V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
USFJ recently completed a Joint Operations Center (JOC) modernization project, that was competed by three offerors for award. Due to current events occurring in the PACOM AOR, the USFJ/5AF Commander directed the expansion of the operational system capability to other secondary operation centers. The JOSC is a critical operations center and is the unilateral arm of 5 AF, and it is responsible for individual functional cells to have real-time common operational data that is sourced from the JOC. Specifically, the bilateral Common Operational Picture (COP) and the Shared Early Warning System are both based inside the JOC and are required to be displayed in the all the working cells in the headquarters. Without these critical components of information, bilateral planning and operational execution will be delayed. The equipment to accomplish this critical interconnectivity must be compatible to the existing system in the JOC.
Additionally, the contract for the JOC provides for a five (5) year warranty, the original equipment manufacturer will not honor support from another system integrator/provider other than USIDC. Because of the critical linkage of these cells to the JOC system, USIDC is the only vendor that can perform this work on the mission critical system.
Any other system or contractor providing this service would void the existing JOC warranty for $ in equipment.
Specifically, USIDC has stated that if a contractor other than USIDC has to re-program the systems they installed in order to integrate a third party equipment, the re-programming would nullify the warranty of the equipment being re-programmed (see Attachment 1, Email and Attachment 2, Warranty). In addition to the warranty of the equipment, USIDC also provides a local system maintenance/support 24/7 telephone warranty help desk support for one (1) year, which includes same day remote engineering support for critical system troubleshooting and less than eight (8) hour response time (even from the US) -- see Attachment 3, Cost Breakout, tab 2, line item 3 description.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
The initial JOC requirement was a full and open competition, and three vendors provided quotes, however, in accordance with the aforementioned, USIDC is the only offeror that is able to complete this mission essential add-on effort without voiding the warranty.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The initial JOC was competed, and three vendors provided quotes. We received a cost breakdown structure (see Attachment 3, Cost Breakout) from USIDC for the JOC that includes pricing for all materials, equipment, and labor.
This very recent and relevant breakout will be used to compare pricing for the new requirement. The Contracting Officer will determine the price to be fair and reasonable in accordance with FAR 13.106-3(a)(2)(ii), Comparison of the proposed price with prices found reasonable on previous purchase.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
See Attachment 4, Market Research.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
