The total estimated cost of this acquisition for a five year period, including all quantities and maximum value is $298,330.69 which is based on last procurement history (FA8524-10-M- 0001) and calculated future unit prices with 3% inflation added to each year to calculate out year prices.
Delivery requirement is basic ordering quantity is required within 15 months After Receipt of Order (ARO). Out year buy quantities are required within a 12 month period of initiating a delivery order.
AMC/AMSC code for this item is 1B. The AMC Code of “1” means suitable for competitive acquisition for the second or subsequent time. The AMSC Code of “B” indicates the data is source controlled drawing. Purchase must be from approved sources.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 USC 2304(c), as implemented by FAR 6.302 (FAR 6.303-2(b)(4)), Only One or a Limited Number of Responsible Sources, and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF
THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)
The Air Force’s requirement can only be satisfied by the unique supplies or services Available from approved sources that possesse the complete engineering data packages that includes assembly, schematic, and test procedures for this item. The government does not have in its possession sufficient data to purchase these parts from any other source. The engineering drawings for the listed part are source controlled, and as such, are inadequate for use in manufacturing. The item has an Acquisition Method Code of 1B; the government does not own the rights and data required to purchase this item from any other source other than the approved sources. The government will not acquire a competitive data package for the armature relay due to Tyco Electronics and Hamilton Sundstrand stating, via phone 5 Nov 2013, they are unwilling to sell the data rights to the government. In addition, this Relay is an ERRC: P item. The 409th will initiate transfer to DLA once the relay is supportable. As a result, no further actions to obtain this data have been taken since it has been determined there is currently insufficient justification for obtaining funds to reverse engineer in order to qualify additional sources for these items. Based on engineering project data, and engineering experience, it is anticipated that a RE effort could cost approximately $1M-$3M and would require 3-6 years to complete with no guarantee of success or cost savings. At this point, a RE effort cannot be economically justified nor could the C-5 Engineering Office successfully complete such a project within the timeframe required to support current demands.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized on the Federal Business Opportunities (FedBizOpps) web page as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Although the Government does not own data to support acquisition of the armature relay from non-approved sources, any source who responds to the Government as a result will be identified to the prime contractor as a potential for subcontracting possibilities.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.404, it is anticipated that negotiations will be conducted using information other than cost and pricing data from the contractor. Thorough price analysis will be conducted using available information and approved pricing techniques that will support the contracting office in making a determination that the price paid to the contractor is fair and reasonable to the Government.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
The Market Research techniques used to conduct this survey included Government engineering data searches and internet searches such as ThomasNet-Relays, http://www.thomasnet.com;
Google-“175 Amp relay”,Http://www.google.com; Honeywell-relay, http://www.honeywell.com. None of the research identified sources for purchase or repair.
Additional search engines were evaluated using key terms such as “175 AMP Relay”, and no other vendors were identified for Armature relay with the same specifications as the C-5 Armature Relay. Also, a review of Government data bases were examined to determine if a commercial item was suitable to meet the Air Force’s needs, or non-developmental items could be modified to meet the needs as available in the market place. Acquisition Method Code (AMC) code was check and screening, procurement history, Item Acquisition Method Suffix Code (AMSC) screening through the Contract Data Management System, and websites queries were also conducted. No other products were found that matched the C-5 Armature Relay specifications. The approved vendors have proven that their item meets the demanding requirements and are the only sources that can provide the item.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
None
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
See Section VI above.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
Review disclosed that sufficient detailed dimensional, specification, and testing requirements are not available to allow a source other than the prime contractor or their vendors to purchase this item. The sources as stated above are the only known suppliers possessing the engineering knowledge, expertise, and who can deliver the Armature Relay with the time frame needed by the government. Circumstances described in parts V and VIII above preclude the Government from competing this item on future acquisitions. 409 SCMS will initiate transfer to DLA once supportable due to the relay being an ERRC: P item. Therefore, the government will not continue to seek opportunities to purchase data rights each year.
XII. CONTRACTING OFFICER’S CERTIFICATION
The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)).
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
