(c) If resolution cannot be made by the contracting officer, the interested party may contact the Cen-ter/MAJCOM/DRU or AFISRA ombudsmen. Concerns, issues, disagreements, and recommendations that cannot be resolved at the Center/MAJCOM/DRU or AFISRA level, may be brought by the interested party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (571) 256-2397, facsimile number (571) 256-2431.

(d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer (End of clause)

(i) Have been provided to the Government or others without restrictions on use, modification, reproduction, release, or further disclosure other than a release or disclosure resulting from the sale, transfer, or other assignment of interest in the technical data to another party or the sale or transfer of some or all of a business entity or its assets to another party;

(2) Except as provided in paragraph (b)(1) of this clause, the Government may use, modify, reproduce, release, perform, display, or disclose technical data within the Government only. The Government shall not--

(i) Use the technical data to manufacture additional quantities of the commercial items; or

(iv) Any such non-disclosure agreement shall address the restrictions on the covered Government support contractor's use of the data as set forth in the clause at 252.227-7025, Limitations on the Use or Disclosure of Government-Furnished Information Marked with Restrictive Legends. The non-disclosure agreement shall not include any additional terms and conditions unless mutually agreed to by the parties to the non-disclosure agreement.

The Contractor, its subcontractors, and suppliers are not required to provide the Government additional rights to use, modify, reproduce, release, perform, display, or disclose technical data. 2.1 APPLICABLE DOCUMENTS

TBMCS FL RFP Forms/Documents:

DD Form 254—DOD Contract Security Classification Specification-Dec 1999

2.2 Background

TBMCS FL is a Command and Control suite of software tools used to build the Air Battle Plan, and publish and disseminate the Air Tasking Order (ATO) and Airspace Control Order (ACO). TBMCS FL is the sole system providing this capability for the USAF Unit Levels (Wings); Air Operations Centers (AOCs); aboard Navy aircraft carriers and command ships; with Marine Corps Air Wings and support units; and at North American Air Defense Command (NORAD) Regions/Sectors/Wings. TBMCS FL fielded systems will continue to be used during peacetime, exercises, humanitarian missions, contingency operations and war. TBMCS FL has supported Operation IRAQI FREEDOM (OIF), Operation ENDURING FREEDOM (OEF) and is a major system supporting the ongoing Global War on Terrorism (GWOT); now referred to as Overseas Contingency Operations (OCO). Current fielded systems have supported over 540,000 sorties being successfully flown in support of multiple operations throughout major commands worldwide.

The TBMCS FL systems provide command, control and intelligence applications and infrastructure providing core air battle planning, management and execution capabilities. This system supports the Joint Forces Air Component Commander, the Air Operations Center (AOC) and the wing and unit levels to include: planning and re-planning of the Air Battle Plan; generation and dissemination of the Air Tasking Order; air and space defensive planning and execution; targeting; weaponeering; and numerous other applications supporting air operations command and control.

TBMCS FL sustainment activities currently provide operational systems on 24 Navy ships, at 7 other Navy locations, 35 Air Force locations and NORAD Regions, 42 NORAD Sectors and Wings, 15 other Joint and Air Force locations, 4 Marine Air Wings, 7 other Marine Corps locations, and 3 Foreign Military Sales cases. TBMCS FL sustainment will also continue to support 23 AOC sites deployed worldwide. These include Center locations in regions such as the Middle East and East Asia from which the Commander who oversees all U.S., allied and coalition aircraft in a theater of operations, can execute an air campaign and direct space support and information operations activities.
