I. Contracting Activity
Department of the Air Force Operational Contracting Division 7180 Reserve Rd., Bldg. 1083
Tinker AFB, OK 73145 Purchase Request Number: F3YCAW4132B001
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
This is a firm fixed price contract. This individual J & A is to support a firm-fixed price type contract for a (6) six month period. The planned effective or start date is 01 Aug 2014.
URS Federal Technical Services has operated and maintained the LLCW equipment for 27 years as a contractor for the Government. The previous acquisitions were sole source to URS. The existing sole source contract is FA8125-14-C-007, awarded 09 Apr 2014 and will expire 30 Jun 2014.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
The purpose of this Request for Purchase (PR# F3YCAW4132B001) is to obtain a contract for operational support and maintenance of the Low Level Continuous Wave (LLCW) Test Equipment. 3400 funding will be used for this acquisition, and the estimated cost of the acquisition is $195,000.00. The estimated dates/ periods of performance are as follows: 01 Aug 2014 thru 31 Jan 2015. The equipment includes the Portable Hardness Surveillance Test System (PHSTS) and two Hardness Evaluation Systems (HES); HES1 located at Albuquerque, NM and HES2 is located at Tinker Air Force Base, OK. The contractor shall provide all labor, tools, materials, transportation, supervision, and associated items and services necessary to perform operational testing and preventive maintenance (PM) of all LLCW equipment at AF Plant 42, Palmdale, CA; and contractor location. The PHSTS is a fully integrated, self-supporting, transportable Electromagnetic Pulse (EMP) test system. The contractor shall be proficient in the operation and maintenance of the PHSTS. The contractor shall maintain clearance levels specific to the B-2 Weapon Systems requirements for all personnel required to support maintenance or operational activities occurring during this test.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C. 2304(c)(2) or 41 U.S.C. 253(c)(2), as implemented by FAR 6.302-2 only one Responsible source and no other supplies or services will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) URS is the only company able to accomplish this effort due to the following: (1) URS built the LLCW equipment, and (2) the Government does not possess adequate engineering data, due to the proprietary nature of the fiber optic equipment, to competitively acquire operational support and maintenance of the LLCW equipment. The decision not to obtain technical data was made during the acquisition phase of the system, and reverse engineering is not possible for this effort.
The LLCW equipment is the only Air Force asset capable of conducting the necessary testing required for Nuclear Hardened Air Vehicles in conformity with Mil Std 461E. Given URS's long history with the equipment (since conception), this acquisition is for continued performance of a highly specialized service. Due to the nature of the proprietary equipment, the Government would be unable to reverse engineer the system. It is not feasible to have other contractors compete for the technical support portion of the effort because any contractor providing test support must have full knowledge of the PHSTS equipment, including knowledge of the proprietary data owned by URS. URS would not be willing to allow other contractors to access its proprietary data, and the Government is unable to provide this data to other contractors. Also, even if other contractors were able to compete for the technical support portion of the testing, URS would still be involved with the maintenance of the fiber optic equipment and software integration. That effort would then need to be subcontracted to URS and would result in a higher overall cost to the government, or the Government would have to break the requirement into separate contracts which would result in a duplication of both procurement and administration activities.
URS has the necessary personnel to support our testing requirement with each technician having performed on each test over the past contract coverage. Special access clearance is required for the B-2 platform; each test technician has the necessary clearance levels required for this effort.
URS has been the only source to maintain and repair the LLCW equipment and it is imperative to continue services in support of the PHSTS and HES. The 76 Maintenance Wing believes that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Award to another source could also cause unacceptable delays in fulfilling the Air Force's requirements. Both duplication in cost (through training on the system) and delay would result from approximately two years it would take to acquire the knowledge and depth of understanding of the PHSTS. An unacceptable delay equals not completing the test in the days allotted in the Program Depot Maintenance schedule. Also, because URS owns the data associated with the PHSTS, any other contractor would have to subcontract to URS or buy the data from URS. This situation equates to additional cost in the form of a pass through rate of a new contractor subcontracting to URS. The Government estimates that such a pass through would be approximately 20 - 25% above the current yearly maintenance cost. Therefore, this acquisition is for continued performance of a highly specialized service.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
However, Pursuant to FAR 5.2, this solicitation will be synopsized and interested parties may respond. This requirement was issued on Fed Biz Ops.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE Prices will be determined fair and reasonable to the Government by the Contracting Officer through cost/price analysis and negotiations. Similar work performed on other contracts will be used as a benchmark, as well as reviewing the pricing for the previous acquisition. The Contracting Officer will also coordinate with DCMA in terms of evaluating the contractor’s proposal. The contractor will provide certified cost and pricing data IAW FAR 15
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED
Market research was performed in accordance with FAR part 10. The sources of information used in this market research include the internet; Bing, Dogpile, Google; IEEE trade societies, and other industry participants. Results from a sources sought synopsis was conducted on 19 June 2013. It was found that the LLCW testing systems for aircraft are very complex, highly specialized and would result in substantial duplication of costs and unacceptable delays in fulfilling contract requirements if not sole source to URS. URS is currently the only source with the expertise, clearance and access to proprietary data required to participate in all phases of the test.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION
The Government does not have and cannot timely obtain the expertise to fully operate and maintain the ILLCW equipment. To utilize government personnel on this effort requires access to personnel with Electro Magnetic Pulse (EMP) expertise and access to aircrafts for testing. The Government does not have the resources for manpower increase to support this effort. URS is currently the only qualified source for hardware integration and full system operation. All current fiber optic transmitters, receivers, and sensors are proprietary to URS and all repairs would be accomplished through this contractor.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
There are no actions planned at this time. In order to solicit this requirement competitively, the Government would need to reverse engineer the components to the equipment that URS has proprietary right (which the Government is unable to do at this time) or other contractors would need to subcontract to URS after obtaining the contract- these circumstances would result in driving the cost of the requirement up unnecessarily.
