The provision at FAR 52.212-2, Evaluation -- Commercial Items (Oct 2014) applies to this acquisition.

(a) The Government will award a contract resulting from this solicitation to the responsible

Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

ADDENDUM TO FAR 52.212-2, Evaluation -- Commercial Items

1. Basis for Contract Award

This acquisition is conducted in accordance with Federal Acquisition Regulation (FAR) 12, Acquisition of Commercial Items and FAR 13.3, Simplified Procedures for Certain Commercial

Items. These regulations are available electronically at https://www.acquisition.gov. The

Government will select the quote with the lowest evaluated price, which is determined to be fair, reasonable and balanced, and technically acceptable.

The following factors will be used to evaluate each offer:

Factor 1: Technical Approach and Capability to meet the requirements

Factor 2: Price

2. Factor 1 – Technical Factor

The Government’s technical evaluation team shall evaluate the technical quotes on an acceptable or unacceptable basis, assigning a rating described below. Only those quotes determined to be technically acceptable, either initially or as a result of discussions, will be considered for award.

However, the Offeror is reminded that the Government reserves the right to award this effort based on the initial quote, as received, without further discussions.

3. Factor 2: Price Factor:

(a) Reasonableness. The offeror’s price quote will be evaluated for reasonableness. The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis

Rating Description

Acceptable Quote meets the requirements of the solicitation.

Unacceptable Quote does not meet the requirements of the solicitation.

https://www.acquisition.gov/ techniques may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information may be required to support the proposed price.

(b) Balance: Offerors are cautioned against submitting an offer that contains unbalanced pricing.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line item numbers (CLINs) is significantly overstated or understated as indicated by the application of quote analysis techniques. The Government shall analyze offers to determine whether there are unbalances separately priced line items or sub-line items. Prices submitted will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror’s response to the pricing structure in the Price Schedule (Attachment 3). Offerors that are determined to be unbalanced may be rejected if the lack of balance poses an unacceptable risk to the Government.

(c) The Total Evaluated Price (TEP) shall be calculated by multiplying the unit price by the quantity to calculate the extended prices for all of the firm fixed price CLINs for the basic year and the Option

CLINs, then totaling those amounts.

(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
