II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
Due to the circumstances described below, this activity will acquire the following effort using “Other Than Full and Open Competition (OTF&OC)” procedures. The Government intends for this action to be a new Firm Fixed Price C-type contract being awarded for an estimated total of 6 months after date of award. The estimated award date is 20 Sep 2014.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
Appropriation: 57 3010 BP13
Period of Performance: Award plus 6 months
Estimate: $249,950
The purpose of this effort is to modify the existing Data Acquisition and Processing system (DAPS) in the PHSTS. The contractor shall provide all labor, tools, materials, transportation, supervision, and associated items and services necessary to modify the acquisition system. The PHSTS is a fully integrated, self-supporting, transportable Electromagnetic Pulse (EMP) test system. The contractor shall be proficient in the operation and maintenance of the PHSTS.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1 Only one Responsible source and no other supplies or services will satisfy Agency requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) The DAPS is the current standard test system within the Air Force and Navy for Low Level Continuous Wave test of Military Nuclear Hardened Air Vehicles in conformity with Mil Std 461E. Our current DAPS in the Air Force is 27 years old and some of the components within the system are becoming harder to maintain. Currently, Team Technologies has developed a new high speed DAPS used by the Navy. This system will cut aircraft testing periods in half and use 1/3 of the equipment currently in the old system, due to modern technology. With the upgraded DAPS, aircraft will be returned back to service quicker and there will be less equipment to maintain/ calibrate which in return saves the Government both money and time.
Personnel at Team Technologies designed and maintain the current DAPS/ LLCW system and also designed this new upgrade. The end result is that, all the corporate knowledge concerning the detailed internal workings of the DAPS/ LLCW and why it is designed the way it is, now resides with the engineering team at Team Technologies VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
This requirement will be synopsized and the RFP posted to FedBizOpps for 30 days.
Future procurement efforts for additional upgrades to the acquisition system are not guaranteed and will be evaluated for the best interest of the Government and VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The Contracting Officer will request a technical evaluation from the Program Manager and a Rates and Factors Check from the Defense Contract Audit Agency (DCAA) for the purpose of determining fairness and reasonableness. A detailed cost analysis and a price analysis will be performed.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION
Under the FAR clause 6.302-1, “Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in Substantial duplication of cost to the Government that is not expected to be recovered through competition”. We believe that the above clause provides ample justification to award a sole source to Team- Technologies for the DAPS upgrade.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
1. Team Technologies 1400 Eubanks Blvd SE Albuquerque, NM 87123
CAGE CODE: 0HR07
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
