PERFORMANCE-BASED WORK STATEMENT

FOR

GRASS/WEEDS CUTTING SERVICES

SECTION 1

1. DESCRIPTION OF SERVICES. The contractor shall provide all labor, equipment, transportation, tools, supervision, and other items and services necessary to provide services as required for grass/weeds cutting at Akizuki, Hiro and Kawakami Ammunition Depot, Japan. The contractor shall perform the scheduled grass/weeds cutting services in accordance with this Performance-based Work Statement (PWS), the attached appendices, commercial standards and practices, and applicable Japanese laws. The ammunition areas must be protected from the outbreak of fire in accordance with DA PAM 385-64,3-7, Ammunition and Explosives Safety Standards.

1.1. The contractor shall maintain grass/weeds height in accordance with the standards listed below for typical growing season, April through October. Grass/weeds cutting shall be accomplished as indicated in Appendix A, Estimated Workload Data, and Appendix B, Site Plan. Grass clippings shall be removed when visible after mowing and all grass and weeds must be disposed of off post.

1.2. Emergency and special event services. The contractor shall perform emergency or special event grass/weeds cutting required in areas not covered under this contract. Upon notification of an emergency, the contract manager shall respond within one (1) hour to meet with the Contracting Officer Representative (COR) and initiate emergency service.

Upon receiving direction by the Contracting Officer (KO), contractor personnel shall begin emergency work within 24 hours. The KO will notify the contractor as soon as a special event requirement is known, but no less than 24 hours prior to the event.

1.2.1. Emergency and special event services are not covered within the requirements of Para 1.1 of the PWS, and will require a separate contract action (modification to existing contract or separate contract). Emergency and special event service is not included in monthly unit price. Price of this service will be negotiated between the contractor and the KO. The COR and contractor will perform a 100% joint inspection to ensure the emergency and special event service work is performed and accepted.

1.2.2. Emergency and Special Event Services Procedure: Emergency and special event services are defined as non-recurring service. If the site survey is necessary, after the joint site survey is conducted between the COR and the contractor’s personnel, the contractor shall submit a price proposal for the services to the KO for review/approval. This price proposal will be accepted upon evaluation of the proposal by the KO after the COR’s technical reviews. Price of such service will be negotiated between the contractor and the KO on a case-by-case basis, and incorporated by a supplemental agreement to the contract. This emergency and special event services will be requested on demand of the Government.

1.3. Schedule. The contractor is responsible for submitting an annual schedule within 14 calendar days after contract award, and submitting monthly schedules 10 calendar days prior to each month for COR approval. The schedule shall indicate the scheduled performance date, performance area, and estimated completion date. In the event rescheduling of services becomes necessary, the contractor shall notify the COR 24 hours prior to the scheduled work time and provide a new schedule for work to be completed.

1.4. The contractor must perform all operations in a prudent, conscientious, safe and professional manner. The contractor agrees that his personnel and equipment are subject to safety inspections by government personnel while on federal property.

1.5. GENERAL INFORMATION

1.5.1. Contract Manager. Contractor shall provide a contract manager who shall be responsible for all requirements in this PWS. By the pre-performance conference the name of this person and an alternate(s), who shall act for contractor when manager is absent, shall be designated in writing to KO. The contractor shall provide telephone number of contract manager and alternate(s) for other than normal duty hours. He/She must be able to read, write, speak, and understand English. Contract manager or alternate(s) shall have full authority to act for contractor on contract matters relating to daily operation of contract.

1.5.2. The contract manager or alternate(s) shall be physically present and available within twenty-four (24) hours after normal duty hours, to meet on the installation with the COR.

1.5.3. Contractor Employees. The contractor shall not employ persons for work on this contract, if he/she is identified to the contractor by the KO as a potential threat to the health, safety, security, general well being or operational mission of the installation and its population.

1.5.4. The contractor personnel shall present a neat appearance and be easily recognized. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee's name. The contractor shall adhere to all base safety and traffic regulations and policies.

1.5.5. Quality Assurance. The Government will evaluate contractor’s performance in accordance with the Quality Assurance Surveillance Plan (QASP) by appointing COR to monitor performance to ensure services are received.

1.5.6. Government Remedies. The KO shall follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items, for the contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.5.7. Damage. The contractor shall exercise care not to damage any vehicles, facilities and grounds at Akizuki, Hiro and Kamakami Ammunition Depot. The contractor at no expense to the Government shall repair any damages determined to have been caused by the contractor. The contractor shall be responsible for verification of the job site and the existing condition of the ground.

1.5.8. Hours of Operations.

1.5.8.1. Normal Performance Hours at Hiroshima area. The facility will be made available to the contractor from 08:00 to 16:45, Monday through Friday, excluding U.S. holidays. Access to the facilities outside of these hours may be authorized by the COR with prior coordination by the contractor.

1.5.8.2. Performance during Rainy days. The working hours will be the same as normal performance hours listed in par 1.5.8.1. but the contractor shall determine either he/she may continue/start performing the specific tasks or he/she should stop performing the specific tasks during rainy days. The contractor shall consider safety and all the hazardous weather and equipment conditions during the rainy day to make determination; hence the contractor is responsible for any mishaps and damages to the contractor or the Government. In the event the contractor determines that they cannot perform, the contractor shall notify the COR to reschedule services.

1.5.8.3. Holidays. The contractor is not required to provide service on the following days:

Note: Any U.S. legal holiday that falls on Saturday will be observed on the previous Friday. If it falls on Sunday, it will be observed the following Monday.

1.5.8.4 Hours of Operation Other Than Normal. There may be situations that require the contractor to work other than normal hours. When the contractor’s access to a work area conflicts with 83rd mission requirement, the COR shall advise the s contractor and schedule work to minimize disruption. Such scheduling may require work to be accomplished at times other than normal duty hours. The payment for the rescheduled work shall be including para 1.1. of this PWS.

1.5.9. Installation Passes. The U.S. Government will issue all required Installation Passes to contractor personnel. Vehicle insurance certificate are required to obtain Base Passes and must cover the automobile liability insurance in the types and minimum amounts of (a) Bodily Injury - ¥30,000,000 per person per occurrence, in addition to the Japanese Compulsory Insurance (JCI), and (b) Property Damage - ¥3,000,000 per occurrence. The prime contractor shall be responsible for all passes issued to his/her own or subcontractor’s employees under this contract. The contractor shall return all applicable passes upon termination of employment or completion of this contract to the Japanese Pass Section, and a certificate of receipt shall be obtained.

NOTE: Contractor personnel are required to comply with U.S. Army Regulation 190-5 for personnel pass requirements. Contractors are also required to comply with U.S. Army Garrison Japan Regulation 190-13 for vehicle pass requirements. These regulations are available for the selected contractor’s review upon personnel and/or vehicle pass issuance.

1.5.10. Security Requirements. Contractor shall ensure each employee obtains required pass and identification items for access to Akizuki, Hiro and Kawakami Ammunition Depot. These items are issued by the Security Forces Pass and Registration Section, located in Building 100 at Kure PMA. Contractor and employees shall return identification cards to Security Forces within 24 hours of termination or completion of this contract. All other government identification for terminated employees shall be returned to the KO within 24 hours of termination.

1.5.11. Personnel List. Contractor shall provide a complete roster of all personnel (includes contract manager and alternate contract manager) to COR prior to performance start date. Roster must include name, address and telephone number of employee. Contractor shall maintain a current listing of employees, providing updates as changes occur.

1.5.12. Reports of Damages, Destruction, Injury, or Death

1.5.12.1. The contractor shall report all incidents of damage or destruction to property, or personal injury or death to any person, arising out of and during the performance of this contract. For the purposes of this clause, the term “property” includes equipment, freight, or property of any type, whether Government owned or not. The term “Contractor” includes the contractor, its agents, servants or employees.

1.5.12.2. The contractor shall submit these reports to the KO through the COR as follows:

1.5.12.2.1. A preliminary report shall be made as soon as practicable after the time the incident occurs. Report may be either verbal or facsimile.

1.5.12.2.2. A complete written report shall be submitted within 96 hours after occurrence of the incident. A copy of this report shall be furnished to the COR.

1.5.13. Installation Safety/Fire Regulations: The contractor is responsible for job site safety and fire prevention. Standard base procedures will be provided at the pre-performance conference.

1.5.13.1. All hazardous material must be contained and stored in the appropriate storage containers and/or cabinets. Material Safety Data Sheet (MSDS) must be maintained for all hazardous materials.

1.5.13.2. Off Limits Signs: The contractor shall provide “OFF LIMITS” signs in both English and Japanese and post them at the entrances, as appropriate or required, and at the job site. Advance information concerning the contractor’s activities and on-site schedule will be provided to building occupants through the directorate of Public Works (DPW).

1.5.14. Contingencies: In the event the Garrison Commander requests a temporary shutdown of the jobsite, the contractor will be notified in writing by the KO. Any government caused delays as a result of a temporary shutdown that may require an adjustment to the contract will be coordinated through the KO and contractor only.

1.5.15. Disposal of Materials: all debris generated from the work shall be removed from the job site and disposed by the contractor in accordance with the laws of Japan.

1.5.16. Performance of Services During Crisis Declared by the National Command Authority or Overseas Combatant Commander: In the event of emergency and/or special conditions such as national Disasters/Emergencies (tropical Cyclone, Typhoon, Heavy Snowfall, Ice Situation, Earthquake, and Post Closing), Labor Strike, and Bomb Threat, the KO may make a decision to stop or adjust/control scheduled work. The contractor shall comply with this decision, and re-schedule and/or make up all missed services at no additional charge to the Government.

1.5.17. Contractor Manpower Reporting. The office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address: https://contractormanpower.army.pentagon.mil. The required information includes: (1) KO, COR; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hour (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-contractors); (7) Total payments (including sub-contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (11) Locations where contractor and sub-contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of contractor and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimate total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor’s systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded from the web site.

SECTION 2

2. SERVICES SUMMARY.

The following Services Summary (SS) identifies the performance objectives and performance thresholds for critical tasks associated with providing support services for this requirement. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

SECTION 3

3. GOVERNMENT-FURNISHED PROPERTY AND SERVICES.

3.1. Services. The Government will provide the following services:

3.1.1. Utilities. The Government at no cost will furnish electricity and water in existing facilities to the contractor for the contractor’s use in connection with the performance of services under this contract.

3.1.1.1. Conservation of Utilities. The contractor shall instruct employees in utility conservation practice and preclude the waste of utilities.

3.1.1.2. Security Forces and Fire Protection. Upon request for assistance, the following units will provide services on installations as necessary:

Emergency Telephone for Fire, Ambulance, and the Military Police: Telephone 911

When the contractor uses the above services, the Contract Manager shall immediately report the details to the COR.

3.1.1.3. Emergency Medical. In the event of a medical emergency, accident, or injury involving the contractor personnel during performance of duties under this contract, services will be rendered in order to save life, limb or to stabilize for transportation to a local medical treatment facility. The contractor shall reimburse the Government for the emergency medical services at the prescribed rate. The contractor shall submit the report in accordance with paragraph 3.1.1.2. above.
