CLAUSES INCORPORATED BY FULL TEXT
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (APR 2014)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. All offers will be submitted by email to erin.m.fisher.civ@mail.mil and megan.f.baer.civ@mail.mil by 3:00 PM Eastern time on 30 March 2015. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the
Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 3:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA

The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts
(see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling

The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting
Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

OMBUDSMAN (APR 2014)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offers, potential offers, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. ADDENDUM TO 52.212-2
ADDENDUM 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(A) Basis for Award: The Government will use a Best Value Technical Tradeoff Source Selection Method. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. When compared with price, technical factors are significantly more important. Past performance will be assessed as acceptable or unacceptable. This acquisition will result in the award of a firm fixed price purchase order with cost reimbursable line items for travel. The Government will select the best overall offer, based upon an assessment of Technical, Price, and Past Performance.
The Government seeks to award to the offeror who gives the Air Force the greatest confidence that it will best meet, or exceed, the requirements. This may result in an award to a higher rated, higher priced offeror, where the decision is consistent with the evaluation factors, and the Source Selection Authority (SSA) reasonably determines that the technical capabilities of the higher price offeror outweighs the cost difference. The SSA will base the source selection decision on an assessment of proposals against all source selection criteria in the solicitation (described below). While the Government source selection evaluation team and the SSA will strive for maximum objectivity, the source selection process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
All proposals will be evaluated based on the following criteria.
1. Factor 1 – Past Performance
(a) Past performance information will be reviewed, however a comparative assessment will not be conducted. (see FAR 15.101-2(b)(1))
(b) Offerors without a record of relevant past performance will or the not be evaluated favorably or unfavorably.
(c) Past performance information shall identify past or current Government contracts for efforts similar to this requirement.
(d) Discrepencies identified in Contractor Performance Assessment Reports System (CPARS) on the identified contracts and any corrective actions must be included in the proposal.
(e) Past performance information will be reviewed to determine the recency and relevance of the information. Past performance information will be considered recent if the contract was active within the last three years as of the date of solicitation opening. Past performance information will be considered relevant if the contract included the same or similar requirements to the PWS.
(f) The past performance of companies associated through prior or current teaming arrangements may be used to count towards recent and relevant past performance.
(g) Contractor performance on the identified contracts will be reviewed through the use of systems such as the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity
Information System (FAPIIS), CPARS, or other databases. Interviews may be conducted with Program
Managers, Contracting Officers, Fee Determining Officials and the Defense Contract Management Agency if required.
(h) Past performance information will be rated in two stages. Table A-2, below, outlines the acceptable/unacceptable evaluation methodology to be used.
(i) The information provided by the offeror will first be assigned a pass/fail rating based upon whether the proposal provides appropriate responses to all of items in (1)(c) through (1)(e), above.
Offerors without a record of relevant past performance will not be evaluated favorably or unfavorably.
(ii) Contractor performance will then be investigated through the means listed in (3)(g), above.
Each past performance submitted will then be given a rating on an acceptable/unacceptable basis.
An acceptable rating will indicate that the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. An unacceptable rating will indicate that the Government has no reasonable expectation that the offeror will successfully perform the required effort.
(iii) Any unacceptable past performance rating will render the proposal not eligible for award.
(i) Acceptable Past Performance proposals will be forwarded to the Technical Capability evaluation team.
Unacceptable past performance proposals will NOT be evaluated by the technical capability evaluation team.
Table A-2. Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the offeror’s performance record, the
Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the
Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
2. Factor 2 – Technical: After a review of all technical subfactors, each technical proposal will be assigned one overall technical solution rating. Any technical proposal receiving an Unacceptable rating will not be considered for award.
Technical Solution Rating. The technical rating reflects the degree to which the proposed approach meets or does not meet the minimum performance or capability requirements through an assessment of the strengths, weaknesses, deficiencies, and risks of a proposal. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. Table 1 outlines the ratings that will be used to evaluate the technical solution.
Table 1. Combined Technical/Risk Ratings
Color Rating Description Blue Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Purple Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is unawardable.
The Government will evaluate and rate each technical subfactor as follows:
(a) Subfactor 1 – Deliverables Plan. The offeror must submit a plan identifying the process for the development, deployment, and final analysis of the deliverables identified in the attached pricing sheet. The deliverables plan does NOT have to address all deliverables found in the pricing attachment, but will address, at a minimum the following: 1) How the Offeror will develop, conduct, and analyze a brief survey, to include several focus groups 2) How the offeror’s approach will change for an intermediate and/or extensive survey and 3) The offeror’s capability and approach for surveys of the US Public. The plan should clearly demonstrate the offerors understanding of the requirement as defined in the PWS.
(b) Subfactor 2 – Staffing Plan. Offeror must submit a detailed staffing plan. The staffing plan shall include a cross matrix that assigns the proposed labor categories to specific PWS tasks. The staffing plan shall explain the proposed number and categories of personnel and shall explain how that mix will be successful in performing the tasks in the PWS. The staffing plan shall demonstrate a recruiting and retention process that clearly establishes how it will obtain and retain the necessary personnel resources. The staffing plan will provide a summary of positions identifying the personnel resources and skill sets proposed for the fulfillment of PWS requirements. The summary of positions shall demonstrate the knowledge and expertise proposed to meet the requirements of the PWS. This may be accomplished by utilizing experience and qualifications of proposed personnel.
3. Factor 3 – Price
This source selection is conducted with the expectation of adequate price competition. Comparison of proposed prices received in response to this solicitation is the intended price analysis technique. Other techniques and procedures, if deemed necessary and reasonable, may be used to ensure a fair, reasonable and balanced price. The Government will evaluate proposed prices to determine whether prices are consistent with the skill sets required for the work to be performed, the geographical locations where the work will be performed, reflect a clear understanding of the requirements, and are consistent with the various aspects of the offeror’s technical proposal. An offer may be determined unawardable if its price is evaluated as unfair, unreasonable, or unbalanced. The techniques and procedures described under FAR 13.106-3 will be the primary means of assessing price fairness.
The price volume shall include a total compensation plan in accordance with FAR provision 52.222-46, Evaluation of
Compensation for Professional Employees (hereby incorporated by reference). Subcontractors unwilling to send this information to the prime offeror may submit the directly to the Government.
Note: Offerors shall not alter the Not to Exceed Amount (NTE) on the Travel CLIN. If an offeror alters the NTE amount, the price evaluator will replace it with the NTE…
