a. Terms and conditions

b. Representations and certifications

c. Technical requirements, in addition to those identified as evaluation factors and sub-factors

d. Current UK business registrations, licenses, and/or insurance required to legally operate and employ personnel within the UK or show rationale for non-applicability.

Failure to meet a requirement may result in an offeror being ineligible for award. The Government’s terms, conditions, and respective clauses contained within this solicitation are prescribed in accordance with United States Federal Acquisition Regulations (FAR), and are not subject to conditionally proposed revisions or changes requested by offerors. Offerors’ specific terms and conditions that may be contingently quoted for subsequent inclusion into the contract if awarded, will not be considered by the Government in its evaluation of quotes. Offerors that are not able to comply with the aforementioned conditions, will be determined as noncompliant with the solicitation requirements, and therefore may be removed from consideration for award.

B. The quote shall consist of two (2) separate parts;

Part I - Technical Capability Part II - Price

C. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial quotes, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists no additional price information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

D. Complete the necessary fill-ins and certifications in provisions and in the on-line Representations and Certifications at www.sam.gov. For the provisions and clauses in the solicitation listed in full text, the offeror is required to submit the pages that require an offeror fill-in with their quote.

Offerors may send their quote using multiple emails and it is advised that number systems such as “email 1 of 4” are used so that if requested by the offeror, we can confirm receipt. (End of Addendum)

Addendum to 52.212-2 Evaluation – Commercial Items

Basis For Contract Award: The Government’s evaluation of offeror’s quotations will be conducted utilizing the evaluation factors of: 1) Technical Capability, and 2) Price. Evaluation of these factors will utilize a Lowest Price Technically Acceptable (LPTA) evaluation approach in accordance with FAR 15.101-2; whereby the Government seeks to award on the basis of the lowest evaluated price of quotations which meet or exceed the listed technical specifications. Under the LPTA evaluation process, trade-offs will not be permitted between price and non-price factors. Only one award will be made as a result of this solicitation.

The Government intends to award without discussions. However, the Government reserves the right to conduct discussions if deemed in it’s best interest. Upon completion of the Government’s initial evaluation of quotations, exchanges with offerors may occur, for the purpose of clarifications in accordance with FAR 15.306. The following factors shall be used to evaluate quotations:

1. Technical Capability. The Government will evaluate the offerors technical capability of the below listed sub-factors on an acceptable or unacceptable basis. An unacceptable rating for any of the below sub-factors will result in an overall unacceptable rating for the Technical Capability primary factor.

Accordingly, under the LPTA evaluation approach, offerors who receive an unacceptable rating for this factor may not be considered for award. If the Government elects to award without discussions, an initial technical rating of unacceptable will render the entire quotation unacceptable. Technical Acceptability shall be evaluated against the following sub-factors where all sub-factors are considered equal:

a. Technical Capability of the Chemical Analyzer:

i. The contractor must demostrate how the specifications for the Chemistry and Immunodiagnostic Analyzer Units meet the specifications as listed in section 1.1 of the Performance Work Statement.

ii. The contractor must demostrate how the specification for the Chemistry and Immunodiagnostic Analyzer Units are able to conduct and perform the tests listed within section 1.2 of the Performance Work Statement.

iii. The contractor must demostrate how the accessories for the required equipment meet the standards listed within section 1.3 of the Performance Work Statement.

b. Technical Capability of the Consumables (if any) and Reagents:

i. The contractor must demostrate how their reagents will meet the specifications listed within sections 1.4 & 1.5 of the Performance Work Statement.

ii. The contractor must demostrate how their consumables (if any) will meet the specifications listed within sections 1.4 & 1.5 of the Performance Work Statement.

iii. The contractor must also state precisely, how the disposal of all waste and debris as addressed in sections 2.3 & 6 of the Performance Work Statement will be handled.

c. Installation Plan

i. Currently 48 MDSS has two operating Chemical Analyzer Units in place which are used daily. Change over in contractor provided Chemical Analyzer units cannot result in a stop in service. The contractor shall describe, IAW section 2 of the PWS, how they are going to coordinate with the 48 MDSS and provide an installation timeline to install their analyzer units in such a way that the 48 MDSS does not experience a break in service of their operational analyzer units. The installation must take place between 1 May 2017 and 30 June 2017.

As a result of the Government’s evaluation of the aforementioned technical sub-factors, a determination of acceptable or unacceptable will be assigned for this factor of Technical Capability using the following ratings with descriptions:

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

2. Price. The Government will evaluate prices submitted in the pricing schedule contained in the attched price sheet of this solicitation. Failure to quote on all CLINs will render the quotation non-responsive.

The Government will evaluate all quotations based on a Total Evaluated Price (TEP). An offeror’s TEP will be determined by multiplying the quantities identified within this request for quotations by the offered unit price for CLIN 0001 and adding the total amount offered for the price per patient test located on the attached price sheet for CLIN 0002.

Additionally, the TEP will include the price for a FAR 52.217-8, Option to Extend Services, six month extension. The price for the six-month extension will be calculated using the one month quoted price of CLIN 0001 multiplied by six months. Evaluation of the option period will not obligate the Government to exercise the option.

The total extended price for each CLIN and the price for the six-month extension authorized by FAR 52.217-8, Option to Extend Services will be added together to arrive at the TEP.

Award Determination: As a result of the Government’s aforementioned evaluation, only those offerors whose quotation is determined technically acceptable, either initially or as a result of discussions, will be considered for award. No trade-offs will be permitted between price and the non-price factors of technical capability. Of those offerors found technically acceptable, an award determination will be made to the offeror with the lowest TEP that is determined to be fair and reasonable.

(End of Addendum)

(End of provision)

52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor:

(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 15 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons.

Upon receiving this notice, the Government may acquire the supplies or services from another source.

(End of clause)
