6. Addendum to FAR 52.212-2 Evaluation--Commercial Products and Commercial Services (Nov 2021)

I. The Government will award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is determined to be the Best Value to the Government, price and other factors considered. Best Value means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. An offer that does not conform to the requirements of the solicitation may be rejected without further evaluation or discussions. The following factors shall be used to evaluate offer:

a. PRICE

The Government will evaluate price for award by calculating a Total Evaluated Price (TEP) (Base year plus all option years) for each Offeror.

The Government will evaluate the Price for completeness. Any incomplete pricing information may result in quote elimination and the Offeror being determined ineligible for award.

The Government will evaluate the Price Factor for reasonableness, to include option periods. The Government will conduct price analysis, using one or more of the proposal analysis techniques and procedures as defined in FAR 15.404-1 and DFARS 215.404-1 to ensure a fair and reasonable price.

The Government will evaluate the Price for balance. The Government will review the quoted prices for the base and option periods for balanced pricing. This review will ensure that the price of one or more items/services is not significantly over or understated as indicated by the application of price analysis techniques, NOT to include price realism analysis.

Unbalanced pricing exists when, despite an acceptable total evaluated price (TEP), the price for one or more items/services is significantly over- or understated as indicated by the application of price analysis technique(s). The Government may determine that a quote is unacceptable if the items/services prices are significantly unbalanced.

Offerors are cautioned that the award may not necessarily be made to the lowest price offered. The Government is more concerned with obtaining the best value than with making an award at the lowest overall price to the Government.

However, the Government will not make an award at a significantly higher overall price to obtain an offer that exceeds the minimum requirements of the solicitation and/or specifications.

b. TECHNICAL

Rating Description

Acceptable The Offer clearly meets requirements of all specifications provided in Attachment 1 – Statement of Work

Unacceptable The Offer does not clearly meet requirements of all specifications provided in Attachment 1 – Statement of Work

A Quotation must clearly meet all requirements (no partial Quotations shall be considered) to be considered “Technically Acceptable.” In order to be considered technically acceptable, the response must demonstrate a clear understanding of the requirement in all areas described in the Statement of Work and the response must demonstrate a practical/functional technical approach that meets the needs of the solicitation. Failure to meet the criteria will render the response to be technically unacceptable and will not be considered for award.

II. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

7. Basis For Award / Evaluation Procedures:

I. The Government will first evaluate offers for acceptability. Offers will then be evaluated based on price. Award will then be made to the technically acceptable offer determined to represent the best value to the Government. If only one “Acceptable” offer is received, the Government will attempt to determine price to be fair and reasonable through means other than competition.

II. Award will be made on the initial evaluation of quotes received in response to this RFQ. Therefore, offerors are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. Offerors are further will be reviewed to determine if award is in the best interest of the government (price and non-priced factors consider). If award is not in the best interest of the government, the government reserves the right to determine the quote ineligible for award.

8. FAR 52.212-4 Contract Terms and Conditions--Commercial Products and Commercial Services (Nov 2023) applies to this acquisition. No addenda to this clause.

9. All firms must be registered and active in the System for Award Management (SAM) database at https://www.sam.gov to be considered for award. Quote must be directly submitted by the firm registered in SAM that is intended to be the successful awardee.

Quote submitted by another firm on behalf of a SAM registered company with the intention of being award “care of” will not be accepted. All quote must include registered Unique Entity Identity, CAGE code, Tax ID, and small business status.
