FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING ACTIVITY
United States Air Force
OL:H/PZIMC
6038 Aspen Ave. (Bldg 1289) Hill AFB, UT 84056 Contracting Officer: Leslie Westcott
DSN 586-5441
Justification for Other Than Full and Open Competition PR Number: F2DCCS3261A001
1. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
1. Upon approval to use other than full and open competition procedures, Hill Air Force Base (Hill AFB) will issue a service contract. This acquisition is for the Theater Battle Management Core System Force Level (TBMCS-FL) program. The award will be made to Lockheed Martin Information Systems and Global Services (hereinafter referred to as Lockheed Martin or LM), 9970 Federal Dr., Colorado Springs, Colorado 80921, Cage: 60854.
1. Type J&A: Individual
1. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
1. The purposes of this acquisition is to provide short term TBMCS-FL Tier II Helpdesk for Maintenance Release 2 Virtualized (MR2V) and to provide technical knowledge transfer of MR2V to Hill AFB. MR2V is a maintenance release of the TBMCS-FL system and was originally created by LM. Hill AFB now sustains the TBMCS-FL program with the customer being the United States Air Force.
1. Theater Battle Management Core System Force Level is the mission critical Command and Control (C2) system that provides management of air battle planning, intelligence operations, and execution functions in peacetime, exercise, and wartime environments. TBMCS-FL is used to task all air assets in the Area of Responsibility (AOR) (not solely Air Force assets) and is the critical planning tool of commanders and staffs at all levels of the Joint Task Force including the Joint Force Air Component Commander (JFACC). TBMCS-FL is used by the United States Air Force, Army, Navy and Marine Corps.
1. The contract covered by this J&A will include; A) Short term Tier II Help Desk services for a single maintenance release of TBMCS-FL (MR2V), B) Technical knowledge transfer of maintenance release from LM to Hill personnel.
1. *No additional Hill AFB follow-on contracting actions are contemplated for these activities.*
1. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1
1. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALFICATIONS OR NATURE OF THE ACQUSITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABLE AUTHORITY):
0. As the original developer of the TBMCS-FL system as well as the maintenance update MR2V, Lockheed Martin possesses unique and highly specialized TBMCS-FL knowledge and equipment that are required for the Help Desk activity. TBMCS-FL is complex software comprised of approximately 5 to 10 million lines of code. This software and its organizational structure must be fully understood in order to provide the needed activities. LM has a TBMCS-FL specific computer lab that is also required to perform these acxtivities.
0. Tier II Helpdesk service is a 24/7 telephone support service provided to the end-user of TBMCS-FL. It’s purpose is to provide technical guidance (support) to the Warfighter to solve operational issues and problems that the Warfighter encounters while using TBMCS-FL. MR2V is a maintenance release to the TBMCS-FL system and is used primarily by the United States Marine Corp (USMC). The support calls range in complexity and seriousness from simple user errors that take only a few minutes to solve to problems with the software that can cause mission failure. If the MR2V helpdesk was not provided then the user would have no viable means to solve technical problems that they themselves could not otherwise solve. This could cause, at worse case, mission failure.
Accordingly, Lockheed Martin is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing an unacceptable risk of mission failure for its USMC user of TBMCS-FL.
1. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLCITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:
1. Sources Sought: In a prior sources sought effort LM was the only company that was deemed capable of working on TBMCS-FL activites. In 2012 TBMCS-FL sustainment and technical knowledge was being transferred from the original developer and sustainer (LM) to Hill AFB, as mandated by the TBMCS-FL Program Office at Hanscom AFB. A Request For Information (RFI), solicitation number FA822412UlFL, was posted on Fed Biz Ops with responses due 17 April 2012. The RFI requested information from interested parties about their specific TBMCS-FL knowledge and ability to transfer TBMCS-FL sustainment from LM to Hill AFB. Two (2) parties submitted responses to the RFI, one from Lockheed Martin and one from Northrop Grumman. The response from Lockheed Martin was acceptable and clearly provided information as requested in the RFI. Northrop Grumman elected to withdraw their interest in the RFI and any contracting action that may occur as a result of the RFI process since they lacked the technical sustainment knowledge of TBMCS-FL.
1. Other Actions: None
1. Qualifying Country Sources: None
1. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
Lockheed Martin is known by the Government to be the only company that possess TBMCS-FL MR2V knowledge. With the immediate need of the contract, relatively low value of the contract and the short term non-recurring nature of the contract, there is no other company that can perform the required tasks of the contract. Therefore further market research was not conducted for this effort.
1. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION
None
1. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTERESTED IN THE ACQUISITION
Lockheed Martin, see section VI above.
1. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
The Government does not anticipate any follow-on contracting actions for the TBMCS-FL MR2V helpdesk activity.
1. CONTRACTING OFFICERS CERTIFICATION
The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12)) and that the price/cost will be determined fair and reasonable before execution the contract action.
1. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION:
As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
