CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Factor: Technical Capability This section outlines the criteria the Government used in evaluating the offeror’s technical proposal.
The Government based its evaluation on the offeror’s capability to execute the program, as evidenced from its offer/proposal submission. Subjective judgement on the part of the Government is implicit in the evaluation process. The application of capability was evaluated on an acceptable/unacceptable basis.
Rating
Definition
Acceptable
Meets specified minimum performance or capability requirements necessary for acceptable contract performance.
Unacceptable
Fails to meet specified minimum performance or capability requirements. Proposal has one or more deficiencies. Proposals, with any unacceptable ratings, are not awardable.
Factor: Price
(a) The approach to the source selection for this procurement was pursuant to best value concepts and an integrated assessment. The objective was to select the proposal that offers the best value for the Government, not necessarily the lowest price.
(b) The Price/Ordering Table showing the Government’s estimated labor categories, estimated number of hours per category, and grand total was used as a basis for price evaluation. Price proposals were not rated or scored. Price proposals were evaluated in accordance with FAR 15.305(a)(1). Price proposals were evaluated for determining Price Risk, Price Completeness & Accuracy, Reasonableness, Realism, and Affordability. The purpose of the price evaluation was to assess risk and determine the proposed price to be accurate & complete, reasonable, realistic, and affordable in relation to the solicitation and Independent Government Estimate.
(1) Price Completeness & Accuracy: Prices were provided for the entire scope of the Performance Work Statement (PWS) and covering the magnitude of and duration of effort (5 years). The Government reviewed the price schedules for completeness and accuracy. A determination was made as to whether the Offerors properly understood the price proposal instructions and properly completed the price schedules. Changes to the evaluation quantities, blanks or zeros in the pricing columns, and/or mathematical mistakes were subject to clarification for confirmation of the Offerors’ intent.
(2) Reasonableness was evaluated based upon price analysis conducted in accordance with FAR 15.404-1(b). One or more of the following techniques may have been used to perform price analysis:
a. Comparison of proposed prices received in response to the solicitation.
b. Comparison of previously proposed prices and previous
Government and commercial contract prices with current proposed prices for the same or similar services. Labor categories, fully burdened labor rates, hours, etc. were provided within your price proposal.
(3) Realism was evaluated by assessing the compatibility of proposed costs with proposal scope and effort.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
5352.201-9101 OMBUDSMAN (AUG 2010)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMBC A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Col Timothy Applegate, AFDW/PK, 2822 Doherty Drive, Building 94, Suite 310, Anacostia Annex, DC, 20373 Phone # 202-767-8046. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067.
(d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
