3 Replace CME vacancies with qualified candidates

4.0 Vacancies are replaced

with qualified candidates within 30 days.

In 90% of the cases, new CMEs report for duty within 30 days of position being vacated.

Note: The Government reserves the right to inspect or test services that have been tendered for acceptance. The Government may require performance of any nonconforming services at no increase in contract price. If performance will not correct the performance issue, or it is not possible, the Government may seek an equitable price reduction or contractual processes will begin to terminate the contract. Past performance history will be reported in the Contractor Performance Assessment Reporting System (CPARS) to reflect satisfactory/unsatisfactory performance.

5.2 QUALITY ASSURANCE

5.2.1. Quality Assurance: The government shall evaluate the contractor’s performance by appointing a COR, to monitor performance to ensure services are received. The COR shall evaluate the contractor’s performance through intermittent inspections of the contractor’s quality control program and receipt of complaints from supported government personnel.

DEFINITIONS:

Minor: Major:

Typographical Errors Misleading Information Grammatical Errors Incomplete Package Minor Omissions Assessments Poorly Defined

5.2.2. Quality Control: The Contractor shall develop, implement, and maintain a comprehensive inspection system that assures compliance with all requirements of this task order IAW FAR Part 46, Quality Assurance.

5.2.3 Government Inspection

5.2.3.1. Contractor performance is subject to surveillance by the COR to ensure compliance with this task order to include all elements of the Service Summary.

5.2.3.2. The task order identifies two types of non-conformances: minor and major.

Additionally, protection of classified information non-conformances, infractions and violations, shall be considered non-conformances. All records of non-conformance and corrective actions will be documented in Corrective Action Reports (CAR), Quarterly Surveillance Reports, and Contract Performance Assessment Ratings (CPARs).

5.2.4. Non-Conformances: The Contractor shall identify and control non-conformances through root cause analysis, corrective actions and preventive actions. The Contractor shall focus on proactive identification and transparency of issues, and on eliminating the cause to prevent reoccurrences. The Contractor shall maintain records of non-conformities and actions taken. The Contractor shall correct and provide response to all Government-identified non-conformances IAW timeframes specified by the CO.

5.2.4.1. Minor Non-Conformance

A Minor Non-conformance is a non-conformance, which by itself may not adversely impact mission, safety of personnel and/or equipment, performance (quality), schedule (delivery), or cost. A Minor Non-conformance normally does not increase risk to the Government.

5.2.4.2. Major Non-Conformance

A Major Non-conformance is a non-conformance that adversely impacts (or has the reasonable potential to impact) mission, safety of personnel and/or equipment, performance (quality), schedule (delivery), or cost. A Major Non-conformance also increases risk to the Government.

An example of increasing risk would be significant number of recurring Minor non-conformances, which indicates inadequate preventive measures or corrective actions, thus lowering the Government’s confidence that quality services will be provided on time and at cost.

5.2.5. Protection of Classified Information Non-Conformances: Definitions below, provided as per Department of Defense Manual (DoDM) 5200.01, DoD Information Security Program: Protection of Classified Information, Volume 3, Enclosure 6 (Security Incidents Involving Classified Information).

5.2.5.1. Infraction

An infraction is a security incident involving failure to comply with requirements (i.e., the provisions of DoDM 5200.01 References (d) and (f), or other applicable security policy) which cannot reasonably be expected to, and does not, result in the loss, suspected compromise, or compromise of classified information. An infraction may be unintentional or inadvertent. While it does not constitute a security violation, if left uncorrected, can lead to security violations or compromises. An infraction requires an inquiry to facilitate immediate corrective action but does not require an in-depth investigation.

5.2.5.2. Violation:

Violations are security incidents that indicate knowing, willful, and negligent actions and result in, or could be expected to result in, the loss or compromise of classified information.

Security violations require an inquiry and/or investigation.

5.2.5.3. Compromise:

A compromise is a security incident (more specifically, a violation) in which there is an unauthorized disclosure of classified information (i.e., disclosure to a person(s) who does not have a valid clearance, authorized access, or a need to know).

5.2.5.4. Loss:

A loss occurs when classified information cannot be physically located or accounted for (e.g., classified information/equipment is discovered missing during an audit and cannot be immediately located).

5.2.6. Non-Conformance Notification: If a non-conformance is found during inspection of the Contractor’s performance, the CO will determine the type of notification based on the category of the non-conformance and pursue non-conformance resolution IAW the contract.

5.2.6.1. First Notice

First Notices provide written notification from the CO to the Contractor of Minor Non- Conformances. First notices shall include a suspense date for the Contractor’s response. The Contractor shall send the completed first notice response to the CO. If the Contractor fails to respond by the specified due date, the CO will notify the COR to annotate the Contractor’s non-responsiveness in the COR Quarterly report. If the Contractor fails to resolve the issue as documented in the notice, the CO may elevate the issue to the next level, and request the COR to complete a Customer Complaint Record (CCR).

5.2.6.2. Customer Complaint Record (CCR)

The CCR provides written notification from the CO to the Contractor of: 1) Minor Non- Conformances not addressed by the Contractor after the CO issued a First Notice, 2) Multiple occurrences of Minor Non-Conformances, or 3) First occurrence of Major Non-Conformances.

The CO will issue the CCR to the Contractor with a suspense date for the Contractor’s reply.

The Contractor shall send the completed CCR to the CO. If the Contractor fails to respond by the specified due date, the CO will notify the COR to annotate the Contractor’s non-responsiveness in the COR Quarterly Report. If the Contractor fails to resolve the issue as documented in the notice, the CO may elevate the issue to a CAR. Corrective/preventive actions initiated and/or completed by the Contractor will be verified by the COR.

5.2.6.3. Corrective Action Report (CAR)

A CAR provides written notification from the Government to the Contractor of significant performance discrepancies. A CAR may be issued when previous notifications of Minor Non-Conformances failed to result in corrective actions or when a Major Non-conformance exists. CARs shall be issued by the CO to the Contractor for their action. To satisfactorily close-out a CAR, the following criteria must be met:

The Contractor shall meet the suspense date The corrective action must have been found satisfactory by the COR and CO Any required updates to the Contractor’s QCP must be made and reviewed by the COR The Contractor’s actions must correct the Non-Conformance (If applicable) The correction to the Non-Conformance must be within specified standards.

If the corrective action is deemed unsatisfactory by the COR and CO, the Government reserves the right for further action, up to and including equitable adjustment.

5.2.7 Contractor Performance Assessment Reporting System (CPARS) Applicability

FAR 42.1502 directs all federal agencies to collect and report past performance information on services contracts with a value of $1M or more. The CPAR assesses a Contractor’s performance and provides a written record on a given contract during a specific period of time. All CPARs are accomplished using the automated Navy Contractor Performance Assessment Reporting System (CPARS) found on the web at <https://www.cpars.gov/>. This system requires the Contractor to provide a designated representative to receive CPARs.
