JUSTIFICATION AND APPROVAL

SOLE SOURCE

MLE Annual Inspection

In accordance with (IAW) FAR 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or

Services Will Satisfy Agency Requirements (ref. 10 U.S.C.,2304(c)(1)).

JUSTIFICATION

(1) Contracting Activity: Department of the Air Force, 766th Specialized Contracting Squadron, Installation Acquisition Flight, 766 SCONS/PKI, 560 Central Avenue, Building 287, Joint Base Pearl

Harbor-Hickam, Hawaii 96860.

(2) Nature and/or Description of Action Being Approved: Justification and approval of Sole Source for

MLE Annual Inspection. Man Lift Mfg Company is the only responsible source, and no other services will satisfy the requirements.

(3) Description of Supplies Required to Meet the Agency’s Needs: A Hazardous Environment Boom

Man Lift, owned by 15th Maintenance Squadron Fabrication Flight is due for an annual safety inspection. A qualified technician must inspect and recertify the equipment. This requirement reoccurs annually.

(4) Statutory Authority Permitting Other Than Full and Open Competition: In accordance with 10

U.S.C., 2304(c) (1) – There is only one responsible source from which the requirement can be met. The head of an agency may use procedures other than competitive procedures when the property or services needed by the agency are available from only one responsible source, or from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.

(5) Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires

Use of the Authority Cited: The Man Lift 80EX-1865’s design is proprietary and the equipment contains controlled parts specific to the make and model of each lift. Only an OEM technician can ensure that there have been no modifications to the equipment (as modification would invalidate the recertification); that all EX related components are still within tolerance; that only certified and traceable service parts are being used; and if specific service requirements are being met.

(6) Description of Efforts Made to Ensure That Offers are Solicited from as Many Potential Sources as

Deemed Practicable: The product was initially purchased from Man Lift Mfg under Contract FA5215-

11-F-0018. As part of the contract, Man Lift Mfg was stated as required to perform the annual inspection/recertification. No other offers will be solicited. In accordance with FAR Subpart 5.2, a notice of intent to award a sole source contract to Man Lift Mfg will be posted via the government point of entry, accessed via the Internet at http://www.fedbizopps.gov.

(7) Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: In accordance with FAR 13.106-3, if only one offer is received, the Contracting

Officer will include in the contract file a statement of price reasonableness. The statement will be based on market research, comparison of proposed prices with prices found reasonable on previous purchases, current price lists, comparison with similar items in a related industry, comparison to an independent government estimate, or any other reasonable basis.

(8) Description of the Market Research Conducted and the Results: The contract that purchased the equipment required annual inspection and recertification from the manufacturing company. The previous acquisition of these services were under a separate service contract through which one base year and three option years were exercised. The fourth option year was unable to be exercised because the contractor did not reactivate its SAM registration in time. Therefore, this is a new acquistion for a continuing requirement.

(9) Any Other Facts Supporting the Use of Other Than Full and Open Competition: N/A

(10) A Listing of the Sources, if any that Expressed, in Writing, an Interest in the Acquisition: No other sources were solicited.

(11) A Statement of Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition Before any Subsequent Acquisition for the Services Required: N/A

(12) Technical and Requirements Certification: Based on the aforementioned, I certify that the facts and representations under my cognizance, which are included in this justification and form a basis for this justification, are complete and accurate.

(13) Contracting Officer Certification: IAW FAR 13.106-1(b)(1), I certify that the circumstances of this contract action deem only a single source is reasonably available.
