JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

Due to the circumstances described below, this Justification and Approval (J&A) authorizes the use of Other Than Full and Open Competition (OTF&OC) procedures to procure repair and/or remanufacture of F100-PW-229 Ducts to support the F100-PW-229 Engines from Pratt & Whitney Aftermarket Services-North Berwick (CAGE Code 8N802), 400 Main Street, East Hartford, CT 06108. The appropriate exception to full and open competition is identified in FAR 6.302-1(a)(2). The resulting contract will be a Firm Fixed Quantity type contract with a period of performance of one year. The estimated acquisition value of this PR is $---.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

This intended acquisition will fill a requirement to perform overhaul/remanufacture of the asset listed below. The contractor will provide all required labor, direct material, parts, facilities, test equipment and services to accomplish repair/remanufacture, packaging preservation and return to the government a completely serviceable asset.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

The authority for this action is 10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2), with an application pursuant to FAR 6.302-1(b)(1).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Pratt & Whitney Aftermarket Services-North Berwick is currently the only source that meets the standards specified in the Repair Qualification Requirement (RQR) and can satisfy the Government’s requirements. Pratt & Whitney Aftermarket Services-North Berwick has unique capabilities, certification, tooling and qualified/trained personnel to perform the remanufacturing of these items.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

In accordance with FAR Part 5.201, this requirement was synopsized and the solicitation will be posted to Federal Business Opportunities (FedBizOps) with the RQR and any interested source will be invited to submit a Source Approval Request (SAR) package. RQRs will be posted periodically into FedBizOps to provide interested sources the opportunity to become fully qualified sources for future requirements. The last time the RQR was posted into FedBizOps was on 6 Jul 10.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ACTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer will ensure that the items herein are negotiated at a fair and reasonable price to the Government. Cost and pricing data will be requested from the contractor. A detailed cost analysis and a price analysis will be performed. A technical evaluation from the Defense Contract Management Agency (DCMA) and a field audit from the Defense Contract Audit Agency (DCAA) will be requested to aid in the evaluation of the contractor’s proposal.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

IAW FAR 10.001(a)(2) and (3), market research has revealed that this is not a commercial item and a commercial item cannot be modified to meet the requirement. It has also been determined that the requirements cannot be restated to permit the use of commercial items. This is a non-developmental repair/remanufacture process.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

At present, Pratt & Whitney Aftermarket Services-North Berwick is the only qualified repair source with data, skills, parts, and test procedures necessary to provide this requirement. These items are critical to the performance of the F100 engine and the government must have a reasonable assurance that all performance and safety requirements can be met. Pratt & Whitney Aftermarket Services-North Berwick is currently the only manufacturer that can provide the remanufacturing requirement. Failure to obtain the components requested will cause delays in production of the next higher assembly F100-PW-229 Core Module. The impact will be depletion of all war readiness spare engines and could result in failure of assigned Air Force missions.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

In accordance with FAR 9.204, repair qualification requirements will be periodically synopsized in FedBizOps soliciting sources as an effort to improve the competitive status. Any potential source that submits a Source Approval Request (SAR) will be considered for award. The Small Business Office will be contacted for any SAR packages in work prior to award.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officers’ signature on the Coordination and Approval Document is evidence that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
