CLAUSES INCORPORATED BY FULL TEXT
52.209-1 QUALIFICATION REQUIREMENTS (FEB 1995)
(a) Definition: "Qualification requirement," as used in this clause, means a Government requirement for testing or other quality assurance demonstration that must be completed before award.
(b) One or more qualification requirements apply to the supplies or services covered by this contract. For those supplies or services requiring qualification, whether the covered product or service is an end item under this contract or simply a component of an end item, the product, manufacturer, or source must have demonstrated that it meets the standards prescribed for qualification before award of this contract. The product, manufacturer, or source must be qualified at the time of award whether or not the name of the product, manufacturer, or source is actually included on a qualified products list, qualified manufacturers list, or qualified bidders list. Offerors should contact the agency activity designated below to obtain all requirements that they or their products or services, or their subcontractors or their products or services, must satisfy to become qualified and to arrange for an opportunity to demonstrate their abilities to meet the standards specified for qualification.
OL:H/PZIOC
6038 Aspen Ave
Bldg 1289 NE Wing
Hill AFB, UT 84056-5805
(c) If an offeror, manufacturer, source, product or service covered by a qualification requirement has already met the standards specified, the relevant information noted below should be provided.
Offeror's Name
Manufacturer's Name
Source's Name
Item Name
Service Identification
Test Number (to the extent known)
(d) Even though a product or service subject to a qualification requirement is not in itself an end item under this contract, the product, manufacturer, or source must nevertheless be qualified at the time of award of this contract.
This is necessary whether the Contractor or a subcontractor will ultimately provide the product or service in question. If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate the contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the
Government's best interests.
(e) If an offeror, manufacturer, source, product, or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government's interests, award of this contract shall not be delayed to permit an offeror to submit evidence of qualification.
(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification. The reevaluation must be accomplished before the date of award.
(End of clause)
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award ONE IDIQ contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
LPTA – Lowest Price Technically Acceptable
a. Price:
A price evaluation will be performed for all offerors in accordance with VOLUME 1– PRICING.
Proposals will be ranked from lowest to highest price based on the Total Evaluated Price (TEP) of CLIN
0001 (Water Treatment Chemicals), CLIN 0002 (Water Testing Reagents) and CLIN 0003 (Water Testing
Equipments).
b. Technical Capability:
A technical evaluation will be performed beginning with the lowest priced offeror. Only those Offerors determined to be technically acceptable will be considered for award.
VOLUME 1– PRICING (NO PAGE LIMIT)
Offerors shall fill out the provided excel worksheet titled “APPENDIX A/ PRICE LIST ” and insert proposed Unit
Prices. Extended Prices, Yearly Totals and Total Evaluated Price are calculated automatically, however offeror is responsible for accuracy of their pricing.
- Extended Prices for each item are calculated by multiplying the offeror’s Unit Price and the Estimated
Quantity listed under the column “EST QTY” in APPENDIX A.
- Yearly Prices are calculated by adding all Extended Prices for the year.
- Total CLIN Price is calculated by adding all five (5) Yearly Prices together.
- Total Evaluated Price is calculated by adding the Total CLIN Prices for all CLINs.
Offerors are hereby notified that all rates proposed in the Price List are CONTRACTUALLY BINDING and shall be utilized to calculate delivery order prices throughout the life of the contract. Offerors shall provide filled out Price
List in Electronic unprotected Excel Format for review by Contracting Officer.
Price Evaluation
The pricing criteria used for evaluation are (1) completeness, (2) price reasonableness, and (3) total evaluated price.
1) Completeness – The Government will review the pricing submissions for completeness and compliance with the RFP. Incomplete price submissions will NOT be evaluated; the proposal may be eliminated from the competition, and considered non-responsive.
2) Price Reasonableness – The offerors price proposal will be evaluated using one or more of the techniques defined in FAR 13.106-3 (Award and Documentation). Generally, adequate price competition will satisfy the criteria of price reasonableness.
3) The total evaluated price will be calculated as the sum of the Contract Line Item Numbers (CLINS) unit price.
Unbalanced Pricing
Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items. Offers that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
VOLUME 2– TECHNICAL PROPOSAL (MAXIMUM 10 PAGES)
NO PRICING SHALL BE INCLUDED IN THE TECHNICAL VOLUME.
Technical Capability - (Acceptable/Unacceptable):
Technical - Factors 1 - 2 of the proposed Offeror’s Technical Volume shall be rated using the chart below. The proposal shall not simply rephrase or restate the Government's requirements from the SOW, but provide convincing rationale to address how the offeror intends to meet these requirements. If a proposed Offeror receives a determination of technically unacceptable in any of the rated areas, that Offeror will not be considered for award and the entire proposal will be considered Unacceptable.
The Technical Evaluation Team will rate the technical proposals according to the chart listed below.
DESCRIPTION RATING
Proposal clearly meets the minimum requirements of the solicitation Acceptable
Proposal does not clearly meet the minimum requirements of the solicitation Unacceptable
Factor 1- Contractor shall submit a letter verifying all components and weight percentages in each of the six
“Water Treatment Chemicals” listed in Table 1, SECTION 2 of Statement of Work dated 15 Mar 2013.
Factor 2- The three lowest offerors will be notified to submit one-liter samples of each of the six “Water
Treatment Chemicals” listed in Table 1, SECTION 2. Material Safety Data Sheet (MSDS) shall be supplied for each sample. Samples will be tested and determined “pass or fail” in accordance with SECTION 1, 1.2 of the Statement of Work.
(b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
All proposals must be received no later than the date and time indicated in Block 8 of the SF1449. Proposals must be delivered by an accepted method listed in this solicitation.
Please address any questions to both SSgt Esteban Bedoya (Esteban.Bedoya@hill.af.mil) and SrA Lei Yang
(Lei.Yang@hill.af.mil).

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
