5352.242-9001 Common Access Cards (CACs) for Contractor Personnel

As prescribed in 5342.490-2, insert a clause substantially the same as the following clause in solicitations and contracts:

COMMON ACCESS CARDS (CACs) FOR CONTRACTOR PERSONNEL (AUG 2004)

(a) For installation(s)/location(s) cited in the contract, contractors shall ensure Common Access

Cards (CACs) are obtained by all contract or subcontract personnel who meet one or both of the following criteria:

(1) Require logical access to Department of Defense computer networks and systems in either:

(i) the unclassified environment; or

(ii) the classified environment where authorized by governing security directives.

(2) Perform work, which requires the use of a CAC for installation entry control or physical access to facilities and buildings.

(b) Contractors and their personnel shall use the following procedures to obtain CACs:

(1) Contractors shall provide a listing of personnel authorized a CAC to the contracting officer.

The contracting officer will provide a copy of the listing to the government representative in the local organization designated to authorize issuance of contractor CACs (i.e., “authorizing official”).

(2) Contractor personnel on the listing shall each complete and submit a DD Form 1172-2 or other authorized DoD electronic form to the authorizing official. The authorizing official will verify the applicant’s name against the contractor’s listing and return the DD Form 1172-2 to the contractor personnel.

(3) Contractor personnel will proceed to the nearest CAC issuance workstation (usually the local

Military Personnel Flight (MPF) with the DD Form 1172-2 and appropriate documentation to http://farsite.hill.af.mil/reghtml/regs/FAR2AFMCFARS/AF_AFMC/AFFARS/5342.htm#p53424902 http://www.dtic.mil/whs/directives/infomgt/forms/forminfo/forminfopage2479.html http://www.dtic.mil/whs/directives/infomgt/forms/forminfo/forminfopage2479.html http://www.dtic.mil/whs/directives/infomgt/forms/forminfo/forminfopage2479.html support their identification and/or citizenship. The CAC issuance workstation will then issue the

CAC.

(c) While visiting or performing work on installation(s)/location(s), contractor personnel shall wear or prominently display the CAC as required by the governing local policy.

(d) During the performance period of the contract, the contractor shall:

(1) Within 7 working days of any changes to the listing of the contract personnel authorized a

CAC, provide an updated listing to the contracting officer who will provide the updated listing to the authorizing official;

(2) Return CACs in accordance with local policy/directives within 7 working days of a change in status for contractor personnel who no longer require logical or physical access;

(3) Return CACs in accordance with local policy/directives within 7 working days following a

CACs expiration date; and

(4) Report lost or stolen CACs in accordance with local policy/directives.

(e) Within 7 working days following completion/termination of the contract, the contractor shall return all CACs issued to their personnel to the issuing office or the location specified by local policy/directives.

(End of clause)

FAR 52.212-4 PARAGRAPH (K)

FAR 52.212-4 paragraph (k), is changed to read:

SOFA STATUS: Logistic Support/Privileges – Technical Representatives

(a) Technical Representative status shall be extended to eligible United States citizens or foreign national employees of the contractor necessarily for the execution of this contract. This status makes eligible employees members of the civilian component of the United States Forces in Japan under Article I (b) of the Status of Forces Agreement (SOFA). The Contracting Officer shall issue contractor employees letters of invitation to allow them entry into Japan as exempt personnel under the provisions of paragraph 4, Article IX, SOFA. The determination of such status will be made by the appropriate commander upon application of the contractor. The presence of a technical representative shall be subject to all regulations and directives pertaining to the civilian component within

Japan. The following privileges shall be extended in accordance with current federal laws and regulations, Department of Defense and Military Department regulations and policies, military Inter-service Support

Agreements, and the SOFA as implemented.

(1) Entry into and exist from Japan as “exempt personnel.”

(2) Duty free import-export into and from Japan.

(3) U.S. customs exemptions under PL 89-346.

(4) U.S. customs exemptions under tariff act of 1930.

(5) Use of the Exchange and Commissary.

(6) Use of laundry and dry cleaning facilities.

(7) Use of military banking facilities.

(8) Use of transient billeting facilities on a space-available basis, not to exceed three days and nights.

(9) Use of morale, welfare, any recreation facilities, including membership clubs.

(13) DODDS Schools on a space available, tuition paying basis.

(14) Postal privileges.

(15) SOFA drivers license and registration of privately-owned vehicles.

(b) Employees may have to pay user charges to use some facilities. Where the term “Reimbursable basis” was used, the contractor or its employees may be required to reimburse the Government for charges incurred.

(c) The above privileges shall be granted to eligible United States citizen or national employees, unless they already have this status and these logistical support privileges. Violation of these privileges may be cause for immediate withdrawal of these privileges for the principal, his dependent family members, or both, and could result in total loss of privileges to all technical representative personnel under this contract.

It is agreed that withdrawal of any of these privileges for reasons cited above will not affect nor constitute grounds for excusable delay or nonperformance of any portion of the contract, nor will any action form the basis for any claim against the Government, based on the contract.

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 2 years.
