About this file
This document is a Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items for a federal contract opportunity.
The key details are: The 36th Contracting Squadron at Andersen Air Force Base, Guam is seeking to procure Brand Name: Persistent Systems or Equal MPU5 Stereo Headsets on a Firm Fixed Price, 100% Small Business set-aside purchase order. The headsets are required to be compatible with the existing Persistent Systems dual Push-To-Talk equipment used by the 644th Communications Squadron. A Sources-Sought was posted but resulted in no responses from interested vendors. The government determined that Persistent Systems or an equal brand is the only reasonably available source that meets the requirement. The anticipated contract cost is expected to be fair and reasonable based on the independent government estimate and previous sole source awards. The government will continue to explore alternative solutions that are compatible with the existing communications equipment in future acquisitions.

I. Contracting Activity.
The 36th Contracting Squadron Andersen Air Force Base, Guam Unit 14040, Bldg 22026
APO AP 96543-4040
II. Nature and/or description of the action being processed.
A Firm Fixed Price, 100% Small Business set-aside purchase order is anticipated.
III. Description of supplies/services required to meet agency needs.
This supply requirement includes the following list of summarized items:
1. Stereo headset with Dual PTT connector - MPU5-compatible stereo headset with Persistent Systems Push-to-Talk direct-attach cable and single headset lead.
2. Vendor must be an authorized seller of Brand Name: Persistent System or Equal
3. Standard one year warranty included
4. Must be new, OEM equipment
5. Direct Shipment to Andersen, AFB, Guam
IV. Statutory authority permitting other than full and open competition.
FAR 13.106-1 (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold.
(i) Contracting officers many solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g, urgency, exclusive licensing agreements, brand-name or industrial mobilization.)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The 644th is requiring Persistent Systems' Stereo Headset since it is the only headset made that is able to directly connect to the Persistent Systems dual Push-To-Talk system with no additional cables. The 644 CBCS already has the Persistent System dual Push-to-Talk and needs the headsets that will be compatible with the existing equipment.
OEM parts are built to the exact specifications of the Brand Name: Persistent System or equal for the MPU5 Stereo Headsets. Aftermarket equipment do not guarantee the exact fit, durability and quality as OEM equipment. Therefore, it is in the best interest of the Government to procure Brand Name: Persistent System or Equal OEM Equipment to avoid potential delays in having to reorder equipment that does not fit properly.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Sources-Sought was posted to SEWP.nasa.gov on 4 Jun 2024 to 11 Jun 2024. The Sources-Sought closed on 11 Jun 2024 that resulted in zero (0) responses indicating that there was not a vendor that was capable or interested. In conclusion, the government’s best interest would be to pursue a 100% small business set-aside by soliciting a Brand Name: Persistent System or Equal MPU5 Stereo Headsets on SAM.gov.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The contractor can determine the fair and reasonable price by the independent government estimate, previous

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
A Sources-sought was posted on Sewp.nasa.gov with one Request for Information regarding quantity . However, there was no responses from vendors saying they were capable and interested in the requirement. Further search on FPDS- NG found there were small businesses with similar products that were awarded contracts with the government.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
The 644 CBCS already has the Persistent System dual Push-to-Talk, therefore they need a Persistent System or equal MPU5 Stereo Headset that will be compatible with the existing equipment.
X. List of any sources that expressed, in writing, an interest in the acquisition.
N/A
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
The government will continue to scrutinize procurements regarding communication systems and their expansions to ensure there are alternatives that are compatible with the existing Push-To-Talk system or other communication systems.
