Section C: Justification for Soliciting from a Single Source
This Flat Panel Monitor was originally installed on the MC-130P by SSAI as part of TCTO 1C- 130- (M) P-510 which replaced the existing Instrument Panel 9" CRT Monitor with the 9" Flat Panel Monitor. SSAI purchased the Flat Panel Monitor from Avalex Technologies Corporation and supplied the government with a Specification Control Drawing. The SSAI Specification Control Drawing does not include sufficient information to repair the Flat Panel Monitor and this information is proprietary to Avalex Technologies Corporation.
The Flat Panel Monitors have been previously repaired by Avalex Technologies through a 5 year sole source contract. The government does not own the complete technical data. Numerous attempts to acquire data have been unsuccessful. Original Equipment Manufacturer (OEM) is unwilling to sell the data rights as of 19 Jan 2017.
Reverse engineering has been considered uneconomical considering the small quantities of repairs. Based on engineering experience, the estimated cost for the labor required to reverse engineer the Flat Panel Monitor for repair purposes is over $400,000 and take approximately 1 year to accomplish. This cost does not include any necessary equipment for reverse engineering and testing of the monitor and its components. It also does not include procuring a new monitor to provide as GFE or the cost of First Article Testing
Section D: Efforts to Obtain Competition
A query at the Central Contractor Registry showed over 3,000 companies with the same NAICS code, 334511.
Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing which covers a wide range of products and services. Example companies on the list are Raytheon, Aydin Displays, and BAE Systems. Based on the results of the Market Research findings there are numerous large and small businesses that repair or manufacture Flat Panel Monitors. Flat Panel Monitors are commercial items and are used in numerous applications. Since the Government does not own the technical data for this part all sources, other than the OEM for this Flat Panel Monitor, would require extensive time and money to provide reverse engineering including data and test procedures to repair the Monitor. Avalex Technologies Corporation, CAGE 096Y5, 115A Gregory Square, Pensacola, FL 32502 is a known source and has historical work, which was performed successfully.
Section E: Steps to Preclude Future Single Source Awards
The Government does not own the technical data. The OEM is unwilling to sell the technical data at this time.
The government possesses the Vendor Item Control Drawing # 1015309, Cage 9S037. A vendor item control drawing does not provide sufficient detail to allow competitive procurement. Per ASME Y14.24 a vendor item control drawing provides an engineering description and acceptance criteria for commercial items or vendor-developed items that are procurable from a specialized segment of industry. By definition of the available data, there is only a specialized market segment capable of producing the required product. Competitive procurement is not viable based on the available data. Avalex Technologies Corporation is the only company with the required technical knowledge.
