About this file

This document is a Buy American—Balance of Payments Program Certificate (Basic) provision dated February 2024, which requires offerors to certify the origin and domestic content of end products in a federal solicitation. The provision mandates that offerors disclose whether each end product is a domestic end product, a qualifying country end product, or a foreign end product, with specific requirements for identifying the country of origin and domestic content percentage. For non-COTS (Commercially Available Off-The-Shelf) items, components of unknown origin are considered to have been manufactured outside the United States or a qualifying country, and offerors must indicate whether foreign end products exceed 65 percent domestic content.

The document provides detailed instructions for completing the certification, including sections for listing qualifying country end products, other foreign end products, and domestic end products containing critical components or critical items. Offerors must carefully complete the form, specifying line item numbers, countries of origin, and domestic content percentages. The government will evaluate offers in accordance with the Defense Federal Acquisition Regulation Supplement (DFARS) Part 225, with qualifying country end products evaluated without restrictions from the Buy American statute or Balance of Payments Program.
