C. Type J&A: Individual

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED MEETING THE

AGENCY’S NEEDS:

A. The Upgraded Data Transfer Unit (UDTU) is a major part of the data transfer equipment (DTE). This equipment supports a controlled exchange of information between the UDTU and the avionics equipment. The UDTU provides the means to automatically or manually upload initialization data to the Control Display Unit (CDU) and Embedded GPS/INS (Global Positioning System/Inertial Navigation System) EGI wind data, weapons data, and pilot preferences to the Integrated Flight Fire Control Computer (IFFCC) from the Data Transfer Cartridge (DTC).

C. Total estimated cost is: . This estimated value is based on the D200A Weighted Repair Costs system accomplished Sep 2011. This action will utilize 4930 Material Support Division Working Capital funds.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION:

10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1 -- Only One or Limited Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED

ABOVE (APPLICABILITY OF AUTHORITY):

A. The above authority was selected because the requirement is for highly specialized services.

The government estimates award to any other vendor would result in substantial duplication of cost to the government that is not expected to be recovered through competition.

B. GE Aviation Systems LLC possesses the skills and equipment required to repair these Advanced A-10C Avionics items and retains the technical data necessary to satisfy the government’s requirement. GE, maintains the repair knowledge and experience required to sustain the quality and integrity of the parts. This item is not considered to be commercial but the repair process had been determined to be commercial. The government has limited rights to the data necessary to create additional sources of repair. The last attempt to obtain the technical data package was submitted 9 Dec 2010 by the 416 SCMS. The vendor responded to the ROM (Rough Order of Magnitude) requesting for the purchase of the data package. The purchase of the data was denied by the Chief Engineer due to the fact that the data was too old with too many obsolescence issues. The Chief Engineer has not changed his position since the request in 2010.

C. Accordingly, GE is the only firm capable of providing the supplies and services described in Section III above without the government experiencing a substantial duplication of cost to the government that is not expected to be recovered through competition.

VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:

A. Sources Sought Synopsis: A repair sources sought synopsis was issued 8 Feb 2011, #FA8251UDTU-2011, with a response date of 8 Mar 2011. The sources sought stated, “The Government is seeking potential sources for repair of the Upgraded Data Transfer Unit

(UDTU), 7025-01-406-5838FJ.

B. The UDTU reverse engineering effort was awarded to ARINC, 4141 Colonel Glenn Hwy, Dayton, OH 45431 on contract GS00Q09BGD0013 delivery order GST0810BP0059, 11 Jan 2012. Period of Performance is 2 years (Jan 2014). Included in this effort is the re-design of processor circuit card and power supply, level 3 data package and test requirement document (TRD). The re-design will mitigate obsolescence issues.

C. Re-Post of Sources Sought Synopsis: The repair sources sought synopsis was re-posted on April 4, 2012. Honeywell responded during the sources sought timeframe. Honeywell currently operates a Government Owned Contractor Operated (GOCO) facility, Kansas City Plant (KCP) in Kansas City, MO. KCP requested drawings, specs, or any other data. Since the Government has no data, there was no data to provide. KCP requested both a functioning and a failed unit. PSI Repair Services also expressed interest. Both KCP and PSI Repair Services will receive loaned assets in the near future. However, award will not be delayed to provide contractors with an opportunity to demonstrate their ability to meet the standards necessary for the repair of the UDTU.

D. This requirement will be synopsized in FedBizOpps, as a notice of contract action IAW FAR

5.201. If other sources express interest as a result of this synopsis or other action, they will be listed in the official contract file and will be given an opportunity to prove they have access to the necessary data and the ability to manufacture this part.

E. Other actions: None

F. Qualifying Country Sources: None

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

The following steps will be taken to ensure that the anticipated cost of this acquisition will be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The Contracting Office will obtain certified cost and pricing data IAW FAR Subpart 15.403, when required. The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.

VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED:

A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

B. Additionally, specific market research was conducted by 416 SCMS engineer Devin

Jorgensen 28 June 2011. The Market Research Strategy focused on gathering information to support establishing additional repair sources for the UDTU. Data sources including DOD Emall, ThomasNet, ILSmart, IHS Haystack Gold and Pinpoint were utilized and reviewed.

No interchangeable or substitutable UDTU’s were identified. Engineering determined that there were no commercial items or NDI (non-developmental items) available that could be modified to satisfy the governments needs. This is a very complicated item to build or repair and the Government has only Limited Rights in technical data. These searches were based on nouns, NSN’s and part numbers. The searches did identify additional sources but none of these sources were able to overcome the costs and expertise required to develop full and open competition.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

None

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION:

A. International Enterprises Inc. (IEI), 108 Allen St, Talladega, AL 35160, CAGE 50218 responded to Sources Sought Synopsis #FA8251UDTU-2011 with a white paper. IEI was loaned an asset and in doing so, came to the determination that they could not adequately repair the UDTU.

B. Duotech Sevices Inc., 245 Industrial Park Rd, Franklin, NC 28734, CAGE 5Y609 also responded to Sources Sought Synopsis #FA8251UDTU-2011 with a white paper. Duotech was loaned and asset which Duotech returned with a suggestion that the Government pursue failure analysis of the UDTU. Duotech did not develop any repair capability and has expressed no further interest in this requirement.

C. Sterling Design Inc., 109 Ellery St, Oceanside, CA 92054, CAGE 4LLQ0 responded to the Sources Sought Synopsis via email. Sterling Design didn’t request loan of an asset to investigate or develop repair capability of the UDTU. Sterling Design has expressed no further interest in this requirement.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
