MEMORANDUM TO FILE

Subject: Posting of Acquisition Synopsis and Sole Source Solicitation – PR FD2030-22-01270

1. It was brought to my attention that the subject PR did not have the synopsis or solicitation posted to the System for Acquisition Management (SAM). Due to changeover in personnel, it appears that this requirement was solicited to the sole-source vendor, but neither the synopsis nor the solicitation were ever posted in SAM. To correct the record, I have directed that the buyer post a combined synopsis and solicitation for15 days. The sole-source vendor has already provided a proposal and there is no opportunity to increase competition; therefore, nothing additional would be gained by posting this requirement for longer than 15 days. The solicitation copy posted to SAM with the synopsis is the one that was created in 2022 when the requirement first arrived in PZABC. This requirement was initially solicited using Simplified Acquisition Procedures (SAP) and this office was not aware of the substantial increase in price until we received the solicitation. That is why this solicitation is a “Q” type solicitation as we expected the proposed price to be below $250,000. What was posted was what was provided to the sole-source vendor.

2. The sole-source vendor owns all the intellectual property and data necessary to manufacture this item. Based on market research, no other vendor possesses the ability to meet this requirement. As such, the posting of this synopsis for 15 days will meet the spirit and intent of FAR Part 5.
