 June 2018. The OEM responded 29 June 2018 stating that they did not wish to sell data rights to the government. The email was signed by Jim Darr, Repair Station Manager. No inquiries from new contractors were received. Any Government effort to obtaining technical data via reverse engineering of the part will be cost prohibitive with no return on

Single Source Justification (Simplified Acquisition) investment over the life expectancy of the airframe. The fleet is expected to draw down and fully retire by FY2025.

Section E: Steps to Preclude Future Single Source Awards

Techniques used included Internet searches, email correspondence with qualified sources, email correspondence with potential sources, personal knowledge of the UH-1N history, and general engineering knowledge of the UH-1N aircraft.

The company site of Aero Dynami, INC was visited. We perused the www.Thomasnet.com website for companies with general expertise in the repair of radar/avionic systems. However, without the technical data package they (the companies) would not have the specific and complete knowledge needed to repair the modified Computer Navigator system GNS530AW.

Due to lack of technical data, full and open competition is not an option. Current need for operational components does not allow for unqualified sources to take the time necessary to reverse engineer each component in order to conduct a repair. While there are vendors capable of repairing a standard GNS530AW, the only approved vendor for the NVIS modified GNS530AWs is Aero Dynamix Inc. Therefore, sole source repair from the OEM is recommended.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
