All contractor inspection forms shall be forwarded to the designated Vehicle Control Officer at RAF Lakenheath through the representative upon acceptance. Upon delivery, each vehicle shall have a minimum of 1/4th tank of fuel. The Government will be responsible for this amount upon return. 2.4. Breakdown repair and Scheduled Maintenance: Contractor will provide and pay for maintenance, towing and replacements of contracted vehicles, if needed. Arrangements for breakdown repair will be made by the contractor with a response time not to exceed 24 hrs. If contractor determines the vehicle cannot be repaired on-site within 2 hours, or if conditions determined that a delay is unacceptable due to mission requirements, a replacement vehicle shall be provided. The contractor shall coordinate all scheduled maintenance with a Government representative. A minimum notice of 72 hours is required, prior to maintenance service. If the vehicle will be away from the site for more than 4 hours, the contractor shall provide a temporary vehicle of the same type and capacity until return of original vehicle.

2.5. Accident Repairs: In the event that damage is made to the vehicle the Vehicle Control Officer will contact the contractor for resolution. If the vehicle is inoperable due to the damage, the contractor shall provide a new vehicle of the same type and capacity to the Government within 24 hours. Once notified of damage by the Government, the contractor shall respond within four hours to take action.

2.6. Instructions for Damages Incurred: The contractor will notify the Contracting Officer within three (3) working days of any damages incurred during rental. A working day is defined as Monday through Friday. Both British and American Holidays that fall on a week day, (Monday through Friday), are not considered “working days.” Following this notification and within ten (10) working days, the contractor will submit two (2) written estimates for damages and a written statement, from all involved, to the Contracting Officer. Documentation shall include an estimate of repair costs and names and phone numbers of all involved. If a police report is taken, it must be submitted with the claim. Copies of any contractor inspection forms shall be provided to the Vehicle Control Officer upon completion of the inspections. All discrepancies in vehicle condition will be addressed by the Vehicle Control Officer. Vehicles returned to the contractor will be in clean condition. The government representative will ensure accessories received with the vehicle are in the vehicle at time of turn in. The contractor shall complete a joint inspection on the vehicle and annotate any damages other than normal wear and tear. Any accident damage found to be other than normal wear and tear shall be the responsibility of the Government. Upon final inspection, each vehicle shall be collected/loaded by contractor personnel. (End Addendum)

Addenda to FAR 52.212-2 Evaluation – Commercial Items (Jan 1999)

A. Award Basis: The Government’s evaluation of the quotation will fully account for the evaluation factors identified and required under the Addendum to FAR 52.212-1. The evaluation of these factors will evaluate price reasonableness, combined with technical capability and past performance. Quotes that do not meet the quote specifics may be deemed technically unacceptable, and therefore not considered for award.

B. Evaluation: Evaluation factors required under FAR 52.212-1 will be evaluated by the Government as follows:

Technical capability:

The Government will evaluate the technical capability of the vehicles offered to meet the Government Vehicle Rental Requirements, as well as the capability of the Contractor to furnish the vehicles to the locations provided. If the Offeror lacks the capability to deliver to any locations, or the ability to furnish the vehicles, the Offeror shall state so. The Offeror shall provide the make/model/year of the vehicle they intend to provide. If they are capable of providing multiple vehicles at the same price for each CLIN, they may provide the make/model/year of the alternate vehicle(s) as well. The Offeror must list which vehicles fall under which CLIN. The price list (attachment 5) shall be completed and submitted for Government review. If the Offeror takes objections any items on the price list, they shall state so. The Government may award multiple BPA’s to multiple vendors based upon the capability of an Offeror who can deliver to one location, but cannot deliver to another at the Contracting Officer’s discretion. The Government may also decide to not make an award to multiple vendors if it is determined that one technically acceptable Offeror can deliver to the location(s), and multiple awards are unneccessary.

Price:

The Government will evaluate the price of each item in the price list in accordance with any of the FAR 13.106-3 bases, attempting to base price fair and reasonable upon competitive quotations. However, if a price cannot be determined fair and reasonable, the Government will determine price reasonableness upon any of the factors in FAR 13.106-3(a)(2). If all line items are considered priced fair and reasonable by the Contracting Officer, the price shall be deemed acceptable. The Government reserves the right to award to any offeror who has a line item that is not fair and reasonable, and remove that line item from the price list unilaterally. That offeror may still be awarded a BPA at the discretion of the Contracting Officer, however, the Government also reserves the right to remove that offeror from consideration completely. The Government may award multiple BPA’s to multiple vendors based upon lower prices for any vehicles.

Past Performance The Government will evaluate past performance under FAR 13.106-2(b)(3). The Government will use any means necessary to identify poor past performance, including, but not limited to, customer surveys, past performance questionnaires, the Governmentwide Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov, or any other reasonable basis, including the Contracting Officers’ knowledge of and previous experience with the supply/service being acquired. Contractors are encouraged to provide any material (limited to 5 pages, size 10 font, Times New Roman, including pictures) to support their past performance. If any adverse past performance is found, the Contracting Officer may eliminate that offeror from consideration. FAR 15.3 does not apply to this acquisition, therefor, offerors may not have the capability to respond to adverse past performance. Past Performance will be evaluated on a pass/fail basis. The Government reserves the right to request clarification on adverse past performance if the Contracting Officer determines necessary, and make an award if appropriate. The Government reserves the right to make multiple awards to multiple Offerors if insufficient past performance is found on an Offeror at the discretion of the Contracting Officer. A lack of past performance on government contracts will not eliminate an awardee, however, multiple awards will allow the Government alternate avenues if a Contractor has poor performance during the course of this BPA.

C. AWARD DETERMINATION: As a result of the Government’s aforementioned evaluation, only those vendors whose quotes are determined to be technically acceptable with satisfactory past performance will be considered for award. No trade-offs will be permitted between price, and the non-price factor of technical capability. This is a competitive solicitation for quotations conducted in accordance with FAR parts 12 and 13. The Government will award from among the technically acceptable quotes based on price and technical acceptance.

(End of Clause) 5352.201-9101 Ombudsman.

OMBUDSMAN (APR 2010)

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.

(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen:

Primary Command Ombudsman:

(d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.

If the Contractor intends to use imported products from inventories on hand, the price of which includes a factor for import duties, the Contractor shall ensure the United States Government’s exemption from these taxes. The Contractor may obtain a refund of the import duties from its government or request the duty-free import of an amount of supplies or components corresponding to that used from inventory for this contract.

(c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract.

(End of clause) 5352.242-9000 CONTRACTOR ACCESS TO AIR FORCE INSTALLATIONS (Jun 2014)

(a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. (b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. (f) Failure to comply with these requirements may result in withholding of final payment.

(End of clause) In accordance with FAR 13.004 -- Legal Effect of Quotations the following information is provided in regards to quotations.

A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.

When appropriate, the contracting officer may ask the supplier to indicate acceptance of an order by notification to the Government, preferably in writing. In other circumstances, the supplier may indicate acceptance by furnishing the supplies or services ordered or by proceeding with the work to the point where substantial performance has occurred.

If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its offer.
