PERFORMANCE WORK STATEMENT

(PWS)

1.0. DESCRIPTION OF SERVICES. The Contractor shall provide the necessary equipment and materials to provide commercial cellular service to all lines of service associated with the Kaiserslautern Military Community (KMC). The Government’s need for devices may be less than, equal to, or more than, the total number of orders for voice and/or data lines of service. The Government shall be permitted to use devices already owned by the Government. However, the Contractor shall furnish a SIM card for every line of service for voice and/or data under this contract regardless of whether or not the device intended for the associated line of service was purchased under this contract. The Contractor shall be responsible for providing monthly bills in English to separate accounts, a process for ordering new cellular devices and lines of services, and a 24-hour/7 days a week English speaking customer service team. The Contractor shall offer Commercial Off-The-Shelf (COTS) wireless devices such as cellular phones, Service Enabling Devices (SEDs) and accessories, and COTS devices able to meet Department of Defense (DoD) requirements. Related services include voice and data (domestic & international), Short Message Service (SMS), SMS with Instant Messaging (IM), Multimedia Messaging Service (MMS), secure voice, directory assistance, and IP Multimedia Subsystem (IMS) or similar capability. Infrastructure devices that extend the range and capacity of public cell networks shall be supported. The desired mission result of this contract is to provide responsive, cost effective, and reliable commercial cellular voice and data communications for all accounts associated with the KMC. The Contractor is encouraged to identify opportunities to accelerate the migration, optimize calling plans, minutes of usage, user requirements and total cost. The services required under this PWS are not mission essential as defined by DoDI 1100.22.

1.1. CALLING OPTIONS. The Contractor shall make calling plans available to meet multiple types of services required, for example standard phone without data, phone with data (e.g., Smartphone, iPhone). The Contractor shall provide options such as international calling, and other voice and data options possible to add to the current plan of the phone.

1.1.1. The Contractor shall provide global coverage for voice and data wireless communication services for COTS wireless/cellular telephones/voice mail/smart phone devices throughout the U.S. European Command (USEUCOM), U.S. Central Command (USCENTCOM), U.S. Africa Command (USAFRICOM), U.S. Northern Command (USNORTHCOM) Areas of Responsibility (AORs). Global coverage means the user will have access to voice and date communication services in all countries and AORs listed in this paragraph, to include the 48 contiguous United States, Alaska, Hawaii, Puerto Rico, District of Columbia, U.S. Territories of American Samoa, the Federated States of Micronesia, Guam, Midway Islands, Puerto Rico, U.S. Virgin Islands, Afghanistan, Albania, Armenia, Australia, Austria, Azerbaijan, Bahrain, Belgium, Bosnia Herzegovina, Bulgaria, Caribbean, Chile, China, Chad, Croatia, Czech Republic, Democratic Republic of Congo, Denmark, Djibouti, Egypt, Estonia, Ethiopia, Finland, Fiji, France, Germany, Ghana, Greece, Honduras, Hong Kong, Hungary, Iceland, India, Iraq, Ireland, Israel, Italy, Japan, Kenya, Kuwait, Latvia, Liberia, Libya, Lithuania, Luxembourg, Macedonia, Malaysia, Malta, Mozambique, Netherlands, New Zealand, Niamey, Nigeria, Norway, Oman, Pakistan, Panama, Poland, Portugal, Qatar, Romania, Russia, Serbia, Singapore, Slovenia, South Africa, South Korea, Spain, Sri Lanka, Sweden, Switzerland, Taiwan, Tanzania, Thailand, Turkey, Turkmenistan, United Arab Emirates, United Kingdom and Yemen, Ukraine, and Uzbekistan.

1.1.2. In order to provide complete coverage, the Contractor shall provide digital wireless communications devices and supporting services as necessary, e.g. through parent operating companies, partner markets, affiliates, teaming arrangements, or subcontracting.

2.0. BILLING AND INVOICING. The Contractor shall provide two types of monthly invoices directly to 86 CS/SCXPR; a summary invoice and detailed invoice that includes all phones/devices subscribed under this contract. These invoices shall be submitted via a Contractor recommended commercial billing database system or equivalent within 10 business days after the covered period. The electronic invoices shall be in English and in a format that can be automatically processed, as opposed to an image of the data (e.g., PDF or bitmap). A structured data file (e.g., .xls or .xlsx) is the preferred format for electronic invoice transmission. The electronic format used shall be such that a machine-to-machine interface can be used and not require manual intervention. The Contractor shall also provide a web site in English to support on-line bill review using a hierarchical structure as provided by 86 CS/SCXPR to allow bills to be reviewed by individual users and 86 CS/SCXPR. The Contractor shall support incorporation of additional levels of bill viewing on the web page as required by 86 CS/SCXPR. The Contractor shall provide the capability to assign a tiered level of access to each user that specifies which levels in the hierarchy they are able to review. The Contractor’s web site shall allow all individual users, including those that are part of a group invoice, to view only their individual bill and usage information on-line. Billing data must include all fees or discounts and provide enough data to enable the customer to ensure accuracy of a single charge. Bills shall be made accessible on-line for a minimum of 90 days after bill was issued. Mandatory minimum invoice and bill data elements are listed in Attachment 1 of this document.

2.1. TIMELY AND ACCURATE INVOICING. Invoice discrepancies shall be handled promptly until resolved and approved by 86 CS/SCXPR. The disputed portion of the invoice must be resolved within 90 calendar days of written notification. Invoicing discrepancies that affect only a portion of the bill shall be reflected in an amended bill for the month in question and not on subsequent bills. The Contractor shall provide a toll-free telephone number that is available between the hours of 7:00 am to 11:00 pm CET, Monday through Friday to address invoice inquiries and disputed charges. All billing disputes will be submitted to the Contractor in writing or electronically.

3.0. REPORTING

3.1. SYSTEM UPGRADE/OUTAGE NOTIFICATION. The Contractor shall provide upgrades to its commercial support systems, (including, but not limited to, systems for billing and invoicing, service ordering and tracking, trouble and complaint handling, and spend management and administrative reporting) at no additional cost to the Government as these upgrades become available to commercial customers.. If the Government will be affected by system changes or upgrades, the Contractor shall notify and inform Government users how they will be impacted 30 days prior to implementation and provide temporary solutions, if available.

3.2. PROBLEM RESOLUTION. The Contractor shall develop a formal problem resolution process that will be incorporated into the contract. The proposed process shall include a means to address the full range of potential problems including, but not limited to, those surrounding product/service delivery, accuracy/integrity of data feeds, invoice and billing discrepancies, and any other potential issues that may arise. The Contractor’s proposed problem resolution process shall include, at a minimum, the following key elements:

· Dedicated Contractor POCs to receive initial calls regarding any problem and help route the caller to the proper person to address the problem.

· Escalation Process: If the initial POC cannot resolve the Government subscriber’s problem surrounding product/service delivery, accuracy/integrity of data feeds, invoice and billing discrepancies, or any other potential issues within 48 hours, the Government subscriber shall be given contact info of an alternate POC with higher organizational authority via phone or e-mail to escalate the rectification of the issue.

· Ability to track a problem from initial contact through the escalation process to resolution.

· Proposed performance metrics for problem resolution (time to resolve) and proposed method for tracking and reporting these metrics listed in Section 12, Deliverables.

3.3. CONTRACTOR MANPOWER REPORTING APPLICATION (CMRA). The Contractor shall report all contractor labor hours (including sub-contractor labor) hours required for performance of services provided under this contract for the Air Force via a secure data collection site. The Contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

3.3.1. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs from 1 October to 30 September of the following year. Contractors may direct questions to the CMRA help desk.

3.3.2. Reporting Period: Contractors are required to input data by 31 October of each year.

3.3.3. Users and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor hour dollars. At no time will any data be released to the public with the Contractor name and contract number associated with the data.

3.3.4. Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link: http://www.ecmra.mil.

4.0. PROGRAM MANAGEMENT. The Contractor shall establish a dedicated Program Manager (PM) that will be responsible for successful execution and ongoing management of this contract. The Contractor shall provide the name and contact information (including phone and e-mail address) for the PM and a minimum of 2 alternate POCs that may be used in the event the PM is unavailable. Program management support includes, but is not limited to, the following:

· Serve as the direct contact for the KMC Commercial Cellular Program for all outstanding issues and concerns

· Provide assistance with urgent request (e.g., broken equipment, service interruptions, surge requirements, coverage issues)

· Assist with normal requests such as service changes or inquires

5.0. ACCOUNT MANAGEMENT.

5.1. ACTIVATION/CANCELLATION. The Contractor shall activate/cancel cellular service/packages within 1 business day of request by the Government. The contractor shall notify the Government technical representative and 86 CS/SCXPR of activation/cancellation in English within 24 hours of request. All devices/cell phones will be activated in English.

5.2. MODIFICATION/SUSPENSION/REINSTATEMENT. The Contractor shall take action on requests by 86 CS/SCXPR, such as adding/deleting service options, suspending or reinstating service and complete such actions within 24 hours of request. A list with persons who are authorized to request these changes will be handed to the Contractor at contract award.

5.3. FEES. There shall be no fees, penalties, or any other cost associated with the cancellation/deactivation of any service to include, but not limited to, early termination of line of service or package (basic and optional), modification of line of service like adding or cancelling one or several packages (basic and optional) or reactivation of line of service. The Contractor will hold the Government harmless for any of these actions.

6.0. CUSTOMER SERVICE/TECH SUPPORT. Support technicians and customer service technicians must be able to communicate in English. Customer service/support hours shall be available at any time, any day, during the contract’s performance (24 hours each day, 7 days each week, and each day of the contract’s performance, to include, but not limited to, Saturdays, Sundays, holidays, and other typical non-work days) at no additional cost to the Government. The Contractor shall have the ability to block unauthorized services/applications and temporarily block lines of service within three calendar days of request by 86 CS/SCOSA.

7.0. DEVICE OPTIONS AND SPECIFICS. The Contractor shall provide cellular devices that are commercially available. The Contractor shall provide and support commercially available SEDs (including cell phones, wireless data devices, and cellular modem cards for computers) with the characteristics and features needed to operate on their network. The Contractor shall provide standard, commercially available warranties for Service Enabling Devices. SEDs shall be separately priced from cellular airtime and their costs shall not be included in the cellular airtime pricing. The Government may choose to purchase more than one device per line of service and upgrades may occur at any time under this PWS. All new devices must come with 220 volt European chargers and an English instruction manual. The Contractor shall provide all SIM cards with English instructions. Replacement of defective or lost SIM cards shall be at no cost to the Government. The Contractor shall provide mini sized, micro sized, nano sized or any other SIM card size/type appropriate for the devices that require SIM cards. At a minimum, the contractor shall offer next-day, one-for-one replacement of all damaged and/or broken cellular devices still under commercial warranty.

7.1. TYPES OF DEVICES. The following three types of COTS devices are required:

· Full-featured, compact digital wireless handheld cellular devices.

· Smart Phones. Smart phones shall provide digital wireless cellular functionality in addition to state-of-the-art functionality including but not limited to two-way wireless e-mailing and text messaging; World Wide Web (WWW) browsing; camera and video-recording; Global Positioning System and mapping functionality; Wireless Local Area Network (WLAN) such as Wi-Fi; large capacity memory and battery life; organizer functionality; and ability to synchronize with Microsoft Office calendars and address books. In addition, Smart Phones shall have a full Q-W-E-R-T-Y keyboard capability.

· Modem cards. Modem cards shall provide the ability to send and receive data packets in any commercial standard format over any port necessary; provide the ability to send and receive transmissions over its network subject to FIPS 140-2 Standards (as outlined within current DoD Information Assurance (IA) policy DoDD 8100.2) and can be found at http://csrc.nist.gov/groups/STM/cmvp/standards.html#02.

7.2. SPECIFIC DEVICES. A list of devices which are currently approved for AF use can be found in Attachment 2 of this document. This applies to all phones for data capabilities that require connection to the AF network. This list is current as of September 15, 2015 and is subject to change. Any other cellular device for data capabilities that require connection to the AF network is not acceptable. The Contractor shall coordinate with the 86 CS/SCX after award to determine the specific cellular device to be provided for applicable lines of service. Cellular device colors shall not be of a vibrant color; for example, black, silver, or dark blue are acceptable colors.

8.0. PRODUCTS AND SERVICES. The requirement is to have voice and data transmit over commercially available cellular and paging networks using commercially available SEDs to support the Government’s mission. The Contractor’s cellular networks shall provide subscribers with cellular and capabilities for their SEDs to be used for applications such as voice, data, short messaging services, multimedia messaging services, and Internet services.

8.1. BASIC SERVICES AND FEATURES. The Contractor shall, for a monthly fixed price, provide basic rate plans for voice only, data only, and voice and data packages with included features as outlined in Attachment 3.1 of this document.

8.2. OPTIONAL SERVICES AND FEATURES. The Contractor shall provide, for a fixed monthly price, optional country packages with included features as outlined in Attachment 3.2 of this document. These country packages may be chosen by specific users and added to their basic voice only or basic voice and data plans.

8.3. CELLULAR AIRTIME REQUIREMENTS. Contractor shall ensure that cellular services provide subscribers with the ability to communicate both voice and data through commercially available cellular networks at standard levels of security. Standard cellular services are grouped into the following three primary service offerings:

· Voice-Only Services

· Data-Only Services

· Combined Voice and Data Services

8.3.1. VOICE-ONLY SERVICES. Voice-only service provides subscribers with cellular voice capabilities for their cellular phones. The Contractor shall also allow voice calls, SMS, and MMS to be made over Wi-Fi for capable SEDs. The Contractor shall build a voice-only call plan with included features, as outlined in Attachment 3.1 of this document. The associated Contract Line Item Number (CLIN) for Voice-Only Services will be CLIN X001.

8.3.2. DATA-ONLY SERVICES. Data services provide access to the Internet and other packet-switched networks over a variety of cellular networks. Due to emerging data requirements, the Contractor shall build two data-only plans with included features, as outlined in Attachment 3.1 of this document. The associated CLINs for Data-Only Services will be CLIN X002 (“1GB”) and CLIN X003 (“10GB”). Data only services will be accessed by SEDs (e.g., smartphone, PC, laptop) using wireless modem cards or MiFi devices.

8.3.2.1. CELLULAR DATA FOR WIRELESS MODEM CARDS. Cellular data for wireless modem cards provides subscribers with cellular data capabilities for their PC/laptop using a modem card. The following cellular data for PC/Laptop access card features are mandatory unless otherwise noted:

· USB capable

· Data transmission. The Contractor shall provide the ability to send and receive data packets in any commercial standard format over any port necessary

· Restricted enclave traffic. The Contractor shall provide the ability to send and receive transmissions over its network subject to FIPS 140-2 standards (as outlined within current DoD Information Assurance (IA) policy DoDD 8100.2)

8.3.3. COMBINED VOICE AND DATA SERVICES. Subscribers using wireless data devices with voice capability will require service plans that combine both voice and data capabilities. The voice aspect of the combined voice and data service offering shall satisfy the same requirements as the basic cellular voice-only service. Both voice and data services shall be provided under a combined plan using a data and voice enabled device. The Contractor shall build a voice and data plan with specific features, as outlined in Attachment 3.1 of this document. The associated CLIN for Combined Voice and Data Services will be CLIN X004.

8.4. OVERAGES. Overage charges are defined as a charge which is not already included in a basic package and/or optional package. The Contractor shall provide an overage price list that shows the cost per minute for each country/region they service with cost breakdown by connection (to include, but not limited to fixed line, mobile line, incoming, outgoing, roaming, data).

8.5. MARKET CONDITIONS. At the time of each option period, the Contractor shall inform the Government in response to the preliminary notice letter, of any market changes for both services and devices, to ensure that pricing remains equal to or better than the best pricing offered to enterprise customers of similar scope and magnitude, including Federal Government agencies. If better pricing is available for services and/or devices than the original option period pricing, the Contractor shall offer the best pricing to the Government for the following option year (to include basic packages, optional packages, overages and devices under this contract). The Government reserves the right to modify the option period prices accordingly.

9.0. COVERAGE. The Contractor shall work with designated Government points of contacts (POCs) to create a plan to optimize cellular network coverage on Air Force installations within the KMC and work toward improving coverage in targeted areas as they become identified. The Contractor is encouraged to enhance coverage in targeted areas by means of cellular towers, antennas, cell on wheels (COWs), repeaters, in-building solutions and other technology as it becomes available. The Contractor shall have a designated POC for this purpose and will be provided the contact information for that person. The Contractor shall offer Government-owned infrastructure options, where available, that reduce overall total cost of ownership. This infrastructure shall be carrier agnostic where possible, meaning that the cellular network must not be proprietary.

10.0. STANDARDS. The Contractor shall work with the Government to document their network and product compliance with the following standards:

11.0. SECURITY BREACH REQUIREMENTS. The Contractor shall report any breach, or incident reasonably believed to have been a breach, which may have exposed Government data to 86 CS/SCOSA immediately upon discovery. Reasonable belief that a breach has occurred arises when, for example:

· Someone has received unauthorized access to data (including, but not limited to; non-public mail / e-mail to an unauthorized person, incorrect network access settings which are reasonably believed to have resulted in intrusion, inadvertent posting of information in electronic format or other non-hacking incidents.

· Data acquisition has occurred (including, but not limited to; lost or stolen electronic equipment including PDAs, laptops, desktop computers, storage media).

· Hacking (to be defined as a successful intrusion or computer systems via the network where it is indicated that Government data may have been downloaded, copied or otherwise accessed).

· Any other unauthorized/inappropriate access of Government data stored by the Contractor in any form.

· Access to the network, which could create a denial or degradation of services of DoD capabilities (e.g., spam or traffic overload).

The Contractor shall report to 86 CS/SCOSA any known or discovered security vulnerabilities which have the potential to compromise the confidentiality, or integrity of data resident on, transmitted or received by cellular devices, and any peripherals, firmware, or software related to these devices provided to the Government by the Contractor immediately upon discovery, but no later than 24 hours following discovery.

12.0. DELIVERABLES. The Government will work with the Contractor to establish Key Performance Indicators (KPIs), which shall govern the services offered under the contract. Any data collected regarding performance metrics that is marked as proprietary by the Contractor will be treated as such by the Government. Such data will not be released outside of the Government, will remain marked as proprietary when circulated internally, and will only be released within the Government to the minimum extent required to achieve the Government’s objectives.

12.1. MANAGEMENT AND OPERATIONAL DELIVERABLES. Deviation from the target service levels for these metrics will be acceptable on an “exception” basis, provided that the Contractor has obtained approval from the Contracting Officer immediately upon becoming aware of the situation (e.g., bulk orders or surge requirements).

A formal dispute, problem tracking and reporting process is available to keep the agency informed of reported disputes. Disputes shall be handled properly until problem resolution accepted by the 86 CS/SCXPR by the next billing cycle.

13.0. CONFORMANCE WITH ENVIRONMENTAL MANAGEMENT SYSTEMS. The Contractor shall perform work under this contract consistent with the relevant environmental policy and objectives identified in the installation environmental management system (EMS) applicable for your contract. The Contractor shall perform work in a manner that conserves water, energy and other resources to the maximum extent feasible and ensure minimum production of waste as possible, giving preference to recycling and reutilization opportunities. Furthermore, the Contractor shall give preference to less toxic materials whenever available and still reliable for their work. In the event as environmental nonconformance or noncompliance of host nation and USAF environmental laws and regulations associated with the contracted services is identified, the Contractor shall take corrective and/or preventative actions. In the case of a nonconformance, the Contractor shall respond and take corrective action immediately. In addition, the Contractor shall ensure that their employees are aware of the environmental management system on base and how these requirements affect their work performed under this contract.

Date of applicability or the date that the charge was incurred shall be presented in a separate data field for each charge. Individual bills shall include the following minimum data elements:
