This is an annual contract for Preventive Maintenance (PM) and Over & Above (TBN) for the Spectro Spectruma Glow Discharge Optical Emission Spectrometer. One Basic and Four Option Years.
Section C: Justification for Soliciting from a Single Source
No other company but Spectro TEK LLC has the parts and rights required to meet the Government's needs.
1. Does the Government have/not have the appropriate use rights to permit the Government to provide copies of the data to accomplish repair of equipment? No, the Government does not have the appropriate use rights to permit the Government to provide copies of the data to 3rd parties to repair the equipment.
2. Does the Government have "use rights" to the data? The Government does not have "use rights" to the data.
3. Will the OEM sell the appropriate data use rights to permit the Government to provide copies of the data to other contractors to accomplish the repair of the equipment? The OEM will not sell the appropriate data use rights to permit the Government to provide copies of the data to other contractors to accomplish the repair of the equipment.
4. If the OEM will sell the appropriate data use rights, ask how much it will cost. The OEM will not sell the appropriate data use rights.
Section D: Efforts to Obtain Competition
Market Research was conducted via Internet and phone calls. It was determined after searching known markets that only one company Spectro TEK LLC has the drawings, parts and rights to the Spectruma Glow Discharge Optical Emission Spectrometer. Since there is limited known source, contracting will do a sources sought on the government point of entry Federal Business Opportunities.
Section E: Steps to Preclude Future Single Source Awards
As long as the Spectruma Glow Discharge Optical Emission Spectrometer is in use, because we cannot get the drawings, parts and software rights, this will always be a sole source to Spectro TEK LLC. On future purchases during Market Research, we will strive to purchase Optical Emission Spectrometers that we can get serviced from multiple sources.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
