The Government expects that the SNC will have adequate health insurance coverage provided by the contractor for overseas medical services.

For all locations, there may be occasions when mission and workload changes require employees to adjust work schedules to meet demand. The SNC will not perform overtime or on-call duties under this contract. In the instance where the Government supervisor directs the SNC to remain on duty in excess of their scheduled shift due to an unforeseen emergency or to complete patient treatment where lack of continuity of care would otherwise jeopardize patient health, the SNC shall remain on duty. This provision is not intended to apply to the time required to complete routine tasks (e.g., completion of paperwork or routine administrative tasks at the end of a shift), which are to be completed as part of the normal shift. The SNC’s schedule shall be adjusted for the additional hours such that the number of hours on the contract is not exceeded and no overtime is required.

8. SPECIAL CONTRACT CLAUSES
8.1. Performance
8.1.1. When the Contractor experiences any delays in accomplishing the specific tasks identified in subparagraphs below, the contractor shall notify the Contracting Officer immediately (via phone or e-mail). The Contracting Officer will evaluate the situation to determine if an extension of the dates is appropriate. If an extension is not approved, the Government may terminate the contract for default or seek other remedies as appropriate.
8.1.1.1. Candidate Selection. Submit resumes of qualified individuals being considered for employment to the QAP through the CO within 30 calendar days after contract award. For replacement SNCs, a resume for the new employee should be submitted within 30 days after notification a replacement is required. The Government reserves the right to interview (via telephone) and approve or disapprove all candidates. The MTF shall make the determination NLT 7 business days after submission. If the contractor is not notified of the decision within 10 business days after submission, they will ask the CO for approval to move forward with the hiring action. The SNC shall physically begin performance as soon as possible, but no later than 120 days after contract award.
8.1.2. In the instance where the Government supervisor directs the SNC to remain on duty in excess of their scheduled shift due to an unforeseen emergency or to complete patient treatment where lack of continuity of care would otherwise jeopardize patient health, the SNC shall remain on duty. This provision is not intended to apply to the time required to complete routine tasks (e.g., completion of paperwork or routine administrative tasks at the end of a shift) which are to be completed as part of the shift. The SNC’s schedule shall be adjusted for the additional hours such that the number of hours on the contract is not exceeded.
8.1.3. During anticipated closure of the facility, (i.e., training holidays, administrative leave granted to the entire staff, or other closure) the contracted staff may be allowed to perform their duties. The SNC may use leave or vacation time during these anticipated closures if available when the MTF commander deems the day “minimal staffing” coverage. The Government will not pay the SNC unless they work or take paid time off during these times. The Government will notify the Contractor of anticipated closures five (5) business days in advance or as soon as possible.
8.1.4. In the event of unplanned closure of the facility due to natural disasters, military emergency, or severe weather, contract employees (for leave and pay purposes) will be treated in the same manner as DoD civilian employees. The time may be billable to the Government if the SNC would have usually worked on that day. If that day was a usual day off, no time will be billed during the closure.
8.2. Restriction on the Use of Government-Affiliated Personnel
8.2.1. The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The Contractor shall not employ any person who is an employee of the Department of Defense, either military or civilian, unless such person seeks and receives approval in accordance with Title 5, USC, Section 5536, DoD 5500.7-R (1993), as amended, and service directives.
8.3. Substitution of Personnel
8.3.1. Substitution Personnel are defined as temporary employees providing backfill for a permanent SNC. Coverage is required for scheduled or unscheduled absences exceeding 160 consecutive hours. The contractor agrees to initiate performance of this contract using only fully qualified SNCs who have been accepted through the Government selection process. Like any SNC placed under this contract, substitution personnel shall meet all contract requirements prior to start of work in the MTF.
8.3.2. No personnel substitutions shall be made by the contractor without the authorization from the Contracting Officer. All substitution requests will be processed in accordance with the performance work statement (Section C, Paragraph 2.1.3.2.).
8.3.3. No personnel substitutions shall be permitted unless they are necessitated by a SNC’s unexpected illness, injury, death or termination of employment. Should one of these events occur, the contractor shall promptly notify the Contracting Officer.
