C. Type J&A: Individual
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED MEETING THE
AGENCY’S NEEDS:
A. The requirement is to procure a total quantity of 184 each F-16 Coil and Housing Assemblies, NSN 1630-01-055-5232 /Part Number 9543424, replacement spares at an estimated unit cost of The F-16 Coil and Housing Assembly is part of the metering valve on the F-16 braking system. This part is responsible for supplying the correct amount of brake pressure to the brakes based upon an electrical input received from the anti-skid control box. The F-16 Coil and Housing is a very critical assembly that must function correctly so the pilot does not lose brake control.

B. Total estimated cost is: . This estimate is based on USAF mission requirements as computed by the D200 Requirements Determination System. This action will use 4930 FC04 working capital funds. Since the government does not control the design or own the data required to manufacture the F-16 Coil and Housing Assemblies, there are no feasible actions that could develop future competition as referenced in section V, paragraph C below.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
10 USC 2304 (c) (1) as implemented by FAR 6.302-1 -- Only One Responsible Source and No
Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY):
A. The above authority was selected because the requirement is for the the manufacture of the
F-16 Coil and Housing Assembly which is a highly specialized component, whose design is currently limited to Meggitt Aircraft Braking Systems. The design of the F-16 Coil and
Housing Assembly is specifically manufactured for the F-16 aircraft’s size and energy requirements. The drawings and data were created at Meggitt Aircraft Braking Systems’ own expense. As a result, the Government does not possess the required drawings and data for the F-16 Coil and Housing Assembly. Interested vendors would have to be willing to invest the time, funding, and manpower required for reverse engineering and qualifying the entire
F-16 wheel and brake package at their own expense.
B. The F-16 Coil and Housing Assembly requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source requires acquisition of the part from the approved source. Meggit Aircraft Braking Systems retains data rights, manufacturing knowledge, or technical data that are not economically available to the
Government, and the data or knowledge is essential to maintaining the quality of the part.
An alternate source must qualify in accordance with the design control activity’s procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. This acquisition is for continued production of highly specialized components.
C. Manufacture of the F-16 Coil and Housing Assembly requires highly specialized manufacturing processes and data. The government does not possess the design or data or liscense rights required to allow full and open competition, for the manufacture and procurement of the F-16 Coil and Housing Assembly. Meggitt Aircraft Braking Systems is the brake Original Equipment Manufacturer (OEM) with design control, authorization, and documentation to manufacture the F-16 Coil and Housing Assembly and is the only source that possesses the required data to manufacture the F-16 Coil and Housing Assembly. The last attempt to obtain sufficient data and license rights to allow for full and open competition from Meggitt Aircraft Braking Systems was on 20 NOV 2012, by the 417 SCMS/GUMD
Integrated Process Team. Meggitt Aircraft Braking Systems declined to provide or sell the government the necessary data and license rights to allow for competition on 4 DEC 2012.
VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:
A. Sources Sought Synopsis: FD2020-13-00113 notified interested contractors of the
Government’s need to procure 184 each F-16 Coil and Housing Assemblies NSN 1630-01-
055-5232 /Part Number 9543424. The Sources Sought closed on 18 DEC 2012 with the following results:
1. On 13 DEC 2012, Thomas Instrument responded by stating they would be interested in this opportunity from the standpoint of reverse engineering the F-16 Coil and Housing
Assembly and becoming a qualified source. Thomas Instrument then requested how they might be able to obtain sample parts in order to begin the engineering and qualification effort. On 17 DEC 2012, the GUMD Program Manager responded by stating that Thomas
Instrument would need to contact the Source Development Office in order to obtain sample parts to begin the engineering and qualification effort.
B. This requirement will be synopsized in FedBizOpps, as a notice of contract action IAW FAR
5.201. If other sources express interest as a result of this synopsis or other action, they will be listed in the official contract file.
C. Other actions: None
D. Qualifying Country Sources: None
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The following steps will be taken to ensure that the anticipated cost of this acquisition will be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the
Federal Acquisition Institute and the Air Force Institute of Technology. The Contracting Office will obtain certified cost and pricing data IAW FAR Subpart 15.403. The Final Step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.
VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS,
OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED:
A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties. In addition, the 417 SCMS/GUMD Integrated
Product Team conducted market research that yielded the following results:
1. On 20 NOV 2012 a search conducted on the Thomas Net (http://www.thomasnet.com), an internet site from the Thomas Registry with NSN 1630-01-055-5232 /Part Number
9543424 resulted in zero results in the product, company name, brand name, CAD drawings and industrial web directories.
2. On 21 NOV 2012, a review of commercial catalogs and other product literature was completed and determined this part to be commercial. The review indicated no other alternate commercial items or non-developmental item (NDI) will meet the requirement, nor can the requirement be modified to permit use of existing commercial items or NDIs.
3. The 417 SCMS/GUMD Integrated Product Team reviewed the procurement history for the F-16 Coil and Housing Assembly and identified Meggitt Aircraft Braking Systems as being the only manufacturer utilized to procure this requirement.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
A. The 417 SCMS/GUEA Engineer has determined that reverse engineering costs are estimated to exceed $2,620,870.10. These costs map out exactly what it would cost the Air Force to duplicate the workload/product already being provided by the sole source contractor. The total dollar value of this acquisition is around .14% for the total reverse engineering costs and would take another 36.27 years to break even.
B. Accordingly Meggitt Aircraft Braking Systems is the only firm capable of providing the requirement for the supplies described in Section III above, without the government experiencing substantial duplication of costs that could not be expected to be recovered through competition.
