ADDENDUM TO 52.212-1
Addendum to 52.212-1 Quotation Preparation Instructions
A. To assure timely and equitable evaluation of the quotations, vendors must follow the instructions contained herein. Vendors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors.
Failure to meet a requirement may result in a quote being ineligible for award. The quotation shall consist of three
(3) separate parts; Part I - Price, Part II - Technical, and Part III - Past Performance.
B. The Government’s terms, conditions, and respective clauses contained within this solicitation are prescribed in accordance with United States Federal Acquisition Regulations (FAR), and are not subject to conditionally proposed revisions or changes requested by vendors. Vendor specific terms and conditions that may be contingently proposed for subsequent inclusion into the contract, if awarded, will not be considered by the Government in its evaluation of quotes. Vendor’s that are not able to comply with the aforementioned conditions, will be determined as noncompliant with the solicitation requirements, and therefore may be removed from consideration for award.
C. Specific Instructions: Complete the necessary fill-ins and certifications in all provisions. The provision FAR
52.212-3 shall be returned along with the quote.
Vendors are encouraged to submit their quote electronically to: david.miller.115@us.af.mil and benjamin.brown.16@us.af.mil. It is the vendor’s responsibility to ensure the quote is sent to the correct
Government email address(s), and it is encouraged that vendors request a “read receipt” to ensure quotations have been received. Please note that our email system has a 1MB limit for attachments. Vendors may send their quote mailto:david.miller.115@us.af.mil mailto:benjamin.brown.16@us.af.mil using multiple emails and it is advised that number systems such as “email 1 of 4” are used so that if requested by the vendor, we can confirm receipt. The requirements below for multiple copies do not apply to electronically submitted quote.
1. PART I – PRICE - Submit original and two (2) copies (copies are only required when quotation is not submitted electronically.)
a) Labor Hour Contract Quotes: As prescribed by clause 52.216-1 TYPE OF CONTRACT, the resultant contract will be a Labor Hour contract. Complete all areas within the Price Schedule, ensuring that proposed unit (hourly rate) and extended prices for the required quantities are correctly calculated for summary totals that equate to prices provided at the Contract Line Item Number-level (CLIN).
b) To be considered for award, proposed pricing must be submitted in British Sterling Pounds (£), and remain valid for 60 days after the solicitation close date for all items in the Price Schedule and for all associated priced CLINs.
c) TUPE: During the solicitation phase and award of the resultant contract the Government does not have access to specific TUPE information nor becomes involved with related TUPE processes and associated liabilities
(to include indemnification) that may transpire during pre-award or post-award phases between transferor and transferee. While the Government fully understands the relevance of TUPE-information in proposing fixed prices, the responsibility to provide TUPE-information rests solely with the transferor; governed by
Regulation 11 of the Transfer of Undertakings (Protection of Employees) Regulations 2006 (TUPE). As the transferor need only provide TUPE information to the transferee prior to the transfer, the Government will only make available the listing of the current, incumbent contractor(s) with associated points of contact if requested.
d) The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial quotes, the contracting officer will assess this determination and if, in the contracting officer’s opinion, adequate price competition exists, the competition of quotes will determine price reasonableness. However, if at any time during this competition the contracting officer determines that adequate price competition does not exist, vendors may be required to submit other than cost or pricing data to establish price reasonableness.
2. PART II – TECHNICAL – Submit original and two (2) copies. Limit to no more than 20 pages. (copies are only required when quotation is not submitted electronically.)

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Part I - Price
Part II - Technical
Part III - Past Performance
ALSO SEE ADDENDUM 52.212-2
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
ADDENDUM TO 52.212-2
Addendum to 52.212-2
BASIS FOR CONTRACT AWARD: Government evaluation will be conducted on vendors’ quotations considering the evaluation factors listed herein. Evaluation of the factors will utilize a Lowest Price, Technically
Acceptable (LPTA) process; whereby the Government seeks to award on the basis of the lowest evaluated price of quotations meeting or exceeding the acceptability standards of non-price factors (i.e. Technical and Past
Performance). Under the LPTA process, trade-offs are not permitted, quotations are evaluated for acceptability but not ranked using the non-price factors. Only one award will be made as a result of this solicitation. The evaluation process shall proceed as follows:
1. EVALUATION FACTORS FOR AWARD: IAW FAR 13.106-2, quotations will be evaluated in an efficient and minimally burdensome fashion whereby formal evaluation plans and establishing a competitive range, conducting discussions, and scoring quotations or offers are not required. A comparative evaluation of quotations will be conducted whereby preliminary consideration of all quotations will identify one that is most suitable to the user, subject to the lowest priced, technically acceptable quotation. Three (3) evaluation factors will be used to evaluate quotations: a.) Price, b.) Technical and, c.) Past Performance.
a) Price. The Government will evaluate prices submitted in the Pricing Schedule and verify extended totals at the CLIN level. Comparisons of quoted pricing by vendors received in response to the solicitation will be first evaluated at the CLIN level to verify completeness and correctness. As only one (1) contract will result from this solicitation, the total evaluated price of each quotation will be determined at an aggregate/overall level, for purpose of the Government’s price evaluation. Accordingly, vendors should quote the best available pricing to the Government for each item in arriving at the most competitive, overall price. A comparison of vendor’s proposed, competitive prices at the aggregate total, will satisfy the requirement for price analysis, in establishing price reasonableness in accordance with FAR Part 13.106-3(1) .
b) Technical. The Government will evaluate technical quotations on a pass/fail-basis, assigning an overall rating for the Technical factor as “Acceptable” or “Unacceptable”. Accordingly, under the LPTA evaluation process, vendor’s assigned an “Unacceptable” rating for this factor, may not be considered for award. Technical Acceptability shall be evaluated against the following factor:
i. Transition Plan: The Transition Plan will be evaluated for its completeness in thoroughly addressing the vendor’s proposed processes and procedures, as identified in the addendum to provision 52.212-1, which enables successful performance of the contract requirements on the contract start date. As the
Government intends to award a contract without discussions, vendors that do not provide sufficient information to clearly and comprehensively illustrate their plans for transitioning and meeting the requirements of the Performance Work Statement, may result in an unacceptable rating for this
Technical factor, and therefore, such vendors may be removed from consideration for award.
c) Past Performance. The Government will use questionnaires for the vendor’s referenced customers to determine Past Performance acceptability. Also utilized by the government during past performance evaluation will be data independently obtained from other government and commercial sources. Based upon feedback from respondents to the questionnaires, and information gained from other government/commercial sources, past performance evaluation will further assess the recency and relevancy of associated projects. If determined by the Government to be recent and relevant, the Government will assess whether or not the vendor had successfully demonstrated an ability to perform. Recent performance includes contract performance within three (3) years of the date of this solicitation. Relevant performance includes performance of efforts involving the services in the PWS that are similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The evaluation of past performance information will result in an overall assessment of acceptable or unacceptable.
Note that the past performance evaluation performed in support of this requirement does not establish, create, or change the existing record and history of the vendor’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the vendor performed those past contracts.
2. AWARD DETERMINATION: As a result of the Government’s aforementioned evaluation, only those vendors whose quotations are assigned acceptable ratings for both factors entailing Technical and Past
Performance will be considered for award. Of those vendors whose Technical quotations and Past
Performance records are assigned acceptable ratings, award will be made to the lowest reasonably priced vendor.
Additional Information for Vendors regarding the Government’s evaluation of quotations:
Vendors are cautioned to submit sufficient information and in the format specified in 52.212-1, Instructions to
Vendors—Commercial Items. NOTE: This addendum supplements section (c) of the primary clause 52.212-2;
whereby this solicitation is issued in accordance with simplified acquisition procedures prescribed by FAR Part 13, in seeking quotations from interested vendors. Accordingly, in accordance with 13.004 -- Legal Effect of Quotations, a quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract.
Therefore, issuance by the Government of an order in response to a vendor’s quotation does not establish a contract.
The order is an offer by the Government to the vendor to buy certain supplies or services upon specified terms and conditions. A contract is established when the vendor awarded the contract (awardee), accepts the offer. The contracting officer may ask the awardee to indicate acceptance of an order by notification to the Government in writing (i.e. by bilaterally signing the contract), and/or the awardee may indicate acceptance by furnishing the supplies or services ordered, or by proceeding with the work to the point where substantial performance has occurred.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (NOV 2013)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.
