I. Contracting Activity.

Air Force Installation Contracting Agency (AFICA) Operating Location AFGSC (KGQ)

II. Nature and/or description of the action being processed.

Nuclear and Conventional Operations Advisory & Assistance Support Services

III. Description of supplies/services required to meet agency needs.

The contractor shall provide seven (7) Contracted Man-year Equivalents (CMEs) to provide technical and analytical support and expertise in the area of acquisition planning, programming, budgeting, capabilities development, and logistics for nuclear deterrence and global strike operations. Results-based performance measures are necessary to effectively monitor and drive strategic plan implementation, while satisfying guidance from higher headquarters (HHQ) and collaborating with internal and external stakeholders. The contractor shall provide Advisory and Assistance Support (A&AS) Services to support AFGSC priorities in activating and implementing the strategic to tactical programs for the MAJCOM.

IV. Statutory authority permitting Other than Full and Open Competition.

The authority permitting Other than Full and Open Competition is 15 U.S.C. 657f, as implemented by FAR 6.302-5(b)(6) -- Authorized or Required by Statute (Sole source awards under the Veterans Benefits Act of 2003)

FAR 19.1406(a) states “A contracting officer shall consider a contract award to a SDVOSB concern on a sole source basis (see 6.302-5(b)(6)), before considering small business set-asides (see 19.203 and Subpart 19.5) provided none of the exclusions of

19.1404 apply and (1) The contracting officer does not have a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns; (2) The anticipated award price of the contract, including options, will not exceed (i) $6.5 million for a requirement within the NAICS codes for manufacturing; or (ii) $4 million for a requirement within any other NAICS code

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

These services had been provided to HQ AFGSC through a task order under the USAMS contract written by 55 CONS at Offutt AFB, NE. In the Fall of 2015, this requirement was identified as one for AFICA/KGQ to re-compete since the last option period was ending on 27 Sep 2016. The initial acquisition strategy was to compete this requirement, however, over the span of 8 months HQ AFGSC/A1MR - Manpower repeatedly insisted contracting for these services was a violation of their AFI in that it was a duplication of work already being performed by government employees. On 16 Sep 2016, Manpower determined these services were not a duplication of work, and approved contracting for these services.

Due to the extremely short procurement lead time for this acquisition, the Contracting Officer did not have a reasonable expectation that offers could be received from two or more service-disabled veteran owned business concerns with sufficient time to conduct a competitive source selection/evaluation. IAW FAR 19.1406(a)(1) Government determined a sole-source award to a Service-Disabled Veteran-Owned Small Business (SDVOSB) concern was the only possible way to get these required services on contract before 28 Sep 2016 and avoid a break in service.

The Government contacted an SDVOSB contractor who was currently providing A&AS services to the command for two other directorates with excellent performance, and they related they could provide a proposal within a few days of receiving the RFP.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

As stated in Section V, the Government had intentions to compete this requirement, but due to circumstances out of the Contracting Officer's control (A1MR not approving the requirement until 16 Sep 2016) the only option available without causing a break in service was to negotiate a sole-source contract with the qualified SDVOSB concern

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

As a result of negotiations, the final proposed price by the SDVOSB concern was 6.82% lower than the Independent Government Estimate which was based on historical prices paid on the previous contract for the exact same effort.

Therefore, the prices were determined to be fair and reasonable IAW FAR 15.404-1(b)(2)(ii)

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research indicated that there were several qualified SDVOSB concerns who were capable of performing this work.

However due to the extremely short acquisition time-line described in Section V, IAW FAR 19.1406(a)(1) Government determined a sole-source award to a Service-Disabled Veteran-Owned Small Business (SDVOSB) concern was the only possible way to get these required services on contract before 28 Sep 2016 and avoid a break in service.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

X. List of sources, if any, that expressed interest in the acquisition.

No other sources were solicited

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Now that A1MR has concurred that these services are not a duplication of work already being performed by government employees, future acquisitions for these services will be able to be solicited well in advance of the end of this contract's period of performance allowing for competition amongst multiple contractors.
