About this file
The document is a Single Source Justification for the maintenance of railroad crossing No. 3 on the Hachiko Line at Yokota Air Base in Japan. The contractor will be required to provide inspection, maintenance, and emergency repair services for the railroad crossing, including the roadbed, electrical systems, and related infrastructure. The justification states that East Japan Railway Company (JR East) is the only entity that can legally perform these services under Japanese law, and that awarding to any other source would result in non-compliance and unacceptable delays. The estimated contract cost is $8,522.08. The contracting activity is the 374th Contracting Squadron, and the requiring activity is the 374th Civil Engineer Squadron. Although the requirement is exempt from synopsis, it will be posted on SAM.gov. The Contracting Officer has determined that JR East is the only reasonably available source for this work.

(3) Emergency repair in the event that a sudden, unforeseen happening which requires action to correct or to protect lives and/or property, the Contractor may be directed to perform emergency repair in accordance with JR East's rules and regulations.
Section C: Justification for Soliciting from a Single Source or Brand Name
(1) Maintenance of the railway roadbed and the railroad crossing is a unique service. The Japanese Railway Business Law ("Tetsudo Jigyo-ho," Japanese Law No. 65) has given technical responsibility for the maintenance and safety of the main lines and connecting sidetracks to the owner of the main rail lines. The owner of the Hachiko Line and this particular crossing is JR East. JR East was established 01 Apr 1987 as a result of the privatization of the Japan National Railways (JNR) controlled under the Government of Japan. At that time, seven (7) companies - six (6) Passenger railway companies including JR East and Japan Freight Railway Company, which handles the freight exclusively - were formed from the privatization.
(2) Requiring Activity, 374th Civil Engineer Squadron requests that JR East is the only responsible company that can provide services properly for this requirement (See Attachment 1, RA Sole Source Justification). The 374th Contracting Squadron believes that the award to any other sources would result in noncompliance with the applicable local Japanese law and unacceptable delays in fulfilling the U.S. Government's requirements. It is unknown if the applicable law would be modified for other entities to be allowed to perform the services. The delay in awarding the follow-on contract would affect the operation and traffic around railroad crossing No.3 at Yokota Air Base.
