IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2), only one or a limited number of responsible sources and no other types of supplies or services will satisfy agency requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED ABOVE (APPLICABILITY OF AUTHORITY)

Research has identified CPI Incorporated (cage 03ZJ4) as the currently qualified repair source available with the unique experience, expertise and relationships to satisfy the Government’s requirements of this highly specialized item. The government does not possess the detailed engineering information that would enable a new vendor to successfully develop a repair and testing methodology for these items. The fact that the Government does not possess a full data package precludes a full and open competition for the repair of items.

The contract would be required to supply as a minimum: functional block diagrams, outline drawings including reference designators, schematic diagrams (electrical, mechanical and electro-mechanical), Preferred Parts Selection Lists (PPSL), Non-Standard Parts List, Detailed Troubleshooting & Fault Diagnostic Procedures, Detailed Repair Procedures, Special Material & Process Guide, Identification of Special Tooling, Environmental Qualification Procedures, Acceptance Test Procedures, Special Test Equipment requirements, obsolete parts and identification of alternatives or requisite redesigns, and the means to validate all of the above. This will take a vendor approximately two (2) years to accomplish given the historical data on similar projects. An additional one (1) year will be required for the Government to approve the source through contract auditing and OSS&E testing by AFLCMC/WNYEBA.

Once all of these tasks are complete, the government can initiate the contract to repair the item.

Therefore, the research of available market information supports the repair of the asset from the original manufacturer, CPI due to the lack of Government owned drawings and engineering data. Development of alternate suppliers can be pursued at a later date if the Government is successful in obtaining a complete data package or if an engineering project to fund second source development is approved. The Government requested a price quote to purchase all internal data and repair data related to these NSNs from CPI on 11 February 2013. CPI declined to sell this data as they consider the data to be proprietary.

Based on previous project data and contract efforts, it would take approximately three to four years and no less than for another vendor to complete the clean-sheet redesign or reverse engineering effort, deliver a technical data package and qualification reports, and provide First Article assets. This estimate assumes the new vendor possesses the required special tools and special test equipment;

without this equipment the estimated cost would be higher.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will be synopsized on the Federal Business Opportunities (FedBizOpps) web page as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Although the Government does not own data to support repairing these assets from any other source, any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential source for subcontracting possibilities.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Management Agency (DCMA) and/or the Defense Contract Audit Agency (DCAA) and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted in August 2013 by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

Market research was conducted as outlined by FAR 10.002 using the following methods: reviewing industry reports, trends and product developments; discussions with industry representatives; internet searches; and industry knowledge possessed by EA Pods Engineering Staff and the ALQ-172 Engineering Staff. Engineering is actively engaged in component product sustainment, staying abreast of industry developments by reviewing industry reports, trends, and product developments. Some of the sites used were:

http://www.tritonsvc.com/web/guest/products http://dsbs.sba.gov/dsbs/ http://www.cpii.com/division.cfm/8

Each one of these vendors’ web-based product line or product history was reviewed to determine if the part(s) under consideration were being repaired, by that vendor if that vendor had information concerning associate contract agreements with CPI to share or acquire the proprietary data for the specific part(s) under consideration Triton ETD LLC was the only small business with prior experience in airborne mini traveling wave tubes, although no direct experience with either of these TWTs. Triton was contacted 7/22/13 to discuss possible repair. Triton Services does not have a contract agreement with CPI regarding their proprietary data for this specific part number. Government waited 7 days with no response from Triton indicating interest in repair.

These items are custom made for the USAF and tend to have limited application.

The current drawings for the TWT are proprietary to CPI.

Review of Government-proprietary component product data-base (Haystack), for the specific product group.

To qualify additional sources, the Program office could submit an appropriate budgetary request for Research & Development project funds on this item for inclusion in the next available budget call in March 2014. Once funded, an interested company could attempt to qualify to repair these components.

Qualifying a new source will take approximately 3 years from receipt of funding to actual production.

Qualifying is dependent on receipt of funding, but if funding was received for 2015 then qualification would be in 2019.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

CPI currently provides ALQ-172 and ALQ-184 repair support and is the only source capable of repairing the listed NSNs at this time.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

See Section VI above.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

Qualifying a new source would require a clean-sheet redesign or an extensive reverse engineering project for the ALQ-184 due to the complexity of the item and the fact that the government does not own internal drawings for the item but merely a source control drawing of the form, fit, and function requirements. The source control drawing does not provide sufficient data to enable another source to qualify for repair.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that the contracting officer has determined this document to be both accurate and complete to the best of the contracting officer’s knowledge and belief (FAR 6.303-2(b)(12)).

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
