II. Nature and/or description of the action being processed.
Due to the circumstances described below, this activity will acquire the highly specialized services using "Other Than Full and Open Competition" (OTF&OC) procedures. This Justification and Approval (J&A) is a Class J&A because all of the listed contracts were awarded as multiple awards for the same Contract Field Team (CFT) contract, and therefore, all listed contracts were required to perform the same or similar work.
This Class J&A authorizes the use of other than full and open competition procedures to extend the ordering period on current CFT Basic Contracts by bi-lateral modifications. The current CFT contracts are non-commercial and were competitively awarded on 3 October 2008 to: AECOM Government Services Inc.
(FA8108-09-D-0001); CSC Applied Technologies, LLC (FA8108 -09-D-0002); Defense Support Services, LLC (FA8108-09-D-0003); DynCorp International, LLC (FA8108-09-D-0004); L-3 Communications Aerospace, LLC (FA8108-09-D-0005); Lear Siegler Services, Inc. (FA8108-09-D-0006); Northrop Grumman Technical Services (FA8108-09-D-0007); Kay and Associates, Inc. (FA8108-09-D-0008); M1 Support Services, LP (FA8108-09- D-0009); Macaulay-Brown, Inc. (FA8108-09-D-0010); and VSE Corporation (FA8108-09-D-0011).
During the seven (7) years of the current CFT contract the following changes have occurred among the original eleven (11) contractors:
1. CSC Applied Technologies, LLC was purchased by PAE Applied Technologies, LLC. Option III of the Basic Contract was not exercised.
2. Defense Support Services, LLC (D52) was purchased by PAE Applied Technologies, LLC.
3. Lear Siegler Services, Inc. was purchased by URS Federal Support Services, INC.
4. Northrop Grumman Technical Services (NGTS) option was not exercised at NGTS's request due to workload issues and therefore NGTS would not be included on any Fair Opportunity Notices effective 7 July 2010.
5. CSC (aka PAE) agreed that its option would not be exercised as of 30 September 2014.
6. AECOM Government Services purchased URS Federal Support Services, INC. AECOM agreed and the Government did not exercise the FAR Clause 52.217-8 Option to Extend Services.
These contracts were awarded for a seven (7) year ordering period to include a two (2) year basic ordering period with two (2) 2-year options and one (1) 1-year option each for a total estimated value of $10.12B.
The individual awards included the following contract types: Fixed Price (Firm Fixed Price and Fixed Price Incentive Fee) and Cost Reimbursement (Time and Material and Cost Plus Incentive Fee) line items. As a result of these changes, the CFT contracts to the following contractors will be extended:
Defense Support Services, LLC (FA8108-09-D-0003)
DynCorp International, LLC (FA8108-09-D-0004) L-3 Communications Aerospace, LLC (FA8108-09-D-0005) Lear Siegler Services, Inc. (FA8108-09-D-0006) Kay and Associates, Inc. (FA8108-09-D-0008) M1 Support Services, LP (FA8108-09-D-0009) Macaulay-Brown, Inc. (FA8108-09-D-0010) VSE Corporation (FA8108-09-D-0011)
The CFT contracts provide a rapid deployment capability to field necessary skilled technicians for modification, repair or maintenance of DoD weapon systems on site anywhere in the world. The customers supported by the CFT contracts include but are not limited to the Army, Navy, Marine Corps, Coast Guard, and the United States Air Force.
The above contracts' ordering period expires on 31 March 2016 and will be extended in accordance with the details herein. The contracts ordering periods will be extended for one (1) year beginning 1 April 2016 and continuing to 31 March 2017. The use of the one (1) year extension will provide coverage of the service gap between the current CFT contract and the robustly competed follow-on contract. Due to anticipated December 2016 award date for the follow-on CFT contracts, the gap in coverage creates an unacceptable risk to the CFT customers and could have a significant impact to CFT customers' missions.
The estimated monetary impact of the one year extension is . This amount was derived by utilizing the average obligations per year for the last seven (7) years of the contracts. The one year extension is for the ordering period only. All Task Orders awarded during the extended ordering period will be subject to Fair Opportunity Notices (FONs), and the previously approved ceiling amount of the CFT contract is not being increased.
Once the new CFT basic contracts are awarded, the contracts under this J&A will expire and all new task orders will be awarded under the new, fully-competed contracts.
III. Description of supplies/services required to meet agency needs.
A CFT is a group of contract maintenance personnel under individually awarded service contracts who are provided with Government-furnished special tools, equipment, and/or work space and supplies to accomplish depot, intermediate and organizational level modification/maintenance/repair effort on-site at operational Government locations, both in Continental United States (CONUS) and Outside the Continental United States (OCONUS). Air Force Material Command Instruction (AFMCI) 21-141, Contract Field Team (CFT) Program, 18 July 2008 established policy and procedures for the utilization of CFTs for modification/maintenance/repair of all systems in the DoD inventory, such as fixed and rotary winged aircraft, aerospace equipment, ground vehicles, communications, automatic data processing and cryptologic equipment, missiles and associated support equipment. This program supports Air Force requirements at each of the Air Logistics Complexes, Air Combat Command, Air Mobility Command, Air Force Reserves, and Air National Guard. The CFT contracts are also used extensively to support Army and Navy requirements as well as requirements generated by other Federal agencies such as the Coast Guard. The CFT Program provides flexible support and rapid deployment capability to the field with necessary skilled technicians on-site anywhere in the world to support the Government's war readiness and posture planning needs.

IV. Statutory authority permitting Other than Full and Open Competition.
10 USC 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(iii)(B), with an application pursuant to FAR 6.302-1(a)(2)(iii)(A), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. FAR 6.302-1(a)(2) allows for limited responsible sources to be included in this class J&A for DoD. All task orders awarded under this J&A will be competed at the task order level amongst the eight (8) contractors identified in section II.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
DynCorp International; URS (aka Lear Siegler Services, Inc.); Defense Support Services LLC (D52); L-3 Vertex; Kay and Associates; Ml; Macaulay-Brown Inc.(MacB); and VSE Corporation (VSE) are the only known responsible sources that possess the expertise necessary to provide the services to Government specifications and prevent unacceptable delays. The services are available from these eight (8) sources.
These sources were established on the 2008 competitive source selection in which each was determined to be responsible sources to support the Government's requirements.
A failure to extend services for one (1) year beyond current contract expiration (31 March 2016) would create an unacceptable delay in support of DoD operations throughout the world, especially troops deployed in support of Overseas Contingency Operations (OCO) on fixed and rotary winged aviation aircraft returning from war efforts. Mission support in other non-theater environments for servicing of returning equipment would also be disrupted. CFT customers would be negatively affected and disrupted in such ways as not having adequate or timely maintenance and modification support of rotary and fixed winged aviation aircraft, ground vehicles, communication equipment, and weapon systems as well as effects on support roles in providing materials for troop support. Due to the unusually high number of offerors and the coordination of high-level reviews/approvals, there is inadequate time to complete the source selection for the follow-on CFT contract and avoid a severe interruption in performance to all customers without the one year extension. Anticipated award of the follow-on contracts is December 2016;
the ordering period of the existing CFT contracts expires on 31 March 2016. This 9-month gap would cause significant disruption to DoD missions globally. The customers affected by the extended ordering period have been made aware of the constraints under which CFT PMO is operating. Potential new customers have been provided the timetables required to meet the performance requirements of the 31 March 2016 expiration. Approval of the extended ordering period will ensure all forecasted CFT customers have sufficient coverage as well as ensure coverage for those requirements not forecasted at this time.
If the CFT contracts are not extended beyond 31 March 16, CFT customers at approximately 30 sites worldwide could experience up to a 180 day interruption in service while working to establish their own stand-alone contracts. The 180 day calculation is based on contract replacement time utilizing the CFT matrix for issuing a new contract package. In the event customers are required to perform separate stand-alone source selections, they would not receive the needed rapid response and would run into their own contracting constraints, resulting in unacceptable delays and interruption in service in forward deployed areas while new contracts are being processed. The cost of such an impact in coverage cannot be accurately predicted but could conceivably be significant in both dollars and time.
Approval of the one (1) year extension to the ordering period will prevent a substantial amount of cost and time to perform an additional source selection. Approval of the extension will also prevent excessive duplication of cost that could not be recovered through competition.
The CFT contractors listed above are the only firms capable of providing the supplies and services described in Section III without causing unacceptable delays in fulfilling vital requirements to the war fighter. Issuing the extension to the ordering period will also prevent excessive duplication of cost that could not be recovered through competition.
VI, Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Sources Sought Notice was issued on December 22, 2014 to FedBizOps under 15AF9999 for purposes of market research in search of a feasible alternative to utilizing the FAR Clause 52.217-8 to extend the ordering period through 31 March 2016.
The Sources Sought listed and briefly described the expected sites with the estimated manning requirements. All interested parties were required to be able to demonstrate capability to perform the entire effort of estimated workload listed in the Sources Sought. Three (3) companies expressed interest in the Sources Sought of which one (1) was an incumbent on our current contract and the other two (2) were small businesses that have expressed interest in competing on the follow-on contract. The two (2) small businesses would not be able to provide the required manning and support of all the projected workloads in the required transition periods, locations, and manning requirements listed in the Sources Sought. The incumbent that expressed interest would be able to meet the requirements listed in the Sources Sought, but would turn an already existing competitive contract into a sole-source environment.
Extending the current contracts enables competition among eight (8) proven CFT contractors at the individual task order level. Extending all eight (8) contracts to maintain competition during the one year ensures supportability to the customer and their mission. Limiting the number of competitors under this Indefinite Delivery Indefinite Quantity (IDIQ) contract could jeopardize the ability to support the customers and their missions and since all eight (8) contractors have acceptable performance it is in the Government's best interest to allow all to compete for this workload.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The cost of the one (1) year extension will be fair and reasonable to the Government. The original proposals were received in a competitive environment wherein cost & price analysis were also utilized along with audit and pricing assistance. The original competition established Not to Exceed (NTE) Rates for each option period of the contracts. Each contractor's NTE were priced in advance in a competitive environment and determined fair and reasonable across all option periods. The NTE rates to be applied to the billing rates for this one year extension will remain the same. The contractors will competitively propose billing rates in each individual Task Order in accordance with revisions to the appropriate wage determinations as required by FAR 22.404-2(a) and FAR 52.222-43. These individual efforts will be awarded using FONs and will be found fair and reasonable based on adequate competition.
11111. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
In accordance with FAR Part 10, market research was conducted by issuance of a Sources Sought synopsis of the proposed acquisition, advising industry and soliciting inquiries from interested parties. The Sources Sought synopsis was released to FBO.gov under 15AF9999 on 22 December 14 in an effort to explore feasibility of an alternative approach to utilizing the 6 month extension to the current CFT contract. Three
(3) sources expressed interest of which one was an incumbent that has the ability to perform all the requirements listed in the sources sought. The other two (2) sources were found to not meet all the requirements listed in the sources sought. In the case of the sources sought, having only one (1) qualified contractor would potentially result in a sole source environment in comparison to the competitive acquisition that we have under the existing CFT contract.

Xl. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The follow-on CFT contracts are anticipated and will be awarded under robust competition as proposals have been solicited from as many sources as practicable. Issuing a one year extension to the ordering period will allow contract coverage for approximately 30 sites. The follow-on competitive acquisition is anticipated to award December 2016.
