Due to the circumstances described below in Sections V, IX and XI, there are no immediate actions that could be taken to develop competition. If other qualified or approved sources become known during the life of this contract, full and open competition will be considered and utilized to the maximum extent practicable.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1 (a) (2).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE

AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

This is a follow-on acquisition for the Remanufacture of the E-3 Flap Drive Ball Screw

Assembly described in Section III.

Linear Motion LLC is the designer and actual manufacturer of the E-3 Flap Drive Ball

Screw Assembly and is the only known source that has the necessary manufacturing data, processes, and parts needed to produce this item. The Government does not have government purpose rights to the necessary detailed manufacturing process data to solicit additional sources to remanufacture the above mentioned item. Linear Motion, LLC is the only certified source that has the equipment/tooling and personnel to satisfy the Air

Force’s minimum need.

This effort was previously competed with the following sources listed as approved on the

Contract Repair Screening Analysis Worksheet (CRSAW):

Airtronics (CAGE 58078)

Gulf Aerospace, Inc. (CAGE 17475)

Texas Aerospace (CAGE 29242)

Thomas Instrument (CAGE 50LP4)

Thomas Instrument (CAGE 5H860)

Thread-Craft, Inc. (CAGE 1H664)

However, a source removal action supported by FAR 9.207(a)(7) was processed on 11 Feb

2019 to remove the above listed sources from the “Approved/Potential Sources” list on the

CRSAW. The overhaul technical manual distribution statement shows the manual to contain proprietary information. The statement therefore limits distribution to the intellectual property holder (i.e. the Original Equipment Manufacturer) or Department of

Defense components only. The sources listed above have not produced any licensing agreements, or other similar arrangements with the intellectual property holder, granting them rights to use the restricted technical order.

The government defined pre-award qualifications of new sources cannot be identified due to the unavailability of the necessary technical data. The OEM is the only entity capable of approving additional sources at this time.

Efforts by the Government to secure the necessary data rights from Linear Motion, LLC have been unsuccessful.

The 423rd SCMS believes that award to any other source would result in unacceptable delays in fulfilling the Air Force’s requirement due to the fact that the Government does not possess the necessary data rights to allow for competitive remanufacture. (see Section

IX for details).

Accordingly, Linear Motion, LLC is the only firm capable of providing the remanufacture described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements. Linear Motion, LLC is the only remanufacture source known for this acquisition.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

This requirement was synopsized on http://www.fedbizopps.gov as a notice of proposed contract action IAW FAR 5.201. Consideration shall be given to potential sources, prior to award. The Government is not aware of the OEM approving any additional sources at this time. Linear Motion, LLC has stated that they have not sold the necessary rights, or entered into any type of partnering agreement, with any other contractors.

There are no other actions.

http://www.fedbizopps.gov/

There are no qualifying country sources.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. IAW FAR as supplemented, the contractor will be required to submit Certified Cost or Pricing Data and/or Other Than Certified Cost or

Pricing Data, if deemed necessary. Price analysis will be performed, as well as a detailed cost analysis, when needed. The Contracting Officer will request a technical evaluation from the Defense Contract Management Agency (DCMA) to aid in the evaluation of the contractor’s proposal and will seek audit assistance from the Defense Contract Audit

Agency (DCAA), if necessary.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS

NOT CONDUCTED

As described in Section VI, the 423 SCMS engineer assigned to these items contacted the

OEM, Linear Motion, LLC to verify that no other company has been approved or purchased the appropriate data to be able to perform the necessary work to remanufacture the E-3 Flap Drive Ball Screw Assembly. A non-developmental remanufacture capability suitable to meet the requirement is only available from Linear Motion, LLC.

Although other sources exist within the marketplace that perform similar efforts, none were identified as having access or the rights to the necessary technical data to meet the

Government’s requirement.

The Joint Engineering Data Management Information and Control System, PDM Gateway and the Military Engineering Data Asset Locator System were used to research available technical data; none was found that could be used to qualify additional sources. Additional inquiries of available systems, such as Haystack, Webster’s online, Aviation Week, Fluid

Power Monthly, and a web search, as well as the synopsis described in Section VI, did not yield any additional sources for remanufacture/upgrade of this item.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Reverse engineering the remanufacture process is not feasible within allowable timeframes. Any effort to reverse engineer the remanufacture process would take a minimum of 5 years from the initiation of a Consolidated Sustainment Activity Group

Sustaining Engineering project. This timeframe includes the budget request period, Purchase Request processing, contract negotiation and award, period of performance, qualification testing of the reverse engineered process, and source qualification of remanufacture/upgrade sources. Additionally, the necessary use rights would need to be negotiated and purchased for remanufacture from Linear Motion, LLC to utilize any available proprietary technical data in the Government’s possession to support the reverse engineering project. A cost estimate to complete this project has not been generated due to the unknown nature of some of the project’s elements such as securing Government use rights to the technical data, lack of historical project cost information for similar equipment, and the scope of qualification testing required to ensure Operational Safety, Suitability, and Effectiveness. As such, the only source of supply for this effort is Linear

Motion, LLC.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

See Section VI for more detail.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

Based upon the discussion in Section V and IX, there are no available actions to remove barriers to competition that can be taken at this time. However, the Government will synopsize any follow-on efforts to identify additional qualified sources, if any, in order to overcome barriers to competition.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences that the Contracting Officer has determined this document to be both accurate and complete to the best of the Contracting Officer’s knowledge and belief.
