Section A: General Contract Information

Contracting Activity: 18th Contracting Squadron, Kadena AB, Okinawa, Japan
Project/Program Name: X-Ray Machine Service Contract
Section B: Description of the Supplies/Services Required
Preventative maintenance and repair services to include parts/labor for the upkeep of luggage X-Ray Machines located at the 733rd AMXS Passenger Terminal.
Section C: Justification for Soliciting from a Single Source or Brand Name
Astrophysics is the sole supplier and warranty service provider of the x-ray equipment currently owned. Authorized dealers act as distributors on the behalf of Astrophysics; however, the products are sold via direct transaction between Astrophysics and their customers. The previous acquisition was awarded as a sole source requirement to Astrophysics, LLC. IAW FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand name description or other purchase description to specify a particular brand-name, product, or feature of a product peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited. This acquisition covers the maintenance and repair of existing equipment from Astrophysics, Inc. and has been determined absolutely necessary to meet the Government's requirements.
Section D: Efforts to Obtain Competition
Astrophysics was contacted in order to find resellers of the x-ray equipment, in order to find third party maintenance and outside competition. In the continental United States, Astrophysics is the sole supplier of the warranty service request but has available sources outside the U.S. that act as third party vendors. In an effort to maximize competition, a sources sought was posted to beta.SAM.gov, which yielded two results (other than the manufacturer). It is anticipated that other companies may be hired by or licensed by the manufacturer to fulfill this requirement and provide competition.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
Until the 733rd AMXS changes the existing X-Ray machine or the proprietary vendor allows third party manufactures to work on their products, this requirement will remain a brand name. At this time, it is not anticipated that the equipment will be replaced within the next five years.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
