EVALUATION OF QUOTES: ADDENDUM TO FAR 52.212-2 Evaluation – Commercial Items (Oct 2014)

The Government will award a firm fixed-price contract to the offeror whose quote represents the BEST VALUE to the government. In accordance with FAR 13.106-2, the following factors shall be used to evaluate offers: Price, Past Performance, and Technical. Technical is more important when compared to price. Past performance and Technical are pass/fail and are not part of a trade-off decision.

BASIS OF AWARD:

a. Responsiveness: The Government will begin by reviewing quotes received to determine if they are responsive to the RFQ requirements. A responsive quote is one that meets all of the terms, conditions and specifications in the RFQ. The Offeror must provide all documents listed and comply with all quote instructions in order for their quote to be considered “responsive” to this RFQ. Only responsive quotes will be evaluated for award.

b. Price (Factor 1). Then, all quotes determined to be “Responsive” will be ranked by Total Evaluated

Price (TEP), from the lowest to the highest TEP. Evaluations will begin with the quote with the lowest TEP.

c. Past Performance (Factor 2). Beginning with the quote that has the lowest TEP, the quote will be evaluated for Past Performance and assigned a rating of “Pass” (P) or “Fail” (F). If the Offeror’s past performance is determined to be a “Fail”, the Offeror will no longer be considered for award and evaluation for that Offeror will stop. If it is rated “Pass”, the quote will next be evaluated for the Technical factor.

d. Technical (Factor 3). Starting with the quote with the lowest TEP and a passing past performance rating, the Technical factor will be evaluated on a “Pass/Fail” basis for that quote. If a quote receives a “Pass” rating, that quote represents the best value to the Government and evaluations will stop. If the quote is affordable, award will be made to that offeror. If the quote does not receive a “Pass” rating, the next lowest TEP quote will be evaluated for Past Performance and the evaluation process will continue until a quote receives a “Pass” technical rating. At that point, evaluations will stop and award will be made to that Offeror.

e. The government intends to make an award to the quote with the lowest TEP which received a past performance rating of “Pass” and received a technical rating of “Pass”. If no quotes receive a passing performance rating or a passing technical rating, the solicitation may result in no award at all.

4 / 35

f. The Government will not differentiate between identical ratings; all “Pass” ratings are equal. Award may be made without communications/discussions/or interchanges with the Offerors. However, the Government reserves the right to hold communications/discussions/or interchanges with one, some, none, or all Offerors. Therefore, the offer should contain the Offeror’s best terms and conditions.

EVALUATION CRITERIA

FACTOR 1 - PRICE:

Each Offeror’s completed Pricing Worksheet will be evaluated to determine reasonableness.

Reasonableness will be confirmed by adequate competition. Quotes that are unreasonable may be determined ineligible for award. The completed Pricing Worksheet must include your total evaluated price (TEP). Quoters will be ranked by TEP, from lowest to highest TEP. Evaluation of options shall not obligate the Government to exercise those option(s). An unaffordable quote is un-awardable.

FACTOR 2 – PAST PERFORMANCE:

Past performance information will be evaluated on an “Pass/Fail” basis with information gathered via the CAGE and DUNS submitted using information pulled from the System for Award Management (SAM)(BETA.SAM.GOV), and the Federal Awardee Performance and Integrity System (FAPIIS).

FACTOR 3 – TECHNICAL

Offeror’s submission of a current and complete Certificate of Designation and current EPA Permit will be considered “Pass”. Failure to submit either of these will disqualify an offer.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed.

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
