SUBJECT: Sole Source Justification for PANalytical ZETIUM WDRF Spectrometer PM

76 MXSG request an annual contract, one (1) Base Year with two (2) Option Years for Preventive Maintenance (PM) on the PANalytical ZETIUM WDXRF Spectrometer. The Analytical Chemistry Section, is responsible for the chemical analysis of metals and other materials used in the United States Air Force (USAF) aircraft and jet engines managed at Oklahoma City Air Logistics Center (OC-ALC). The WDXRF spectrometer is used to conduct investigations into aircraft mishap causes and product contamination. The PANalytical Axios MAX Advanced WDXRF spectrometer is used for quantitative elemental analysis of metals and alloys, plasma spray powders, and aerospace coatings used on jet engines and aircraft.

Only the original equipment manufacturer (OEM) Malvern Panalytical Inc. have access to proprietary data and hardware for service. OBCA reached out to the OEM and verified with Eric Jenkins that Malvern Panalytical Inc.

does not authorize any third-party service providers to service their equipment, and they are not willing to sell data rights to the Government.

Therefore, the proposed sole source vendor is the only vendor that can satisfy the Government’s requirements.

Market research was performed reviewing System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code (811210) looking for companies that could provide an annual contract for Preventive Maintenance (PM) on the PANalytical ZETIUM WDXRF Spectrometer under Federal Supply Code (FSC J066).

A review of small businesses to include:

Dynamic Small Business Search (DSBS) – Email sent to twenty-four (24) vendors, resulting in Two (2) responses – No ROMs or Capability statements provided.

OBCA reached out to the original equipment manufacturer (OEM) Malvern Panalytical Inc. and verified with that Malvern Panalytical does not authorize any third-party service providers to service their equipment, and they are not willing to sell data rights to the Government.

In review, there is one (1) source that can provide this service for this acquisition.

The Government will continue to monitor the market and conduct market research surveys to determine potential future sources to try and avoid future single source acquisitions.

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
