I. Contracting Activity

AFLCMC/PZZKB

6039 Wardleigh Ave/ B1206 Hill AFB UT 84056

II. Nature and/or Description of the Action Being Processed

This is a Task Order for the GSA Delivery Order GS-35F-0777J, and the new task order FA8217-16-F-XXXX will be with The Boeing Company. The Period of Performance will be 12 months after receipt of award. This will be a Firm Fixed Price effort. A one year warranty is included on all repaired or refurbished HHRs.

III. Description of the Supplies/Services Required To Meet the Agency’s Needs The Combat Suvivor Evader Locator (CSEL) Joint Program Office has a requirement to refurbish and retrofit the CSEL hand held radios and provide additional batteries. The devices provide over-the-horizon and line-of-sight communication as well as a 406 MHz personnel locator beacon and GPS capabilities.

The HHRs that are being returned from the field in order to be refurbished are also being retrofitted from AN/PRQ-7 to AN/PRQ7A. There will be three line items to include radio repair with a beginning quantity of 37 at a unit price of $2,101for a total of $77,737.00. The radio retrofit/refurbish will be as needed and the purchase of replacement batteries as needed. The amount of the refurb and batteries are approximately $257,476.00 for a total task order price of $335,213.00. The service is non-performance based offered on the GSA schedule which falls under SIN 132-12 for The Boeing Company. The delivery schedule will coincide with the radios as they are to be repaired or retrofitted and supplied with batteries.

IV. Identification of the Justification/Rationale for Limiting Sources and Demonstration of the Contractor’s Unique Qualifications to Provide the Required Supply/Service FAR 8.405-6(a)(1)(i)(B), “Only one source is capable of responding due to the unique or specialized nature of the work”. The Boeing Company, in accordance with FAR 8.405- 6(a)(1)(i)(B) is the only source capable of providing these supplies or services for this program at the level of quality required because the supplies or services are unique or highly specialized.

Boeing is the designer, developer, and sole manufacturer of the AN/PRQ-7, AN/PRQ-7A HHRS and the HHR batteries.

The Government does not own the technical data package for the HHR, which would be required to accomplish the repair or refurbishment by another vendor or government agency. The cost to obtain the TDP would be over $30M as confirmed in a requested Rough Order of Magnitude (ROM) dated 1 April 2016. Boeing noted the HHR’s and the batteries for the HHR’s would be $32M. At this time to obtain the TDP for the repair and refurbishments would not be equitable to the Government.

V. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with FAR 8.404(d) This effort is supported with a Statement of Work (SOW) per FAR 8.405-2 for the services to be performed. The hand held radio is a commercial item available to the public but has been modified to meet the Governments requirement. A ROM was received from Boeing concerning this requirement which provided pricing to compare to the price list on the GSA site. The discounts and concessions from Boeing are the best value to the Government. The services will be acquired through a GSA IDIQ which has been reviewed to provided the necessary support for this requirement. The proposal will be evaluated by the Contracting Officer who will perform a price reasonableness determination as part of the best value determination.

VI. Description of the Market Research Conducted Among Schedule Holders and the Results Or a Statement of the Reason Market Research Was Not Conducted According to market research accomplished by Internet searches, reviewing past contracts, and the GSA catalog there are multiple vendors who can provide the radios. The radios must be modified to meet the requirements of the CSEL program. Past contract Task Orders have determined that the radios are modified commercial items. Therefore, an equivalent HHR will not be requested in this effort.

VII. Other Facts Supporting the Justification The hand held radios are a unique and highly specialized item. The level of quality required to support the HHR repair, retrofit/refurbishment, and batteries can only be acquired from The Boeing Company as the Government does not own the technical data package.

VIII. Actions the Agency May Take to Remove or Overcome Any Barriers that Led to the Restricted Consideration Before Any Subsequent Acquisition For the Supplies or Services The action to overcome the sole source barrier is to obtain the technical data package (TDP). For the Government to own the TDP, funding must become available. This would allow the Government the ability to support a competitive vendor to accomplish the repair, refurbish, or supply the batteries on the hand held radios.
