Single Source Justification (Simplified Acquisition)

Section A: General Contract Information

Contracting Activity: AFSC/PZIMB Purchase Request/ Identification Number:

F3YCEB6064AQ03

Project/Program Name: JEOL JSM-IT300LV Estimated Contract Cost (including Options):

$130,359.25

Section B: Description of the Supplies/Services Required

Preventive maintenance of the JEOL JSM-IT300LV will include two (2) PM visits per year and Remedial Maintenance (RM) service as needed (to include cost of parts except consumables). The PM shall include one complete cleaning of the SEM (i.e. column), vacuum pumps, system calibrations and software updates. For RM the contractor shall respond within 24 hours of being notified of a system's failure or operational problems. RM shall be performed on all systems provided with the purchase and installation of the SEM (i.e. pumps, chillers, computer hardware and software, monitors). The contractor shall provide knowledgeable support of the operating systems for troubleshooting and performance.

Section C: Justification for Soliciting from a Single Source

The justification for the single source is as follows:

Authority: FAR Part 6.302-1, Only One Responsible Source and no other supplies or services will satisfy agency requirements

JOEL USA, Inc. offers a concept or services not otherwise available to the Government. The government currently lacks the license rights to perform the PM/RM services for the JEOL JSM-IT300LV SEM organically or to solicit the contemplated contract under full and open competition. Although the government realizes that it has unlimited usage rights to form, fit, and function data as well as operation, maintenance, installation, and training data, such rights are insufficient for the government's needs as they are not detailed enough to accomplish the required service of this item. Access to level three drawings is required to accomplish these tasks and the OEM is unwilling to sell license rights to the government. It is not possible to draft adequate specifications for the PM/RM services of this item or JEOL's unique and highly specialized capabilities without the data usage rights. It is not in the government's best interest to spend to procure replacement systems. Minimal remedial maintenance has been performed on the JEOL JSM-IT300LV.

Section D: Efforts to Obtain Competition

Market research was performed reviewing Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code 811219 looking for companies that could provide this Service. A review of small businesses to include 8(a), HUBZone, Service Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide this Service. In review I found there is one entity that can provide this service, the OEM. With the exception of JEOL, the following vendors were unable to provide the service:

Section E: Steps to Preclude Future Single Source Awards

We will continue to monitor JEOL to see if they implement distributorships. We will continue doing Independent Government Estimates to determine if a complete change out of all JEOL's equipment may be economically feasible in the future.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
