CLIN 0002: TA Services- Non-Business-Hours- Contractor shall provide all personnel, supervision, and any other labor services necessary to perform transient aircraft services BEYOND normal hours of operation.
Approval is requested for more than one fiscal year as the proposed six month extension to this contract would expire 29 March, 2017.
Estimated award date: 30 September 2016
IV. Statutory authority permitting Other than Full and Open Competition.
10 U.S.C 2304(c)(2), FAR 6.302-2, Unusual and Compelling Urgency
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
This Transient Alert Services contract is a follow-on (bridge) of a previous contract that ended 6 April 2016. The bridge contract will be created to fill the requirement for TA services while a new multi-year contract is solicited. The previous contract was extended and will expire 6 Oct 2016. A new contract was awarded 1 August 2016, but was protested.
Page 3 of 4Updated: 15 Mar 16
The extension of the existing FCC O&M contract is needed because the follow-on contract which was awarded using competitive procedures has been protested and Terminated For Convenience. The continued services that this bridge contract will provide are required until such time as the new contract can be solicited/awarded. The unusual and compelling urgency and the ramifications that have required the Government to request for approval of this extension are explained in the following paragraphs.
1. There is no time for a transition of services due to the late requirement to re-solicit the annual contract.
2. The current contractor is in place with all required equipment, manpower, and insurance.
3. Since the airfield cannot operate without the Transient Alert services provided by the current contractor, it is vital that there be no interruption in those services. The 6 month extension will provide continuity while the new multi-year contract is negotiated.
4. There is no viable alternative to the current contractor being extended 6 months since no other service provider can stand up a viable Transient Alert Service within the remaining days leading up to 30 Sept.
2016. If the extension is not in place by that date, the Transient Alert services will cease and the airfield will be forced to close for transient aircraft. Since transient flying would cease, priority missions and deployment actions would also cease. This would severely affect the Air Force mission and National Security.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
FAR 5.201 requires that a synopsis be made available, however, FAR 5.202(a)(2) provides an exception to the synopsis when the proposed contract action is made under the conditions described in 6.302-2 and the Government would be seriously injured if the agency complies with the time periods specified in 5.203. In accordance with FAR 5.202(a)(2) a synopsis is not required.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The following steps will be taken to ensure that the anticipated cost of this extension will be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The contracting office will obtain certified cost and pricing data IAW FAR 15.403, when required.
The final step is to include the Price Negotiation Memorandum (PNM). This detailed documentation and justification of price reasonableness will be disclosed in the official PNM, to be prepared upon completion of negotiations.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
In accordance with FAR Part 10 market research was conducted and revealed that this requirement is not capable of being advertised to all small business contractors available on FOB. Research of other Air Force bases Transient Alert Services via telephone and obtained vendor information was conducted. An internet search was conducted and past vendors for this contract were researched. Prior contract solicitation generated 12 small business bidders. All research reflected that there was not a contractor that could be on site and providing service in the timeline required other than the incumbent contractor.

IX. Any other facts supporting the use of Other Than Full and Open Competition.
Denial of this request would cause substantial loss of service resulting in a loss of cost to the Government, which is not expected to be recovered through competition. Competing a follow-on or another bridge contract is not feasible at this time due to both time and funding.
X. List of sources, if any, that expressed interest in the acquisition.
FCC O&M Inc.
915 West Second Ave
Suite SW7
Spokane, WA 99201
CAGE Code 0SPT8
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
This bridge contract is being solicited to allow time for a full multi-year re-compete. A re-compete is not possible at this time due to the unusual and compelling urgency detailed in the preceding sections. Due to the unusual and compelling urgency of this requirement, there is only one acceptable source for this service. In the future, this contract will be fully competed using FOB.
