PERFORMANCE WORK STATEMENT (PWS)

for

B52 Flaptrack Heat Treat

16 July 2014

1. DESCRIPTION OF SERVICES/GENERAL INFORMATION.

Scope: The contractor shall provide all labor, tools, equipment, test equipment, material, parts, quality control, transportation, Personal Protective (PP) clothing and equipment, prescription safety glasses, and any incidentals necessary to perform heat treatment of the Oklahoma City Air Logistics Center (OC-ALC) Government-owned Heat Treat 4330M Material. The equipment is listed in Appendix A.

1.1. Requested Services: The contractor shall heat treat (1) - 3" x 29" x 90" 4330M material to 180-210 KSI to BAC 5617 and BMS7-122 specifications within 30 days after contract award.

Contractor shall have the capability to Heat treat the B52 flap track with 0.125” added material left on the roughed out flap track with 1-1/4” tabs around the part to 180-210KSI following BAC 5617 specifications within 30 days after contract award. The contractor shall hold a flatness tolerance to +/-0.1 across the entire length of the part. The contractor shall provide hardness testing of 40-44 HRC on the government supplied coupon of 4330M material once heat treated.

The contractor shall be Nadcap and AS9100 certified to perform the heat treat requirement.

Configuration listed in Appendix D.

1.2. Off-Site Repair: The Contracting Officer Representative (COR) will request that the technical point of contact prepare the equipment for shipment. The COR will ship the equipment to the contractor with required information included; contract no, CLIN No, equipment ID#, a brief description of the malfunction, technical point of contact’s name and telephone number.

1.2.1. Delivery: The contractor shall ship all repaired and non-repairable equipment the fastest and most traceable method to arrive within five (5) work days after the repair completion date.

1.2.2. Shipping: The contractor shall provide to the COR, the date equipment was shipped out, shipment identification information and include contract number on paper work with a Freight- On-Board (FOB) Destination. The ship to address is listed below. Ship to:

1.3. Parts and Materials: The Contractor shall provide and use only new parts and material in performance of this PWS unless authorized by the CO.

1.4. Quality Assurance: According to the contract’s inspection clause, the Government will evaluate the Contractor’s performance under this contract. The COR will participate in the administration of this contract. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the CO. All services to be performed by the Contractor during the period of this contract will be subject to review by the CO or COR.

1.5. CAR/Complaint Contractor Response Time: The Contractor shall provide written response addressing the root cause, corrective action and preventive action(s). The Contractor will be given two (2) business days to answer a submitted Corrective Action Report (CAR) or Customer Complaint.

1.6. Continuation of Essential DoD Contractor Services During Crisis: This requirement has been determined not to be essential and does not require continued support during a crisis as defined in DFARS 252.237-7023.

1.7. Special Qualifications: Contractor shall have the capability to Heat treat the B52 flap track with 0.125” added material left with 1-1/4” tabs around the part to 180-210KSI following BMS 7-122 and BAC 5617 specifications. The contractor shall hold a flatness tolerance to +/-0.1 across the entire length of the part. The contractor shall provide hardness testing of 40-44 HRC.

The contractor shall be Nadcap and AS9100 certified.

1.8. Contractor Personnel: The Contractor shall provide the name of the Contract Manager (CM) and any alternate(s) who shall act for the Contractor when the manager is absent and they shall be designated in writing to the COR within five (5) work days after contract award.

The Contractor shall provide telephone numbers and email addresses of the CM and alternate(s) where these persons may be contacted at any time. The CM or alternate shall have full authority to act for the Contractor on all matters relating to operation of this contract at Tinker AFB. The CM or alternate shall be available to meet on the installation with Government personnel designated by the CO to discuss problem areas. The Contractor shall provide a CM who can read, write, speak and understand English fluently.

The Contractor and Contractor personnel shall be required to identify themselves as Contractor personnel by introducing themselves or being introduced as Contractor personnel and displaying distinguishing badges or other visible identification for meetings with Government personnel. The Contractor and Contractor personnel shall identify themselves as Contractor employees in telephone conversations and in formal and informal written correspondence.

1.9. Environmental Certification: Contractor shall ensure and provide written certification that the repaired B52 Flaptrack Heat Treat 4330M Material is cleaned to remove all hazardous contaminants, dirt, shavings, oil, or grease, and drained and purged to remove all fluids, oils and liquids before return to Tinker AFB. Certification shall be on company letterhead with a statement which specifies the part or equipment is certified to be clean, drained and purged. In addition, as a minimum, said letter shall contain description of part or equipment, make, model, serial number, and OC number (if applicable). This certification shall be provided to the COR two (2) work days prior to the return of the part or equipment.

The Government will ensure the part or equipment is clean, drained and purged before it is transferred to the contractor for repair. The Government will provide written certification of such to the contractor prior to shipment or pick up of the part or equipment. Certification will be on letterhead with a statement which specifies the part or equipment is certified to be clean, drained and purged. In addition, as a minimum, said letter will contain description of the part or equipment, make, model, serial number, and OC number (if applicable). This certification will be provided to the COR three (3) work days prior to the pick-up or shipment of the part or equipment. The COR will, in turn, provide it to the contractor within two (2) work days prior to the pick-up or shipment of the part or equipment.

1.10. Forms, Technical Orders (TO’s), AFI, AFMCI and Publications: The Contractor shall obtain the forms and publications expressly required to perform the work in this contract via internet at www.e-publishing.af.mil. In the event a form or publication is not available online, the COR will provide the form, instruction, or publication to the Contractor upon written request (e-mail is acceptable) by the Contractor. In the event, laws, regulations, TO’s, Air Force Instructions (AFI’s), Air Force Material Command Instructions (AFMCI’s) change during the term of this contract, the Contractor is required to comply as such changes come into effect. Contractors delivering or handling official USAF records shall comply with the applicable records management regulations, AFI 33-322, All of Chapter 3.

1.11. Safety and Health: While performing work under this contract the contractor shall comply with all applicable federal, state and local regulations regarding occupational safety and health.

The contractor shall notify the Contracting Officer (CO), within eight (8) hours of any damage to government property where the dollar value exceeds $500,000.00 and within two workdays, for any damage to government property less than $500,000.00 during the execution of the contract.

Mishap notifications shall contain, as a minimum, the following information:

a. Contract, Contract Number, Name and Title of Person(s) Reporting

b. Date, Time and exact location of accident/incident

c. Brief Narrative of accident/incident (Events leading to accident/incident)

d. Cause of accident/incident, if known

e. Estimated cost of accident/incident (material and labor to repair/replace)

f. Nomenclature of equipment and personnel involved in accident/incident

g. Corrective actions (taken or proposed)

h. Other pertinent information

If requested by the designated CO, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records, until released by the Procuring Safety Office. Contractors will not dispose of contract data related to a mishap until notified to do so by the CO.

2. Performance Assessment

The Contractor shall be aware that in the absence of any contract requirement from the SS does not detract from its enforceability nor limit the rights or remedies of the Government http://www.e-publishing.af.mil/ under any other provision of the contract. The Contractor shall ensure the following service summary requirements are accomplished:

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

3.1. Government Furnished Property (GFP) Repair/Maintenance Off-Base.

Government Furnished Property (GFP). In Accordance With (IAW) FAR Part 45 Rewrite June 2007 – FAR 45.107(d), the Government Property Clause(s) are not required when the cumulative acquisition cost of the GFP requiring repair/maintenance off-base is less than the Simplified Acquisition Threshold (SAT) $150,000. However, the Contractor shall comply with the contract terms and conditions which includes this PWS. The Contractor shall ensure all GFP is secured at the close of each workday. The Government retains title to all GFP, until the Government properly disposes of the GFP as authorized by law or regulation. This GFP shall not be used for the performance of any other contract. The GFP is identified in Appendix B.

3.1.1. Shipment to Contractor or Pick up by Contractor. See PWS Paragraph 1.2.

3.1.2. Return Shipment or Delivery to Government. See PWS Paragraphs 1.2.1.-1.2.2.

3.1.3. Loss of Government Property.

3.1.3.1. The Contractor’s off-site (not on Tinker AFB) liability for the Government Property shall begin when the GFP is delivered to the Contractor’s site for repair, FOB Destination (Government’s expense). The Contractor shall remain liable for this GFP until the return shipment/delivery is received by the Government at the destination specified in the contract, FOB Destination (Contractor’s expense).

3.1.3.2. Since the GFP is less than the Simplified Acquisition Threshold (SAT) $150,000, the Government will use the Report of Survey (ROS) to process Loss of Government Property incidents/accidents.

3.1.4. GFP Identification Labels. When applicable, the Contractor shall clearly label (without damaging) Government Furnished Property to distinguish it from Contractor Furnished Property, in accordance with the contract terms and conditions and this PWS.

3.1.5. GFP Records, Reports, and/or Disposal.

The responsible Government Organization, (76 CMXG), for the GFP will be responsible for GFP record keeping, reporting requirements, and/or disposal of all Government Furnished Property that was used and/or in the possession of the Contractor during the performance of this contract.

3.2. Shared Property of the Government. Not Applicable.

3.3. Government Furnished Services (GFS). Not Applicable.

3.4. Intangible Government Property. Not Applicable.

3.5. Contractor Acquired Property (CAP). Not Applicable.
