2.1.2 Project Manager (PM): The Contractor shall designate and provide a PM who has relevant experience at a comparable level of responsibility in projects of similar size, scope, and complexity. The PM or alternate shall have full authority to act for the Contractor on all contract matters relating to this contract. The PM or alternate shall be available on-site within one hour, upon request both during and after the Government's regular working hours. The PM and the alternate must be able to read, write, speak, and understand English.

2.1.3 Quality Manager (QM): The Contractor shall designate and provide a Quality Manager other than the Site Safety and Health Officer (SSHO) who shall have full authority and responsibility for assuring performance objectives and standards identified in this contract are met. The QM or alternate shall be available on-site within one hour, upon request both during and after the Government's regular working hours.

2.1.4 Site Safety and Health Officer (SSHO): The Contractor shall designate and provide a SSHO other than the Project Manager and the Quality Manager whose duties and responsibilities include preparing and enforcing the Contractor’s safety program on this contract. The SSHO shall have fulfilled the following prerequisite training and experiences before being hired as the SSHO under this contract. The SSHO shall have satisfactory experience in preparing and enforcing safety programs on contracts of similar size and complexity in the past, and have completed the OSHA General Industry Course and must keep current.

2.1.5 Operators: Bus operators shall comply with all federal, state, and local laws and regulations regarding certification, training, and licensing/permits. All bus operators shall be trained by the Contractor in the routes, bus types available, appropriate emergency evacuation procedures for a bus, including the safe and expedient evacuation of all student passengers. All bus operators shall be trained and maintain current certification in Red Cross CPR and First Aid procedures for children and young adults. Licenses, permits, training, and medical records shall be submitted as per the submittal section to the Contracting Officer (CO).

2.1.6 Personnel: The Contractor shall provide personnel with the qualifications, technical knowledge, experience, licensing, and skills required for safe, reliable, and efficient operations. Personnel shall fluently speak, read, and comprehend English to the extent that they can perform the contract requirements, comply with installation emergency procedures, and communicate with young school children. Refer to Attachment D which has additional important collective Contractor and individual employee references. The Contractor shall ensure that all employees present a professional appearance that is appropriate for their position. All Contractor employees working under this contract shall be identified by a distinctive nameplate, emblem, or patch attached in a prominent place on an outer garment.

Employee identification shall not be substituted for station required passes or badges.

2.1.7 Conflict of Interest: The Contractor shall not employ active duty military or Government civilian employees to perform this service under this contract.

2.1.8 Work Reception and Telephones: The Contractor shall provide the capability to receive, prioritize, correspond, and respond to trouble/service calls during Government regular working hours; and provide a point of contact at a local or toll free telephone number who can perform the above function during other than Government regular working hours. Provide contact name and telephone information per submittal section.

2.1.9 School Bus Schedules: The Government shall provide an initial bus schedule (Attachment B). The Contractor shall maintain and update bus service schedules as needed, when directed by the Government. All schedules are subject to approval by the Contracting Officer. The school bus schedule must reliably support and meet all school and route requirements in Attachment B. School bus service shall be provided to schools in session between the hours of 0600 and 1800, Monday through Friday, for approximately 180 school days (depending on school jurisdictions, weather, and laws) beginning in August and ending in July of each year for the duration of this contract, as well as for the two (2) option years, if exercised, as listed in 2. Description of Services. No service shall be required on weekends, school holidays, regularly scheduled schools breaks, summer vacation, or when the schools are closed due to inclement weather. School bus transportation service will be provided to students for schools listed in Attachment B that are open on Holidays. School make-up days shall be considered as normal school days.

The Contractor shall schedule bus transportation to arrive at all schools no earlier than thirty (30) minutes prior to the scheduled start of the school day and no later than ten (10) minutes prior to the school starting time. The Contractor shall pick up students within five (5) minutes after the close of the school day and transport passengers to arrive at the last bus stop not later than ninety (90) minutes after the close of school. When a school bus is delayed at the end of the school day, the bus driver shall notify the PM when the bus has not left the school fifteen (15) minutes after the end of the school day or when a driver is delayed in route for any reason (e.g., traffic or weather). This notification shall include the bus location, reason for delay, and approximate arrival time on JBAB. The PM shall immediately forward the same report to the Government representative.

The Contractor shall prepare a schedule of bus routes with times of departure at each bus stop on base, and provide to the Contracting Officer’s Representative (COR) for parent distribution and posting. Each bus shall have two signs:

one on the windshield with the route number big and bold, and another on the door that clearly shows what schools the bus is going to. The Contractor shall submit to the COR one copy of the bus routes (Attachment B) (with bus numbers), including written route directions for each school(s) from JBAB prior to performance. The Contractor shall provide the COR a copy of the route(s) and schedule(s) changes as per the submittal section. The schedules shall reflect and ensure that sufficient seating for each child registered to use the service and in accordance with National Highway Traffic Safety Administration (NHTSA) safe seating recommendations (Ref. in Attachment A). The Contractor shall keep the COR informed of current bus capacity limits as per Attachment B to prevent emergency contract actions. Any request to add or delete schools from the bus routes (Attachment B) shall be submitted in writing to the COR prior to ANY route changes or route consolidations. These changes are required to be approved by the COR before execution of the route in the morning or afternoon. The COR will give advance notification to the Contractor on changes to the pick-up or delivery points.

2.2 Bus Requirements

2.2.1 Buses operating under this contract shall be certified, owned or rented, and include required components to be properly designated as a school bus transportation vehicle, and not be older than ten (10) years. All guidelines as outlined in CFR Title 49, Chapter V, Part 571, National Highway Traffic Safety Administration (NHTSA), and Highway Safety Program Guideline #17 (Pupil Transportation Safety) will apply to all buses used under this contract.

The company name shall be displayed on each of the Contractor's vehicles in a manner and size that is clearly visible.

All buses shall be yellow in color and contain fully functioning air conditioning systems. All vehicles shall display a valid state license plate that complies with State Vehicle Code. Vehicles shall meet all other requirements of the State Vehicle Code, such as safety standards, and shall carry proof of insurance and state registration, if applicable. Each bus shall be clearly marked to indicate the route(s) and bus stop(s) being serviced.

2.2.2 Buses: Contractor shall determine with approval of the Contracting Officer, the most cost effective and safe routing and bus size to transport students from JBAB to school destinations based on the projected requirement from historical figures (Attachment B can be used an example). The Contractor shall submit the bus route and list of vehicles to include the year of manufacture, make, model, seating capacity, and vehicle identification number as per Attachment G.

2.2.3 Camera Systems: All buses shall have fully functional and operational camera systems installed. All personnel on Government-contracted buses are subject to monitoring at all times. The camera system shall be utilized to monitor all personnel on the buses at all times. Camera must be able to clearly view and record images of students seated from five (5) feet behind the driver to the rear of the bus providing 360 degree coverage of the interior of the bus. It must be able to record recognizable video images in both daylight and at night with no adjustments. The observation system must be capable of recording the sounds from within the entire school bus. In addition, all electronic video files/recordings shall be playable and transferable onto computers that are Microsoft Windows compatible.

The Contractor shall provide to the Contracting Officer evidence the camera systems have been purchased and evidence of the scheduled installation date. All buses shall be equipped with live camera systems. All buses shall provide signage stating that surveillance systems are in use. The access to camera disk and information regarding placement of the camera systems will be limited to the Government. The Contractor shall ensure personnel involved in installing or servicing the camera systems, do not divulge to unauthorized personnel that each system is considered a “live” system. Bus drivers and students are considered unauthorized personnel and are not privileged to any information regarding the camera systems and/or recordings. The Contracting Officer must approve, in advance, access to the disk and the camera system by any other individual not listed above. The recordings shall be reviewed upon request. A copy of the recordings will be put on a disc upon request. The Government will coordinate with the Contractor’s on-site manager to determine that all buses have “live” and operational camera systems. Changes to these determinations will only be made with the approval of the Contracting Officer.

2.2.4 Communication: Each bus driver shall be equipped with reliable communication to the PM. All bus drivers shall be required to have a cell phone with hands free capability and a cell phone charger on the bus. In addition, each driver must have the capability to properly find and communicate alternate routes in the event of road closures.

2.2.5 Inspection, Maintenance, and Cleaning: The Government reserves the right to periodically inspect the Contractor’s vehicles. If any vehicle is found to be unsafe or unsatisfactory, as identified by the standards called out in the PWS, the Government may prohibit the vehicle’s use until such unsafe or unsatisfactory conditions have been corrected. In such an event, the Contractor shall replace the vehicle(s) to maintain the schedule and other contractual requirements. All maintenance inspections and repairs are the sole responsibility of the Contractor. The Contractor shall furnish all necessary gasoline, diesel fuel, oils, and lubricants necessary for the performance of this contract.

Maintenance records shall be submitted to the Contracting Officer as per the submittal section. The Contractor shall be responsible for cleaning and maintaining all work and parking areas daily, including costs associated with the proper cleaning/disposal methods for accidental spills/leaks of any fuels, oils, or lubricants. Standard cleaning of the buses shall include having them be presentable for ridership each day to include no garbage/debris on or under the seats, being swept daily, and being wiped down with disinfectant hand-wipes which have a minimum of 60% and above alcohol on a weekly basis.

2.2.5.1 Additional Health and Wellness Cleaning: In the event that additional health and wellness cleaning is needed, such as in the event of a pandemic like Corona Virus Disease (COVID), the Contractor shall be responsible for cleaning all buses before and after each trip. The Contractor shall wipe down all common points of contact and the seats on all buses after the morning drop-off and the afternoon drop-off (twice daily) with disinfectant hand-wipes which have a minimum of 60% and above alcohol. Bus drivers are to wear masks at all times during which the additional health and wellness cleaning is being implemented.

2.2.6 Authorized Passengers: Authorized passengers include dependents of Active Duty or Department of Defense (DoD) civilian personnel in grades Kindergarten through 12th grade residing in military housing in the DC area on the following military installations: JBAB, the Navy Yard, Ft. McNair, and the Marine Barracks. Students who reside on the Navy Yard, Ft. McNair, or the Marine Barracks must come to JBAB for School Bus Transportation, if desired.

Additionally, Route 14 is authorized to pick up non-DoD affiliated Learn DC Public Charter School students on a space available basis.

The Government will provide bus drivers a list identifying students authorized to ride the buses. The Government will issue each student a bus pass as authorization to ride the bus. Drivers shall check bus passes every morning and afternoon during boarding times. Immediately following completion of the route, bus drivers shall prepare and submit to the Government a written report identifying any student who does not possess a bus pass. The Government will identify to the bus driver in writing any student who will be denied bus boarding.

The Government is authorized to board the buses when performing inspections and evaluations and a bus pass shall be provided for the Contracting Officer and Contracting Officer Representative. Security Forces and off-base police officers shall be authorized to board the bus when performing official duties (e.g., safety inspections/accidents). Bus drivers shall verify their identity by requesting a form of photo ID. Bus drivers shall refuse boarding to any unidentified individuals and report the incident immediately to the PM and Government.

2.3 Safety Requirements

2.3.1 Safety Plan: The Contractor is responsible for developing and submitting a Safety Plan that includes the

Accident Prevention Plan (APP), Activity Hazard Analysis (AHA), Hazard Specific Safety Plan, Emergency Response Plan, Health Hazard Control Plan, and Accident Reporting and Damage Reporting. The Contractor shall develop and implement a Safety Program detailing how the Contractor executes all safety practices while delivering best value services to the Government without any accidents or mishaps. The Contractor’s safety program shall comply with all applicable safety standards identified in the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM-385-1-1 Section I threw I-B and Public Law 91-596, Occupational Safety and Health Act (Ref. in Attachment A) and any other safety regulations. In addition, the Contractor must comply with all D.C., state, and local laws and regulations pertaining to school buses and school bus operations and safety.

2.3.2 Code of Conduct: Bus drivers shall provide for the safety of passengers and enforce the “Code of Conduct” (Attachment F) for bus passengers. Buses shall only pick-up and/or drop-off passengers at the designated bus stops and schools. Buses shall be brought close to the pick-up point at the designated stops so that all passengers may step from the curb to the bus, or the bus to the curb, without stepping into the street. The bus shall not move from a stop until all passengers are seated or have completely disembarked. Drivers shall not change student’s seats while the bus is in motion except in conditions involving the safety of the students. A Behavior Referral Form (Attachment E) shall be provided to the Government when any passenger violates the Code of Conduct within 24 hours.

2.3.3 Passenger Supervision: Under no circumstances will the bus driver leave the riders without proper supervision.

2.3.4 Accident Reporting: When a bus is involved in an accident, it shall be reported immediately to the Government following first response. The Contractor shall follow up with a written Contractor Significant Incident Report (CSIR) to the Contracting Officer within eight (8) hours of the accident. If any local authorities were at the scene of the accident, a copy of the police report shall also be provided within 48 hours.

2.3.5 Fire Extinguishers: Buses shall be equipped with at least one dry chemical type fire extinguisher meeting the requirements of the applicable Government authority or nationally recognized testing agency. It shall be mounted in extinguisher manufacturer’s bracket of automotive type, and located in the driver’s compartment in full view and readily accessible to the driver. If extinguisher is of stored pressure type, it shall be equipped with a gauge and checked for correct pressure on a regular basis.

2.3.6 First Aid Kit: The Contractor shall provide and maintain a fully stocked first aid kit mounted in full view and in an accessible place in the driver’s compartment. All first aid kits must be approved by applicable local, state, or Government authority when no applicable regulations exist.

2.3.7 SAPR Compliance: The Contractor shall comply with Sexual Assault Prevention and Response (SAPR) Program. The SAPR reporting requirements apply only to knowledge obtained by Contractor personnel while performing services under this contract.

2.3.7.1 The Contractor shall require all personnel with knowledge of an incident of sexual assault occurring on a Government facility, to include a Government leased facility, where the Contractor is providing services under this agreement, to report the incident to the Contractor, who shall immediately report the incident verbally to Law Enforcement. Also, simultaneously in written or email to the Government’s COR or Representative (within 24 hours). All incidents shall be reported whether they involve Contractor personnel or Government personnel, or other individuals.

2.4 Government Furnished Facilities (GFF)

2.4.1 Government-Furnished Facilities (GFF): In accordance with FAR 52.245-1 – Government Property, FAR 52.245-2 – Government Property Installation Operation Services, FAR 52.245-9 – Uses and Charges, the following paragraphs, and Attachment C, upon request the Government will furnish or make available to the Contractor a School Bus parking/staging area on JBAB in connection with this contract. The exact location of such parking/staging area on JBAB shall be designated by the Government Program Manager (PM). Compliance with the Occupational Safety and Health Act (OSHA) and other applicable laws and regulations for the protection of employees is exclusively the obligation of the Contractor. Further, the Government will assume no liability or responsibility for the Contractor’s compliance or noncompliance with such requirements. Additionally, the Government is not responsible for any vandalism or harm done to the buses while left in the parking/staging area and the Contractor assumes full liability for the safety and operation of the buses using the parking/staging area. The buses in the parking/stage area must be fully operational. Any bus not operational must be repaired or removed within 24 hours after identification. No alterations to the facilities shall be made without specific written permission from the Contracting Officer. In the case of alterations necessary for compliance with the OSHA, such permission shall not be unreasonably withheld. The Contractor shall return the facilities to the Government in the same condition as received, fair wear and tear and approved modifications excepted. Only buses used in the performance of this contract may be permitted to utilize these facilities. These facilities shall be used only in the performance of this contract. School buses are not to be parked anywhere else on the installation, unless they are in the performance of this contract.

2.5 Environmental Requirements

2.5.1 Environmental Management and Sustainability: The Contractor shall comply with all applicable Federal, State, and local laws, and with the regulations and standards listed for DoD and base installations. All environmental protection matters shall be coordinated with the Contracting Officer. Inspection of any of the facilities operated by the Contractor may be accomplished by the Activity Environmental Protection Coordinator, or authorized officials on a no-notice basis during Government regular working hours. In the event that a regulatory agency assesses a monetary fine against the Government for violations caused by Contractor negligence, the Contractor shall reimburse the Government for the amount of that fine, costs of defending against administrative or other legal action, remedial action, and other costs.

2.5.2 Waste Management: The Contractor shall assist the Government by complying with the base recycling program. This may require segregating reusable/recyclable waste materials by type. The Government shall retain ownership of all reusable waste materials. Non-reusable waste materials (trash and garbage) will be removed from the facility by a Government-approved method. In the event of renovation by Contractor, it is the responsibility of the Contractor to obtain the necessary dumpster and proper disposal at Contractor expense.

2.5.3 Environmental Protection: The Contractor shall comply with all applicable Federal, State, and local laws, and with the regulations and standards. All environmental protection matters shall be coordinated with the Contracting Officer. Inspection of any of the facilities operated by the Contractor may be accomplished by the Installation Environmental Protection Coordinator, or authorized officials on a no-notice basis during Government regular working hours. The Contractor shall comply with the instructions of the cognizant Air Force medical guidelines with respect to avoidance of conditions which create a nuisance or which may be hazardous to the health of military or civilian personnel. The Contractor is responsible for ensuring that its employees receive applicable environmental and occupational health and safety training, and are kept up to date on regulatory required specific training for the type of work to be conducted onsite. All on-site Contractor personnel, and their subcontractor personnel, performing tasks that have the potential to cause a significant environmental impact shall be competent on the basis of appropriate education, training, or experience.

3. QUALITY ASSURANCE

3.1 Inspection. The inspection for all services rendered under this contract shall be performed by the COR. The performance by the Contractor personnel, the quality of services rendered, and any documentation or written material in support of same, shall be subject to continuous inspection, surveillance, and review for acceptance by the CO or

COR.

3.2 Quality Assurance Surveillance Plan: The Contractor will be evaluated based on the Quality Assurance Surveillance Plan (QASP) and the Safety Plan integration.

4. SECURITY REQUIREMENTS

4.1 Access to Installation: All Contractor personnel will obtain access to the installation through enrollment and registration into the Defense Biometric Identification System (DBIDS). The Contractor will provide the CO with the name of their designated Contractor Representative for enrollment in DBIDS. Once enrolled, the Contractor must provide the DBIDS Registrar with an approved employee list and then direct their employees to register into DBIDS.

4.2 Defense Biometric Identification System (DBIDS): DBIDS is a program in which Contractor personnel who enroll, and are approved, are subsequently granted access to the installation for a period up to one year, or the length of the contract, whichever is less, and are not required to obtain a new pass from the Visitor Control Center for each visit.

The Government performs background screening and credentialing. Throughout the year the Contractor employee must continue to meet background screening standards. Periodic background screenings are conducted to verify continued DBIDS participation and installation access privileges. Under the DBIDS program, no commercial vehicle inspection is required, other than for Random Anti-Terrorism Measures (RAM) or in the case of an elevation of Force Protection Conditions (FPCON).

The following is required to obtain a DBIDS credential:

4.2.1 Present a letter or official document from the Government sponsoring organization that provides the purpose for your access.

4.2.2 Present valid identification, such as a passport or Real ID Act-compliant state driver's license.

4.2.3 Present a completed copy of the JBAB 5512 Base Access Registration Form to obtain your background check.

4.2.4 Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments; after all this is done, you will be provided a DBIDS pass.

There is no cost to obtain a DBIDS credential.

4.3 The Contractor shall obtain current vehicle registration and all necessary licenses and permits by all applicable Government agencies prior to commencement of this contract for all vehicles used in the performance of this contract and during the performance of this contract if any vehicles are added or replaced.

Evidence shall be made available to the CO and COR per Attachment G.

4.4 Physical Security: The Contractor shall be responsible for safeguarding all Government property provided for contract use. At the end of each work period, all Government facilities, equipment and materials shall be secured.

5. HOURS OF OPERATION

5.1 Normal Hours of Operation: The Government's regular working hours are from 0600-1800, five (5) days per week, Monday through Friday, except observed Federal holidays. Any work outside Government regular working hours requires prior approval by the Contracting Officer.

5.2 Performance of Services During Crisis Declared by the National Command Authority or Overseas Combatant Commander: The Contractor shall perform all services under this contract during a national emergency or crisis according to the Department of Defense Instruction (DODI) 3020.37. The Contractor is expected to perform emergency or special event services as indicated in aforementioned paragraphs, unless otherwise directed by an authorized Government representative.

5.3 Days Off from School: The District of Columbia Public Schools Calendar shall be utilized for determining the days in which busing must be provided and the days in which busing is not needed for JBAB. Regardless of the public school or charter school the children attend, this is the schedule the Contractor will follow in the performance of its duties. Should a particular school utilize another schedule, the parents or legal guardians of the children are responsible for transporting their children on days in which buses are not needed for JBAB pursuant to the District of Columbia Public Schools Calendar (Attachment H). It should be noted that days off include holidays, parent teacher conferences, professional development, and for other reasons.

*For the 2021-2022 school year, a minimum of fourteen (14) buses are required for this contract based on the routes above. Number of routes, buses, and number of riders per bus are subject to change based on actual enrollment, which will not be known until shortly before the school year starts. As such, the above is subject to change on a yearly basis.

In order to account for this, Contractors must submit their proposals with a price per bus per route for each of the fourteen (14) routes listed above, taking everything into account, and then providing an overall grand total. In essence, each route will have its own price and in the future, if multiple buses are needed for the same route, the price will just be doubled, tripled, etc.

Additionally, in the event one of the buses breaks down, it is the Contractor’s responsibility to procure a replacement bus in order to transport the children to and from school on the day of in fulfillment of the contract requirements and until the original bus can be repaired or replaced. Authorized passengers include dependents of Active Duty or Department of Defense (DoD) civilian personnel in grades Kindergarten through 12th grade residing in military housing in the DC area on the following military installations: JBAB, the Navy Yard, Ft. McNair, and the Marine Barracks. Additionally, Route 14 is authorized to pick up non-DoD affiliated Learn DC Public Charter School students on a space available basis

**This is the current estimate of the number of children residing on military installations within DC (JBAB, the Navy Yard, Ft. McNair, or the Marine Barracks) needing busing to the Learn DC Public Charter School. This number will fluctuate based on enrollment and as the school grows. It should also be noted that the Learn DC Public Charter School is opening for the first time in the 2021-2022 school year with only grades Kindergarten and 1st grade. Each year thereafter, a grade will be added until it reaches 8th grade. As such, enrollment at the Learn DC Public Charter School is expected to increase each year over the life of this contract (including option years) with changes in number of buses and bus routes going from more on base to less off base as children attend this school over off base schools.

For example, for the 2022-2023 school year, the Learn DC Public Charter School will have grades Kindergarten, 1st, and 2nd, so it is likely more buses and bus routes will be needed for this school and less for off base schools as the Learn DC Public Charter School reaches its final student capacity.

***JBAB provides a Youth Center on base for before and after school care for school children grades Kindergarten through 6th Grade. It is the parents’ responsibility to drop off and pick up their kids from the Youth Center for before and after school care. JBAB provides busing for those children attending before and after school care at the Youth Center to and from their public or charter school, including the LEARN DC Public Charter School. As such, some of the routes above include a stop at the Youth Center, for those who attend before and after school care there, to transport those children to and from their public or charter school, including the Learn DC Public Charter School.

****It should further be noted that both the Youth Center and the Learn DC Public Charter School do provide openings for preschoolers, but it was not noted anywhere above as bus services for preschoolers is not subject to this contract. Parents who have preschoolers attending the Youth Center and the Learn DC Public Charter School must provide their own transportation for their children to either facility. DRAFT

ATTACHMENT C

GOVERNMENT FURNISHED FACILITIES

The following is a list of Government furnished facilities and services to be used by the Contractor in the performance of this contract:

For information on the specific Government Furnished Facilities to be provided under this contract, please see 2.4.1 Government-Furnished Facilities (GFF) above. In essence, the only Government Furnished Facilities under this contract is a parking/staging area on JBAB, at a location to be designated by the Government PM, to be used by the Contractor for the storage of the school buses needed for this contract, if requested by the Contract. Upon termination or expiration of this contract, the Contractor and Contractor’s employees shall vacate such facilities within five (5) working days after termination or expiration.

ATTACHMENT D

CONTRACTOR/DRIVER REQUIREMENTS

The Contractor shall have at least two (2) years of school bus transportation experience. Experience can be demonstrated as a Prime Contractor, or as a Subcontractor that has performed this effort for a Prime. Prior experience shall be verifiable and shall have performance ratings of at least Satisfactory from prior clients. The Contractor’s communications shall be limited to the Contracting Officer (CO) and the Contracting Officer’s Representative (COR).

Occasional communications shall be maintained with the School Liaison Officer, but only for the exchange of operational information updates. Written communications shall be limited within the Government organization to the CO and COR; unless assistance is required for information to be coordinated with the Office of the State Superintendent for Education (OSSE) through the Liaison.

The Contractor shall provide the Contracting Officer with the Contractor’s name, address, primary point of contract for this effort, Cage Code, DUNS, and Contractor’s Federal Tax Identification Number prior to performance. All drivers and others engaged in the operation of the Contractor’s school buses shall be employees of the Contractor.

Contractors shall carry adequate Workmen’s Compensation Insurance and cause a certificate of such insurance to be forwarded by the insurance carrier to the County immediately upon award, indicating that the policy is not subject to cancellation, non-renewal, or reduction in coverage until forty-five (45) days prior written notice has been given to the County.

All drivers shall be qualified under State (and/or the District of Columbia) law to drive a school bus and drivers shall be employed or continued in employment by the Contractor subject to approval by the Contracting Officer for fitness and competence. Bus drivers shall not drive the school bus until certified and approved by the Contracting Officer or COR, and any other authority required by law. The Contractor shall be responsible for compliance of their drivers with all laws, statutes, rules, and regulations for the transportation of school children, and DOT and FMCSA regulations, including but not limited to the 49 CFR 40 drug/alcohol program requirements for employees. The Contractor and their drivers shall be subject to pre-employment, random, post-accident, return-to-duty, and reasonable suspicion drug and alcohol testing in accordance with current Commercial Driver’s License (CDL) and FMCSA requirements.

The Contractor shall provide primary and substitute bus drivers who are capable of exercising acceptable control of school children at all times during transportation. Drivers shall observe the highest possible standards of safe driving at all times and strictly comply with all CDL rules and regulations. Primary and substitute drivers shall perform training to include: proper bus safety, proper student interactions, discipline referral process, and familiarization with primary and alternate routes. Also, refresher trainings shall be conducted at least once per semester. In addition, Contractor employees will not engage in the use of illegal drugs or alcohol while on the job and in accordance with the 49 CFR Drug & Alcohol Policies, bring firearms or weapons on the school bus or its surrounding areas, nor use cell phones for personal calls while driving the school bus. Emergency phone calls shall be permitted, provided the driver has first pulled the bus to a safe off-road area; an investigation which confirms a violation of this provision shall result in immediate suspension and/or termination of said driver’s responsibilities for the remainder of the school year, and/or termination of this Agreement. As such, text messaging with a mobile device while driving is strictly prohibited, and will result in immediate termination of said driver’s responsibilities for the remainder of the school year and/or termination of this Agreement. Bus drivers shall promptly report the detail of any misconduct or breach of order and discipline to the COR via the Bus Passenger Behavior Referral Form and in accordance with all other guidelines as set forth in the Code of Conduct for Bus Passengers (Attachment F) and JBAB Bus Instruction.

The Contractor is responsible for all timely communication with the Contracting Officer or COR pertaining to their fleet operations, including student or bus stop changes, incidents or accidents, and bus driver schedules. The school bus driver will not be held liable or responsible for any of the foregoing communication/information.

The Contractor shall notify the PM/COR of any and all uses of the buses for any other intended purpose other than designated to be used for this contract. Notification shall be made in writing to the PM/COR at least one week prior to the anticipated use, detailing purpose of the other intended purpose, the bus to be utilized, the designated bus driver, and the day/hours the bus would be used. Other intended uses of the bus are not permitted to interfere with regular school bus operations for the schools, and the assigned school bus must be made available for the regularly assigned routes as the first priority and as contractually obligated to do so.

Contractors are required to retain and consistently maintain a sufficient number of alternate drivers in case of emergency and/or vacation and sick leave. Throughout the entire school year, every substitute driver must submit all paperwork, as required by the Contracting Officer, prior to operating a school bus for a school bus route.

The Government reserves the right to terminate any contract, if in its opinion there shall be a failure, at any time, to promptly perform faithfully any of its stipulations, or in the case that bus services are not provided in full, as described in this contract. Failure to provide transportation for school bus routes can result in termination of this contract, at the sole discretion of the Government.

ATTACHMENT F

CODE OF CONDUCT FOR BUS PASSENGERS

The listing of rules for bus passengers provided below is not intended to be all inclusive of any and every type of inappropriate conduct by students. It is simply representative of the most common occurrences of misbehavior by students on the buses. Misconduct of any type will be handled, with appropriate consequences, by the school bus transportation Contracting Officer Representative (COR). In addition, some incidents of misconduct require immediate suspension of bus riding privileges due to their nature or severity. There is no specific requirement for parents to have received multiple notifications prior to suspension in these cases.

ALL BUS PASSENGERS MUST:

1. Show their current bus pass any time it is requested to the bus driver, COR, Security Forces, or any other appropriate personnel dealing with the school bus transportation program. Failure to produce a current bus pass will result in suspension of riding privileges until the issue is properly resolved.

2. Deliver any notices given by the bus driver or COR to their parents/legal guardians on the same day they were received by the student.

3. Arrive at their assigned base bus stop ten minutes prior to their scheduled pick-up time. Bus drivers will not wait for children who are not at the bus stop on base and/or school at the scheduled pick-up or drop-off time.

4. Conduct themselves in an orderly manner while waiting for, boarding, riding, and exiting the bus. No horseplay, pushing, crowding, or other malicious and inappropriate behavior is allowed on the bus or at the bus stop.

5. Select their seats before the bus is moving and remaining seated until the bus comes to a complete stop. The driver of the bus may require a student to change seats or assign them a permanent seat.

6. Comply with the driver’s instructions immediately. The drivers are in complete charge of the bus while in transit.

7. Board and exit their bus only at the assigned stop or school. The assigned bus route and bus stop numbers, as well as the name of the school are indicated on the bus pass. Students are responsible for being able to identify their correct bus stop and school both visually and by name.

8. Not tamper with the emergency exit or any bus controls. Not eat, drink, chew gum, smoke, or leave trash on the bus. Not raise or lower windows unless requested to do so by the bus driver.

9. Not invite any unauthorized student to ride the school bus; permission will not be granted for these requests.

10. Not distract the driver while the bus is in motion. This includes keeping their voice at a moderate level and remaining properly seated at all times.

Violation of the above rules will result in the following action(s) being taken by the COR:

1st Violation: Parents will be called and/or sent a written warning.

2nd Violation: Suspension of bus transportation privileges for up to 10 school days.

3rd Violation: Revocation of bus transportation privileges and/or appropriate action taken against the parent or legal guardian.
