SECTION 1

DESCRIPTION OF SERVICES/GENERAL INFORMATION

1. DESCRIPTION OF SERVICES. The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform refuse collection and disposal services at Kure Pier6 and Hiro Ammunition Depot, Japan. The contractor shall perform to the standards in the contract as well as all local (Kure-city), GOJ, and Federal Regulations.

1.1. TYPE OF SERVICES REQUIRED. The contractor shall perform the following listed services:

1.1.1. ROUTE / SCHEDULE SUBMITTALS. The contractor shall make detailed coordination with Akizuki Sub Facility Engineer (ASFE), IMPC-JA-PW-AFE, to establish vehicle routes and refuse collection schedules. The contractor shall submit them to the Government Representative (GR) for approval ten (10) calendar days prior to the start of contract performance. The contractor shall collect all municipal waste (ippan gomi) in accordance with the instruction manuals published by Kure-city. No changes are allowed to the schedule or haul route without GRapproval. Estimated workload data is listed in Appendix B and collection points listed in Appendix C. General municipal waste collection shall be performed three times a week for Kure Pier 6 and twice a week for Hiro Ammunition Depot. Large refuse collection shall be performed through corrdination withthe GR.

1.1.2. INCLEMENT WEATHER SCHEDULE. The contractor shall perform required service under this contract during periods of inclement weather however; the contractor is not required to perform during severe weather. The contractor shall make up all missed performance within 24 hours after the severe weather has terminated.

1.1.3. EQUIPMENT. The contractor shall use standard refuse trucks designed for solid waste transport such as the rear-loading compactor trucks, etc. This requirement is to accommodate the Government’s loading procedure and assure containment during transport.

1.1.4. COLLECTION POINTS. Collection points for refuse are shown in Appendix C. The contractor shall position refuse containers for customer ease in depositing refuse. The contractor shall also position containers to minimize interference with adjacent parking areas, sidewalks, roadways, overhead utilities, trees, and other potential obstructions.

1.1.5. CUBIC METER CAPACITY. Present capacity of containers and number of containers at each location is listed in Appendix B. Volume of refuse in Appendix B is estimated data. If refuse volume fluctuates drastically, the contractor shall immediately report it to the Contracting Officer (CO).

1.1.6. COLLECTION AND SEGREGATION. The waste is roughly segregated into burnable waste, non-burnable waste by containers and large refuse however, it is considered Non-segregated (mixed) waste. After pick up, the contractor shall check and segregate waste into burnable waste, non-burnable waste or large refuse as required by local regulations of Kure-city.

The contractor shall not collect any non-municipal waste under this contract. The contractor shall notify ASFE by phone immediately (the commercial direct in-dial number of ASFE is 0823-23-1192) with the following information when the contractor finds any non-municipal waste at collection points:

· The name of waste material

· The quantity, size and approximate weight of waste material

· The location of the collection point

1.1.7. MAINTAINING CONTAINERS. The contractor shall furnish plastic bags and install them inside of the Government Furnished refuse containers in order to keep the refuse containers in a clean and sanitary condition. After servicing, the contractor shall return the containers to their original location, in an upright position, with the lids securely in place (closed). The contractor shall also be responsible for immediately cleaning up any spills, debris, etc., which may occur during the servicing of containers. Cleaning should be done on at least a semi-annual basis off-base and include thoroughly washing containers with steam, soap or detergents and water. The contractor shall provide the GR with an annual schedule for cleaning of refuse containers no later than (NLT) five (5) days prior to contract start date. The contractor shall provide an annual cleaning schedule NLT 15 days prior to the end of the current contract year for the following contract year.

1.1.7.1. MAINTAINING COLLECTION AREAS. All waste on the ground within ten feet of the containers, whether spilled by the contractor or placed there by base personnel, shall be picked up by the contractor during collection. The contractor is responsible for the cleanliness of the collection areas. This includes, but is not limited to, washing, sweeping, dusting and other janitorial services necessary to maintain the area in a clean and sanitary condition.

1.1.7.2. GOVERNMENT FURNISHED TEMPORARY REPLACEMENT CONTAINERS. During cleaning of the containers, the Government will furnish at maximum 10 containers for temporary replacement purposes. The contractor shall coordinate with the GR for use of the temporary replacement containers. Temporary replacement containers are located at building #420, Akizuki Ammunition. The contractor is responsible for transporting the Government Furnished containers to and from building # 420 at Akizuki Ammunition Depot.

1.2. OFF BASE DISPOSAL. The contractor shall transport and dispose of all collected municipal waste at an off-base disposal site approved by Kure-city. (Clean Center Kure) Disposal shall be performed in accordance with current local (Kure-city), GOJ and federal regulations and laws. The contractor shall be responsible for any permits or fees associated with the use of off-base disposal locations/facilities.

1.3. TRUCK MAINTENANCE. Trucks used for transport shall be maintained to ensure they are free of odor, dirt, debris, leaks and pests. The contractor shall keep all equipment, vehicles and/or tools in clean and sanitary condition during the contract period.

1.4. REPORTS AND RECORDS. The contractor shall provide a performance report detailing the total cubic meters of municipal waste collected and disposed of on a monthly basis. This monthly report shall be included to confirm that all collected and disposed of solid municipal waste has been treated in compliance with local (Kure-city) regulations and Japanese law.

1.5. GENERAL INFORMATION.

1.5.1. QUALITY CONTROL. The contractor shall develop procedures for refuse collection and disposal services to maintain a quality program to ensure service requirements are performed in accordance with commonly accepted commercial practices, local regulations and Japanese law. This document will be submitted to the GR for coordination and approval prior to the services start date. The contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services. The contractor shall be responsible for any unsatisfactory performance and shall take actions at the earliest possible date to correct any noted deficiencies.

1.5.2. QUALITY ASSURANCE. The GR will evaluate the contractor’s performance through intermittent on-site inspections of the contractor's quality control program and receipt of complaints from base personnel. The Government may inspect each task as completed and decrease or increase the number of quality inspections by the result of inspections. The Government will also receive and investigate complaints from various customers located on the installation. The Government will validate any complaints received. The CO will resolve any disagreements concerning the validity of a complaint. Reference Alternate Performance Plan for further quality assurance details.

1.5.3. GOVERNMENT REMEDIES. The CO shall follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items, for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.5.4. GOVERNMENT REPRESENTATIVE (GR). The authorized GR for this contract is Mr. Kazuo Hikida, Engineer, ASFE, DPW, Tel: 0823-23-1192.

1.5.5. CONTRACTOR PERSONNEL

(a) CONTRACT MANAGER. The contractor shall provide a contract manager who shall be responsible for all requirements in this PWS. The contractor shall provide telephone numbers of the contract manager and alternate(s) to the GR. He/she must be able to read and write English. The contract manager or alternate(s) shall have full authority to act for the contractor on contract matters relating to daily operation of contract.

(b) CONTRACTOR EMPLOYEES. The contractor personnel shall be easily recognizable as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges which contain the contractor’s company name and the employee’s name.

(c) Removal of Contractor’s Employees. The contractor shall utilize only experienced, responsible and capable employees in the performance of this contract. The CO may require that the contractor remove from the Government job any of his/her employees who endanger persons or property or whose continued employment under this contract is inconsistent with the interests of military security.

(d) THIRD COUNTRY NATIONALS (TCN). The Security Forces on each base control entry to the base. Under certain circumstances, the TCN might be denied entry. It is the contractor’s responsibility to coordinate with Security Forces at each base when there is a question about particular circumstances. See Appendix A.

(e) U.S. GOVERNMENT OR JAPANESE NATIONAL EMPLOYEES. The contractor shall not hire employees of the United States Government and/or MLC (Master Labor Contractor) if employing such persons would create a conflict of interest or appearance of a conflict of interest as determined by the contractor. The contractor shall not employ any person who is an employee of the Department of the Army, either military or civilian, unless such person seeks and receives approval according to DODR 5500.7, Standards of Conduct.

(f) MILITARY PERSONNEL. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment. Military Reservists and National Guard members may be subject to recall to active duty. Abrupt absence of these personnel could adversely affect contractor’s ability to perform; however, their absence at any time shall not constitute an excuse for non-performance under this contract.

1.5.6. INSTALLATION BASE PASSES. The U.S. Government will issue all required Installation/Base Passes and Controlled Area Badges to contractor personnel at no cost to the contractor. Vehicle insurance certificates are required to obtain Base Passes and must cover the automobile liability insurance in the types and minimum amounts of (a) Bodily Injury- ¥30,000,000 per person per occurrence, in addition to the Japanese Compulsory Insurance, and (b) Property Damage- ¥3,000,000 per occurrence. The prime contractor shall be responsible for all passes issued to his/her own or subcontractor’s employees under this contract. The contractor shall return all applicable passes to the Japanese Pass Section upon termination of employment or completion of this contract, and a certificate of receipt shall be obtained.

NOTE: Contractor personnel are required to comply with U.S. Army Regulation 190-5 http://www.apd.army.mil/USAPA_PUB_pubrange_P.asp for personnel pass requirements.

The contractors are also required to comply with U.S. Army Garrison Japan Regulation 190-13 https://intranet.zama.army.mil/CmdStaff/usagj/cmdgrp/doc/reg190-13.pdf for vehicle pass requirements. These regulations are available for the selected contractor’s review upon personnel and/or vehicle pass issuance.

1.5.7. SECURITY REQUIREMENTS. The contractor shall ensure each employee obtains required pass and identification items for access to the base. These items are issued by the Security Forces Pass and Registration Section, located in Building 100, Kure Pier 6. The contractor and employees shall return identification cards to Security Forces within 24 hours of termination or completion of this contract. All other government identification for terminated employees shall be returned to the CO within 24 hours of termination.

The contractor shall not commence work at the job site until an Accident Prevention Plan and a Job Hazard Analysis are submitted for review and approved by the CO or his duly assigned representative. The contractor is responsible for reviewing EM 385-1-1 http://www.usace.army.mil/publications/eng-manuals/em385-1-1/toc.htm, the U.S. Army Corps of Engineers’ Safety and Health Requirements Manual. The confined space exists in this construction site.

1.5.8. INSTALLATION SAFETY/FIRE REGULATIONS. The contractor is responsible for job site safety and fire prevention. Standard base procedures will be provided by the U.S. Government.

1.5.9. REPORTS OF DAMAGES, DESTRUCTION, INJURY, OR DEATH

(a) The contractor shall report all incidents of damage or destruction to property or personal injury or death, arising out of and during the performance of this contract. For the purposes of this clause, the term “property” includes equipment, freight or property of any type, whether Government owned or not. The term “Contractor” includes the contractor, its agents, servants or employees.

(b) The contractor shall submit these reports to the CO through the Directorate of Public Works (DPW) as follows:

(1) A preliminary report shall be made as soon as practicable after the time the incident occurs. Report may be either verbal or facsimile.

(2) A complete written report shall be submitted within 96 hours after occurrence of the incident. A copy of this report shall be furnished to the DPW.

1.5.10. HAZARDOUS MATERIALS. All hazardous materials must be contained and stored in the appropriate storage containers and/or cabinets. The contractor shall immediately report spills or releases of hazardous materials to the GR. The contractor shall be liable for containment and environmental clean up of spills or releases of such substances. The contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness and materials handling. The contractor shall comply with environmental and hazardous materials storage and handling requirements and maintain current Material Safety Data Sheets (MSDS).

1.5.11. ENVIRONMENTAL AND HAZARDOUS MATERIAL HANDLING. The contractor shall comply with municipal environmental laws to protect the health and safety of employees/residents and minimize or eliminate environmental pollution.

1.5.12. RESPONSIBILITY FOR DAMAGES. Any damages caused to U.S. Government property during the course of performing this contract shall be restored, replaced and/or repaired to its original condition at no additional cost to the U.S. Government.

1.5.13. HOURS OF OPERATION.

(a) AVAILABILITY OF FACILITIES. The facilities will be made available to the contractor from 08:00 to 16:45, Monday through Friday, excluding U.S. holidays. Access to the facilities outside of these hours may be authorized by the GR with prior coordination by the contractor.

(b) U.S. LEGAL HOLIDAYS. Recognized US legal holidays are listed below. Holidays falling on a Saturday may be observed on the preceding Friday. Holidays falling on a Sunday may be observed on the following Monday.

1.5.15. PERFORMANCE OF SERVICES DURING CRISIS DECLARED BY SECRETARY OF DEFENSE OR THE OVERSEES COMBATANT COMMANDER.

This provision is not applicable since no services are required during the crisis. The CO or GR shall notify the contractor, by any means of communication, of a crisis. There shall be no costs paid by the Government to the contractor during a crisis except those costs incurred for work performed under this contract and PWS.

1.6. LICENCE. The contractor must have the license for municipal waste collection and transportation certified by Kure-city.

1.7. CONTRACTOR MANPOWER REPORTING (CMR).

“The office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address: https://contractormanpower.army.pentagon.mil.

The required information includes: (1) Contracting Office, Contracting Officer, Contracting Officer’s Technical Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-contractors); (7) Total payments (including sub-contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (11) Locations where contractor and sub-contractor perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website);

(12) Presence of deployment or contingency contract language; and (13) Number of contractor and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year. The contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor’s systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded from the web site.

3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

3.1. REFUSE CONTAINERS. The Government will furnish refuse containers for burnable solid waste and non-burnable solid waste. The number of containers is listed in Appendix B and their locations are shown in Appendix C.

3.2. UTILITIES. The Government shall furnish available water, electricity and heat at existing outlets as may be required for the work to be performed under this contract, without cost to the contractor.

3.3 SECURITY FORCES AND FIRE PROTECTION. Upon request for assistance, Base Emergency (phone number 911) will provide necessary on base services.
