FA810119RA010 Questions
1. The wage determination identifies ambulance driver and emergency medical technician and their rates, what base wage should be used for paramedics as the average wage of paramedics is higher than an EMT, Should bidders use the EKG Technician for as the base rate for Paramedics?
Answer: It is up to the company to determine the pay for their employees for labor categories not included on the wage determination. The wage determination is the prevailing rate for the occupation in the locality. The prevailing rate then becomes the minimum rate that the contractor must pay its employees working on the contract.
2(a). The pre-solicitation documents contained detailed instructions to offerors that are not apparent in the new solicitation documents. For instance, what are font and margin requirements?
Answer: See 52.212-1 Addendum updated paragraph 2.4 2(b). Volume names and content instructions?
Answer: See 52.212-1 Addendum updated paragraph 2.3.3 Table 1 Proposal Organization.
2(c). Is there a past performance questionnaire that needs to be provided and if so, can the government please provide it?
Answer: See 52.212-1 Addendum updated ITO Attachment 1.2 Past Performance Questionnaire. We will post a separate copy to make it easier to complete.
3. Section 3.2.1. - Technical - states "The Offeror, and subcontractors as required, must provide original copies of their approved state license/certification to provide ambulance services on an around Tinker Air Force Base from the Oklahoma State Department of Health EMS Division to be considered for the technical evaluation. (Note: Failure to provide the required license/certification with the original proposal will result in the Offeror being unawardable. Also, the Government will not accept proposals that state required license/certifications will be obtained prior to contract award or prior to commencement of full performance.)
Pursuant to Title 63 of the Oklahoma Statutes - Oklahoma State Department of Health - Emergency Medical Services - Statutes and Regulations, Effective 11 SEPT 2016, Section 310:641-3-11(c) "The license shall be issued only for the name, service area (area of coverage), level, and type of service given in the application."
Therefore, considering the language of the Solicitation, and the language of the State of Oklahoma, it is impermissible for this offeror, and potentially others, to meet this pre-offer qualification which is unduly restrictive of competition, anti-competitive, arbitrary and capricious. There is no legitimate rationale that that would preclude an otherwise qualified offeror from obtaining a State of Oklahoma license prior to the Phase-In period.
Answer: The Addendums were updated to remove “on or around Tinker Air Force Base”. There is still a technical requirement to be licensed for ambulance services by the state of Oklahoma at the time of proposal submission. See 52.212-1 Addendum updated and 52.212-2 Addendum updated.
4. Do you have to have an Oklahoma license at the time of application?
Answer: Yes, an Oklahoma license is required when you submit your proposal.
5. What are the limits of insurance that is necessary to bid the contract? For example general liability, or vehicle amount.
Answer: The limits of insurance amount is for the offeror to decide.
