1. DESCRIPTION OF SERVICES.

The contractor shall provide all management, tools, supplies, equipment, labor/manpower to perform custodial services at the following U.S Army Installations in Okinawa, Japan: Torii

Station, Naha Port, Kuwae Tank Farm #1 & 2, Chimuwan Tank Farm #1, 2 & 3 and White Beach.

And the contractor shall use and resupply with the government supplies materials mentioned in para 3.1. The contractor shall perform custodial services to maintain good sanitation and a comfortable environment in all indicated facilities and frequencies in Appendix B. After cleaning, the performance result shall be in a manner that will present a satisfactory facility condition and a clean, neat and professional appearance.

1.1 BASIC SERVICES.

The contractor shall submit a schedule for basic cleaning services per buildings and contractor personnel scheduled to the Contracting Officer Representative (COR) for acceptance not later than the Post Award Orientation Conference. The contractor may coordinate with the COR for the format of the schedule.

1.1.1 Sweep & Mop/Vacuum (Interior Floors). The contractor shall perform sweep and dust mopping and damp mopping to rubber or polyester entrance mats and all type of floor surfaces, such as vinyl (plastic) tile, wood, concrete, steel, ceramic tile, rubber, etc., other than carpeted floors. Stairways shall be considered in all floor related cleaning services.

The contractor shall vacuum carpeted areas, throw rugs areas, underneath carpet-type entrance mats and carpet-type entrance mats. The contractor shall remove entrance carpet type mats during the vacuuming and returned to their original location after completion of performance. Carpet-type entrance mats shall be vacuumed to remove soil and grit and to restore resiliency of the carpet pile.

After sweep and dust mopping/vacuuming, the entire floor surface, including corner and abutment shall be free from the accumulation of litter, dust, debris and other foreign matter. After damp mopping, the floor shall have a uniform appearance with no streaks, swirl marks, detergent residue, or any evidence of soil, film debris or standing water, and there shall be no evidence of splash marks or mop strands on the surfaces of furniture, walls and baseboards. Rubber or polyester entrance mats shall be swept, vacuumed, or hosed-down outside to remove soils and grit. Soil and moisture underneath entrance mats shall be removed and mats returned to their original location.

1.1.2 Restroom/Bathroom/Laundry/Sauna (Dry & Steam)/Jacuzzi and Locker Room.

Restroom, bathroom, laundry, sauna, jacuzzi and locker room cleaning services includes but is not limited to dusting, sweeping and mopping, scrubbing, sanitizing and descaling walls, floors, sinks and lavatories, toilet bowls, and urinals, resupply restrooms, cleaning of mirror, scrub ceramic type benches, wiping plastic and wood benches and removal of trash.

1.1.2.1 Sweep & Mop Floors. All floor surfaces except carpet including grouts shall be swept and shall be free from the accumulation of litter, dust and foreign debris upon completion. Grout on floor tiles shall be free of dirt, scum, mildew, residue, etc. Floors shall have a uniform appearance without streaks, swirl marks, detergent residue, or any evidence of soil, stain, and film or standing water.

1.1.2.2 Descale Utility Fixtures, Clean and Disinfect. The contractor shall descale utility fixtures, to include but not limited to showers, sinks, toilet bowls, mirrors and urinals. Descaling shall be

performed before cleaning and disinfecting is accomplished. After descaling, the entire surface shall be free from streaks, stains, scale, scum, urine deposits and stain, and rust stains.

The contractor shall completely clean and disinfect all surfaces of sinks, toilet bowels, urinals, lavatories, showers mats, dispensers, plumbing fixtures, saunas, partitions, dispenser, doors, walls, and other such surfaces, using a germicidal detergent. After cleaning, receptacles will be free of deposits, dirt, streaks, and odors. Disinfect all surfaces of partitions, stall doors, entry doors, (including handles, kickplates, ventilation grates, metal guards, etc.) and wall areas adjacent to wall mounted lavatories, urinals, mirrors and toilets.

1.1.2.3 Resupply Restrooms. The contractor shall ensure cake toilet soap, paper towel dispensers, and liquid hand soap dispensers located at all Army facilities building’s restrooms are refilled and ready for use after each cleaning. Restroom supplies shall be stored only in designated areas determined by the COR. The contractor shall notify the COR if it appears insufficient supplies exist to support the next service date.

1.1.2.4 Trash Removal. All trash containers located inside restroom, bathroom, locker and laundry rooms shall be emptied and returned to their initial location. The contractor shall provide plastic bags in order to empty the trash containers. Boxes, cans, papers placed near trash receptacles that are identified by facility occupant, as trash shall be removed. Any obviously dirty, soiled or torn plastic trash receptacle liners shall be replaced. Trash shall be deposited in the nearest trash collection bin or container outside the facility. Trash receptacles shall be left clean, free of foreign matter, and free of odors.

1.1.2.5 Jacuzzi Pool. The water in the jacuzzi pool shall be removed in the process of cleaning.

Scrub all interior surfaces of the jacuzzi pool. After cleaning the Jacuzzi pool shall be refilled to its original water level.

1.1.3 Trash Removal. All wastebaskets and other trash containers within the area shall be emptied and returned to their initial location. The contractor shall provide plastic bags in order to empty these wastebaskets and other trash containers. Trash placed near a trash receptacle shall be removed with the previous confirmation by the user. Trash shall be disposed of in plastic bags and secured. The contractor shall pickup any trash that may fall onto the facility or grounds during the removal of such collected trash. The trash bags shall be deposited inside the trash collection bins or containers located in the nearest trash station.

The contractor shall empty and clean all public ashtrays and urns located outside facilities.

Ashtrays shall be cleaned to remove ashes, odor, and stains. All public urns shall be cleaned.

Ashtrays and urns included in this contract are those that are placed in designated smoking areas only whether outside of the facility.

1.1.4 Drinking Fountains. The contractor shall clean, and disinfect all polished metal surfaces, including the orifices and drain, and exterior surfaces of drinking fountains. The entire drinking fountain shall be free from streaks, stains, spots, smudges, scale, and other obvious soil.

1.1.5. Common Areas Kitchen and Kitchen Hood Cleaning. The contractor shall clean, and disinfect all polished metal surfaces, including the orifices and drain, and exterior surfaces of kitchen sink, heater and kitchen hood located in the common areas. The entire kitchen sink shall

be free from streaks, stains, spots, smudges, scale, and other obvious soil. The kitchen basket strainer, kitchen drainage interior surface and kitchen trap shall be free of grout and mold or other obvious soil. All kind of oil dirt shall be removed from the kitchen heater, hood exterior and interior surface, including the hood filter and fan.

1.1.5.1 Cleaning Kitchen Ovens/Ranges. The contractor shall clean the ovens/ranges located at any rooms at Army Facilities. The ovens/ranges shall be free from grease dirt, streaks, stains, spots, smudges, scale, and other obvious soil. The contractor shall submit Safety Data Sheet (SDS) in English for any cleaning supplies or solutions to the government for approval.

1.1.6. Low Dusting. The contractor shall perform low dusting and wiping to remove the accumulation of dust, lint, debris, and soil from all horizontal and vertical surfaces to include but not limited to base boards, top and sides, of file cabinets, book cases, mirrors, desk lamps, table, chairs, benches and fire extinguishers that are within the height of 7 feet from the floor surface, with the exception of desks, computers, printers, copier machines and personal items. The contractor shall clean both sides of all glass surfaces inside facilities, to include but not limited to all glass portions on division walls, interior doors, trophy/display cases, directory boards, bulletin boards and mirrors. There shall be no traces of film, dirt, smudges, water, or other foreign matter on the glass surface upon completion of this task. Glass surfaces shall be cleaned from top to bottom. The contractor is not required to clean glass surfaces that are on the interior side of closets and display cases. Measurement will be based on the total floor area of the room that requires this type of service.

1.1.7 Sweep (Exterior Floors/Pavement). The contractor shall sweep exterior floor/pavement surfaces as indicated on the floor plans for each facility, including entrances, stairways and sidewalks to remove and collect for pick-up, all visible foreign objects such as sand, gravel, soil deposits, cigarette butts, leaves, paper and unwanted debris. Accumulated debris and dirt shall be collected, removed, and deposited inside the trash collection bins or containers located in the nearest trash station. The contractor shall not sweep to divert trash, litter and debris to adjacent grass or unpaved grounds.

1.2 PERIODIC SERVICES.

The contractor shall submit a monthly schedule for periodic cleaning services per buildings and task to the COR at least 5 days prior to the start of the following month.

1.2.1 Waxing. All areas accessible to floor maintenance shall include but is not limited to vinyl

(plastic) tile and wood type of floors machines shall receive floor maintenance. After receiving floor maintenance the entire floor shall have a uniform coating of a nonskid floor finish, have a uniform glossy appearance, and be free of scuff marks, heel marks, and other stains and discoloration. Cover with plastic covers all kinds of computers placed on the floor, without moving them from the original place to avoid any kind of cable disconnection and to prevent them getting wet during the performance. After the performance is done the plastic covers shall be removed very carefully. The contractor shall not use tape on the walls to prevent any paint pealing.

All floor maintenance solutions shall be removed from baseboards, furniture, trash receptacles, etc. Chairs, trash receptacles and easily movable items shall be tilted or moved to maintain floors underneath. All moved items shall be returned to their proper position when all operations have

been completed. Floor maintenance includes the techniques of dry buffing, spray buffing, stripping, and waxing as required to achieve the above stated results.

1.2.1.1 Stripping & Re-waxing. The contractor shall strip, scrub, seal, and wax floors and perform all tasks associated with stripping, sealing, and waxing of the floor surface to maintain a clean and uniform glossy appearance. A non-skid wax is required. Remove items like chairs and trash receptacles and move them back to the original location. Cover with plastic covers all kinds of computers placed on the floor, without moving them from the original place to avoid any kind of cable disconnection and to prevent them getting wet during the performance. After the performance is done the plastic covers and tapes shall be removed very carefully. The contractor shall not use tape on the walls to prevent any paint peeling. Upon completion of task the entire floor shall have a uniform glossy appearance, free of scuff marks, heel marks, wax build-up, and other stains and discoloration. The type of floors that this task is applicable to shall include but is not limited to vinyl (plastic) tile, wood type of floors.

1.2.2 High Dusting. The contractor shall perform high dusting to remove and clean the accumulation of foreign matters to include but is not limited to all dust, dirt, lint, litter, and soil from all horizontal and vertical surfaces located more than 7 feet from the floor surface. This type of performance shall be performed to all facilities, except ceiling height more than 12 feet. High dusting shall include but not limited to areas over windows and doors, suspended ceiling light fixtures, air conditioning supply and return registers and diffusers, all wall fixtures including glasses, mirrors and picture frames and all other visible surfaces including soiled areas of upper walls and ceilings and the upper surfaces of exposed structural beams and girders. High dusting shall be performed before low dusting occurs. A satisfactorily dusted surface shall be free from all dust, dirt, cobwebs, streaks, oily residue, and stains. Measurement will be based on the total floor area of the room that requires this type of service.

1.3 ON CALL SERVICES.

On call services is required in order to support the Using Activities, when requirements emerge and in case of typhoons or other calamities that may smudge the interior and exterior of the facility.

The government will make service calls on weekdays (Monday through Friday) within the contractor’s regular office hours. The schedule shall be coordinated with the COR.

1.3.1 General Room Cleaning. The contractor shall perform all tasks mentioned in basic and periodic cleaning services and carpet & ceramic tile floors shampooing (paragraph 1.1 & 1.2 &

1.3.2). However, the tasks need to be performed depends on the requirements needed. The contractor shall coordinate with the COR for schedule and tasks required.

1.3.1.1 Mold Cleaning. The contractor shall clean mold from all walls, ceilings, government furniture, electrical appliances surfaces contaminated, to include but not limited to doors, within the room, indicated by the COR. Entire bathrooms, restroom, shower room are shall be free of mold, as well. The contractor shall clean all kinds of government furniture and electrical appliances like, drawers, cabinets, refrigerators, etc., if all these items are empty at the time of performance. The contractor shall not clean any personal goods, equipment, or electrical appliances. Measurement will be based on the total floor surface of the room that requires this type of service. The contractor shall follow Occupational Safety & Health Administration

(OSHA) guidance at website http://www.osha.gov/dts/shib/shib101003.html to conduct this performance in a safe manner.

1.3.2 Carpet & Ceramic Tile Floors Shampooing. The contractor shall vacuum to thoroughly remove all kinds of debris, dirt, soil and stains. The carpet and ceramic tile floor should have a bright uniform color and shall be dried thoroughly at the point of completion. Remove items like chairs and trash receptacles, until the carpet and ceramic tile floors is dry to avoid staining from rust or dye, and move them back to the original location. Cover with plastic covers all kinds of computers placed on the floor, without moving them from the original place to avoid any kind of cable disconnection and to prevent them getting wet during the performance. After the performance is done the plastic covers shall be removed very carefully.

1.3.3 Cleaning Beach Toilet During Events. The contractor shall clean and maintain the toilets clean during the events, located at Torii Beach as it is mentioned in paragraph 1.1.2. The contractor shall provide personnel to maintain the toilet clean until at least one hour after the events are completely finished. Some event’s hours might last until midnight, so the contractor shall standby personnel until 0100 hrs. The contractor shall coordinate the schedule and hours with the COR.

1.3.4 Interior & Exterior Surface Windows Cleaning. The contractor shall perform cleaning of interior and exterior windows glasses, frames and rails of the building (s). None of the windows interior and exterior surfaces shall not be left with dust, dirt, stain or any kind of dirt visible.

Interior Surface of Windows. The contractor shall wipe the interior surface of the windows using water. However, for some heavy dirt the contractor may use window cleaning solution. The contractor shall submit to DPW, Environmental Office the SDS prior to the usage of any solution

(s) that will be used for the window cleaning.

Exterior Surfaces of Windows. The contractor shall clean the exterior surface of windows with water using a high-pressure cleaning machine. The contractor shall provide rolling tower if necessary for windows above 2nd floor of the building (s). The contractor shall ensure the performance for cleaning exterior surfaces windows above 2nd floor shall be in a safe manner. The contractor shall wear helmets and use safety bets at the point the contractor needs to use the rolling tower on site.

1.3.5. Blinds Cleaning. The contractor shall perform blind cleaning of all the blind in the building

(s). Blinds shall be free of stains, dust and any visible dirt. The contractor shall submit to DPW, Environmental Office the SDS prior to the usage of any solution (s) that will be used for the blind cleaning.

2. SERVICES SUMMARY.

The contractor service delivery requirements are summarized into performance objectives that relate directly to standards of performance required to meet mission essential needs. For the

Performance Objective to be met, service delivery must be in substantial compliance with applicable performance standards. The Performance Threshold describes the minimum overall levels of service delivery required for acceptable quality control. Failure to meet these

Performance Thresholds means that contractor quality control is unacceptable.

3. GOVERNMENT PROPERTY AND SERVICES.

NONE

3.1 GOVERNMENT SUPPLIES MATERIAL. The contractor shall obtain government supplies material from Building 276 (Warehouse), Torii Station and distribute it to all appropriate buildings. The government will provide the items listed below:

3.2 UTILITY. The government will provide water and electricity at no cost to the contractor when available.

3.3 JANITOR STORAGE. The government will allow the contractor to use existing built-in janitor closets or storage in each facility when available, but it is the responsibility of the contractor to secure all supplies and materials to ensure they are kept out of reach from children or any unauthorized personnel in the facility.

3.4 PROTECTION OF GOVERNMENT PROPERTY. The contractor shall take all necessary precautions to government property. All damaged property due to the contractor’s cleaning performance or any related action to support the cleaning performance shall be repaired, replaced, or restored to a condition as approved by the COR at no cost to the government. All damaged property shall be corrected within 5 working days by the contractor with the same or equivalent quality material and finish by skilled craftsmen as required. Should the contractor fail to correct damages, the government will correct the damages and the cost will be deducted from the contractor’s payment. The contractor shall report all damages to the COR and CO.

4. GENERAL INFORMATION.

4.1 QUALITY CONTROL.

4.1.1 The contractor is required to control the quality of services delivered to the government.

The overall quality must meet the specified performance thresholds for each requirement in the

Services Summary.

4.1.2 Records of inspections shall be kept and made available to the government throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.

4.2 QUALITY ASSURANCE.

The government will periodically evaluate the contractor’s performance by appointing the

Contracting Officer’s Representative (COR) to monitor performance to ensure services are received. The COR will evaluate the contractor’s performance through Periodic Inspection on-site inspections and receipt of complaints from base personnel. The government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality control inspections if merited by performance.

4.2.1 The Contracting Officer’s Representative(s) (CORs) is the authorized government representative(s) who will perform assessments of the contractor’s performance. Subsequent to contract award, the identity of the COR(s), with a letter defining their duties and authority will be promptly furnished to the successful offeror.

4.2.2 The COR(s) will inform the contract manager in person when discrepancies occur and will request corrective action. The COR(s) will make a notation of the discrepancy on their surveillance checklist with the date and time the discrepancy was noted and will request the contract manager

(or alternate contract manager) to initial the entry on the checklist.

4.2.3 Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer (CO) through the COR(s).

4.2.4 The services to be performed by the contractor during the period of this contract shall at all times and places be subject to review by the CO or authorized government representative(s).

4.3 SECURITY REQUIREMENTS.

Security and base access requirements are contained in clause 5352.242-9000 “Contractor Access to Air Force Installations(NOV 2012).” Except U.S. military installations where the required custodial services are performed, only two (2) contractor employees (contract manager and its alternate) shall require for base pass for access to Kadena Air Base. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base. Procedures for commercial vehicle access to the base are subject to change without prior notice.

4.3.1 ID Passes, Badges and Vehicle Stickers. The contractor is responsible to obtain such clearances and/or passes as required for his/her employees to enter the U.S. military installations prior to start to work. The contractor shall be responsible for all passes issued to his/her employees under this contract. Applications shall be coordinated through the CO or designated representative.

At the time of application, Security Forces may conduct a background check on employees. Upon termination of employment, the contractor shall be responsible for returning identification cards and base passes to Security Forces within 24 hours.

4.3.1.1 The contractor shall submit a request for base passes for his employees to the 18th

Contracting Squadron, Attention: 18 CONS/LGCB, Kadena Air Base, for recommendation of approval by the Pass and ID Section. After approval from 18 CONS/LGCB, the contractor shall follow the instructions for acquiring designated pass ID for entry into applicable Marine and Navy facilities at Camp Foster, Bldg 456, at DSN 645-2239/7519 or from off base dial 098-970-

2239/7519. The contractor shall follow the instructions for acquiring designated pass ID for entry into Army Facilities (Torii Station, Naha Port and POL Facilities=Kuwae Tank Farm #1 & 2, Chimuwan Tank Farm #1, 2 & 3 and White Beach Tank Farm) from Torii Station Pass Office, at

Bldg 240, Torii Station, at DSN 644-4688 and from off base dial 098-911-5111(Operator) and after the tone changes, dial 644-4688.

4.3.1.1.1 Contractor personnel desiring entry into Petroleum Oil Lubricants (POL) facilities

(Kuwae Tank Farm #1 & 2, Chimuwan Tank Farm #1, 2 & 3 and White Beach Tank Farm) must process the application documents through DLA-Energy Okinawa and then to Torii Station Pass

Office. DLA-Energy Okinawa is located outside of Kadena Air Base gate 3. The application documents shall be submitted to Defense Logistics Agency-Energy Okinawa (DLA-Energy

Okinawa), Bldg 53135 at DSN 632-4760 or from off base dial the operator at 098-938-1111

(Operator) and after the tone changes, dial 632-4760.

4.3.1.2 For vehicle access, follow the instruction from Vehicle Registration, Bldg 5638, Camp

Foster, at DSN 645-3200 or from off base dial 098-970-3200. The prime contractor shall be responsible for all passes issued to his/her or his subcontractor’s employees under this contract.

The government reserves the right to obtain certification of receipt for all base passes upon

termination of employment or completion of contract, prior to payment of final invoice.

Contractor employees will be required to display identification badges.

4.4 PHYSICAL SECURITY.

The contractor shall be responsible for safeguarding all government property provided for contractor use (if applicable). At the close of each work period, government facilities, property, and materials shall be secured.

4.4.1 Key Control (When applicable). The contractor shall establish and implement methods of ensuring that all keys/key cards issued to the contractor by the government are not lost or misplaced and are not used by unauthorized persons. The contractor shall not duplicate any keys issued by the government. The contractor shall coordinate with the COR to obtain keys for work areas that are fenced-in. The contractor shall return the keys to the COR before close of business every day.

Failure to do this may result in refusal of key use by the government.

4.4.1.1 The contractor shall immediately report the loss of a duplicate key to the COR

4.4.1.2 In the event keys, other than master keys, are lost or duplicated, the contractor shall, upon written direction of the CO, re-key or replace the affected lock or locks; however, the government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the government and the total cost deducted from the monthly payment due the contractor.

4.4.1.3 The contractor shall prohibit the use of keys issued by the government by any persons other than the contractor’s employees. The contractor shall prohibit the opening of locked areas by contractor employees to permit entrance of persons other than contractor’s employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the

Contracting Officer (CO).

4.4.2 Lock Combinations. The contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations.

4.4.3 Secured Areas/Buildings. The contractor shall clean designated facilities during normal working hours only. The authorized contractor to perform the secured areas/buildings will be escorted by an appropriate government official or provided an access ID pass solely valid for these secured areas/buildings issued by the using activity of these secured areas/buildings. If access to these secured areas/buildings is delayed or not available, the contractor shall perform other duties.

4.5 HOURS OF OPERATION.

4.5.1 Normal Hours of Operation. The contractor shall perform the services required under this contract during the following hours: 0730 thru 1630 hrs, Monday thru Saturday, except U.S

Holidays. The contractor may work, with prior approval of the CO, extended hours to ensure timely completion of work at no additional cost to the government.

Normal operating hours is 0730-1630 hours, Monday through Friday. However, for buildings 242, 284, 313, 321, T301, T315, at Torii Station, includes Saturday & Sunday. In some areas, due to the volume of personnel, type of operation, or other considerations, cleaning shall be accomplished at times other than during normal operating hours which is identified in Appendix B. The contractor shall coordinate with the COR for the allowable cleaning hours in these areas. During the events at Torii Beach the contractor will be requested to perform until midnight to maintain the toilets clean.

4.5.1.1 Recognized Holidays. The contractor is not required to provide service on the following days: New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence

Day, Labor Day, Columbus Day, Veterans Days, Thanksgiving Day, and Christmas Day. If the holiday falls on Saturday, it is observed on Friday. If the holiday falls on a Sunday, it is observed on Monday. Except at Bldgs, 242, 284, 313, 321, T301, T315, Torii Station.

4.6 CONSERVATION OF UTILITIES.

The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions which prevent the waste of utilities which include the following:

4.6.1 Lights shall be used only in areas where and when work is actually being performed.

4.6.2 Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the contractor or by contractor employees unless authorized.

4.6.3 Water faucets or valves shall be turned off after the required use has been accomplished.

4.6.4 Government telephones shall be used only for official government business.

4.7 RECORDS.

The contractor shall be responsible for creating, maintaining, and disposing of only those government required records that are specifically cited in this PWS or required by the provisions of a mandatory directive listed in Applicable Publications and Forms. If requested by the government, the contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request.

4.8 ENVIRONMENTAL CONTROLS.

4.8.1 Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Japan Environmental Governing Standards (JEGS), at web site as follows: http://www.usfj.mil/Portals/80/Documents/Other/2016%20JEGS.pdf, Department of

Defense, prefectural and local environmental laws and regulations and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect.

4.8.2 Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, the contractor or its agent shall immediately report

The liability for the spill or release of such substances rests solely with the contractor and its agent. The contractor is responsible for spill clean-up, remediation and disposal in accordance with appropriate laws and regulations.

4.8.3 Use of Hazardous Materials. The contractor’s use of any hazardous materials will require the submittal of a Safety Data Sheet (SDS) in English and in Japanese for each item utilized. The contractor shall prepare to obtain the approval through the COR from the Fire Department, Safety and the Environmental Office prior to the use of the item. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and materials handling. The contractor shall be responsible for the proper handling, labeling, storage and disposal of hazardous materials in accordance with all existing laws and regulations set forth by the Prefecture Government of Okinawa, Japan. Storage of hazardous material on the installation is prohibited and all hazardous material will be removed from the installation at the end of each work day.

4.9 GOVERNMENT OBSERVATIONS.

Government personnel, other than the CO and COR, may from time to time, with the CO coordination, observe contractor operations. However, these personnel may not interfere with contractor performance or make any changes to the contract.

4.10 SAFETY REQUIREMENTS.

In performing work under this contract, the contractor shall:

4.10.1 Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.

4.10.2 Perform work in a safe manner as required by OSHA 2206, General Industry, Occupational

Safety and Health Standards (29 CFR 1910) http://www.osha.gov/, Japan Environmental

Governing Standards (JEGS) by US Force Japan and general safety requirements of EM 385-1-1, dated 03 November 2003, “US Army Corps of Engineers, Safety and Health Requirements

Manual”. See website address http://www.usace.army.mil/usace-docs/eng-manuals/em385-1-

1/toc.htm for this regulation.

4.10.3 Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of government facilities and property and to provide a safe work environment for contractor personnel.

4.10.4 Provide protection to government property to prevent damage during the period of time the property is under the control or in possession of the contractor.

4.10.5 Include a clause in all subcontracts to require subcontractors to comply with the safety provisions of this contract as applicable.

4.10.6. Security Police and Fire Protection. Any suspicious or unexpected situations that might threaten or damage the facilities or performance required under this contract, the contractor shall notify Security Police and/or the Fire Department. Ensure personnel have the following on-base emergency services phone numbers programmed into their cell phones:

4.10.7 Record and report promptly (within one hour) to the CO or COR all available facts relating to each instance of damage to government property or injury to either contractor or government personnel.

4.10.8 In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the CO.

4.10.9 If the government elects to conduct an investigation of the accident/mishap, the contractor shall cooperate fully and assist government personnel in the conduct of investigation until the investigation is completed.

4.10.10 Include a clause in each applicable subcontract requiring the subcontractor's cooperation and assistance in accident reporting and investigation.

4.10.11 The contractor will be responsible for instructing his employees in safety measures considered appropriate. The contractor shall not permit placing or use of any equipment in traffic or other locations in such a manner as to create safety hazards. Whenever applicable, the contractor will provide and place appropriate warning signs at work areas and its removal after completion of work.

4.10.12 All safety precautions shall be exercised when working in and around POL storage facilities. All contractor equipment shall be equipped with proper safety and noise-limiting devices and shall be kept in safe operating condition at all times.

4.10.13 All contractor vehicles shall be in good mechanical and safe operating condition. All vehicles shall keep dry chemical type fire extinguishers on each vehicle. These vehicles are subject to inspection at any time. The vehicles shall have the contractor’s (firm’s) name displayed in

English on both sides and shall be readable up to a distance of at least 50 feet away.

4.10.14 All contractor employees entering POL areas shall not have matches or lighters in their possession. Smoking is prohibited at POL Facilities (Kuwae Tank Farm 1, 2, Chimuwan Tank

Farm 1, 2 & 3, White Beach Tank Farms and POL Patrol Road). The contractor shall ONLY smoke in designated areas at Torii Station and Naha Port.

4.10.15 Fire & Emergency Services.

The contractor shall be responsible to follow the Fire & Emergency Services (USAG-J Reg 420-

90) in appendix D.

4.11 CONTINUATION OF ESSENTIAL DOD CONTRACTOR SERVICES DURING

CRISIS IAW DoDI 3020.41.

IAW DoDI 3020.41, Operational Contract Support, paragraph 2.c, it is determined that Custodial

Services at U.S. Army Installations in Okinawa, Japan, has been identified by the Functional

Commander/Director as an essential service.

4.12 PHASE OUT.

4.12.1 If there is a change in contractor or if the operation reverts to in-house, the incumbent contractor will provide familiarization, to the government or the follow-on contractor, whichever the case may be, for 30 days after receipt of a notice from the CO. During the phase-out familiarization period, the incumbent will be fully responsible for the operation of the required services.

4.12.2 The government reserves the right to conduct site visits in all contractor operated facilities in conjunction with the solicitation of offers for the follow-on contract. In the event the follow-on contract is awarded to other than the incumbent, the incumbent contractor will cooperate to the extent required to permit an orderly change over to the successful contractor. With regard to the successor contractor’s access to incumbent employees, a recruitment notice may be placed in each facility.

4.13 PUBLICATIONS.

4.13.1 Compliance with all publications, regulations and operating instructions provided by the government is required when:

4.13.2 They pertain to the procedures for materials expediting herein and where the contractor is authorized by the performance work statement to accomplish the work specified in the publication, regulation or operating instructions.

4.13.3 The publications prescribe USAF policies, use of materials, procedures and processes applicable to the work requirements.

4.13.4 The contractor is required to acquire and work on the latest version of the publication.

4.14 CONTRACTOR PERSONNEL

4.14.1 Contract Manager: the contractor shall provide a contract manager and alternate contract manager (responsible in the absence of the contract manager) who shall be responsible for the performance of the services. The names of the contract manager and alternate(s) shall be provided to the CO in writing prior to the beginning of the first performance period. The contract manager and alternate(s) must be able to read, write, speak, and understand English.

4.14.1.1 The contract manager and alternate shall have full authority to act for the contractor on all contract matters relating to daily operations of this contract.

4.14.1.2 The contract manager or his/her alternate shall be available on work sites during the normal hours of operation for the CO, COR, and other government personnel designated by the

CO for any matters and issues concerning the contract.

4.14.2 Contractor Employees: the contractor shall not employ persons for work on this contract if such employee is identified to the contractor by the CO as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population.

4.14.2.1 Contractor personnel shall present a neat appearance and be easily recognized as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name in English.

4.14.2.2 The contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest. Additionally, the contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to DOD 5500-7-R Joint Ethics

Regulation. The contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies in AFI 64-106.

4.14.2.3 The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours or deployment.

Military Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform;

however, their absence at any time shall not constitute an excuse for nonperformance under this contract.

4.15 JAPANESE ROAD LAWS

4.15.1 The contractor shall comply with Japanese Road Laws while on US Military installations to specifically include: Article 43 The Road Law (Japan) (prohibited acts relative to roads). No person shall commit the following described acts:

4.15.1.1 Damaging the road, causing roads to be littered with debris, polluting the roads with debris or fall-out from motor vehicles or otherwise defacing roads unreasonably or without due cause.

4.15.1.2. Article 43-2 (Measures to be taken to prevent cargo or things loaded on motor vehicles from falling out)

4.15.2 The agency managing a road may when there is reasonable cause for him to feel that items or cargo being carried in or on a motor vehicle may fall out and damage, pollute, or otherwise deface the road in such manner as to hinder or obstruct the traffic, order the operator of the vehicle in question to take steps or measures necessary to prevent occurrence of such hindrance by stopping operation of the vehicle, or correcting the method of loading or traveling or operation of the vehicle.

4.16. REQUIRED INSURANCE by JAPANESE LAW

4.16.1 The Contractor shall procure and maintain during the entire period of his performance under this contract the following minimum insurance on each vehicle used by the Contractor at the work site.

4.16.1.1 Type: Automobile Property Damage Insurance Amount: ¥3,000,000 or Dollar equivalent Bodily Injury Insurance Amount: ¥30,000,000 or Dollar equivalent

4.16.1.2 All vehicles must be properly inspected/insured in accordance with Japanese

Compulsory Insurance (JCI) requirements.

4.16.2 Prior to the commencement of work hereunder, the Contractor shall furnish to the CO a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the U.S. Government in such insurance shall not be effective for such period as may be prescribed by the laws of the state in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the CO.

4.17 CONTRACTOR MANPOWER REPORTING (CMR).

The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address: https://www.ecmra.mil/Default.aspx

The required information includes: (1) the Contracting Office, CO and COR; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-contractors); (7) Total payments

(including sub-contractors); (8) Predominant Federal Service Code (FSC) reflecting services

4.18 INVOICE INSTRUCTION

In accordance with DFARS 252.232-7003 Electronic Submission of Payment Request and

Receiving Reports (JUN 2012), the contractor shall submit invoice(s) through interface, Wide

Area Workflow (WAWF), https://wawf.eb.mil/ in order to receive payment. The DODACC, a code, which the contractor shall use for invoice(s) in WAWF is WT6KHU.
